REVISED IMPLEMENTING RULES AND REGULATIONS OF REPUBLIC ACT NO. 10124, OTHERWISE KNOWN AS "AN ACT CHANGING THE NOMENCLATURE OF THE TONDO CONGRESSIONAL DISTRICT LIBRARY IN TAYUMAN, TONDO, MANILA, INTO SENTRO NG KARUNUNGAN LIBRARY, APPROPRIATING FUNDS THEREFOR AND FOR OTHER PURPOSES"

RULE I

Preliminary Provisions

SECTION 1. Title. — These Rules shall be known as the "Revised Rules and Regulations Implementing Republic Act No. 10124."

SECTION 2. Purpose. — These Revised Rules are promulgated to prescribe the guidelines to implement Republic Act No. 10124.

SECTION 3. Declaration of Policy. — It is hereby declared the national policy to promote the moral and intellectual well-being of the people, elevate the literacy level of every Filipino to the end that illiteracy is eradicated; and recognize the vital role of knowledge and information in nation-building by establishing public libraries in every congressional district throughout the Philippines. aScITE

RULE II

Status of the Library

SECTION 3. Official Name. — The official name of the library is SENTRO NG KARUNUNGAN LIBRARY (SKL).

SECTION 4. Area of Coverage. — As a congressional library, SKL primarily serves as a district library of the 2nd Congressional District of Manila. However, it is open to serve and cater to the library needs of other congressional districts of the City of Manila.

SECTION 5. Administrative Supervision. — The SENTRO NG KARUNUNGAN LIBRARY shall be under the administrative supervision and control of the National Library of the Philippines hereinafter referred to as "NLP."

RULE III

Library Personnel

SECTION 6. Appointments. — The Director of the NLP shall appoint all personnel of the SENTRO NG KARUNUNGAN LIBRARY, as may be necessary, in accordance with civil service rules and regulations.

SECTION 7. The Library Staff. — The SENTRO NG KARUNUNGAN LIBRARY shall have the following personnel:

1 Librarian III (SG 18)

1 Librarian II (SG 15)

1 Administrative Assistant III/Secretary (SG 9)

1 Administrative Aide I/Clerk-Secretary (SG 1)

3 Utility workers (Contractual)

all of whom, except contractual employees, shall possess the required Civil Service eligibilities and whose basic salaries, allowances and benefits shall be the same as those enjoyed by employees of the National Government occupying similar or equivalent position and Salary Grades, and shall be taken from the annual General Appropriations Act.

The staff of SKL may be increased through a staffing pattern to be presented and duly endorsed by the NLP to the Department of Budget and Management for approval. 1

SECTION 8. Third Party Technical Group. — Subject to existing laws and applicable government rules and regulations, the Director of NLP is hereby authorized to contract the services of a highly qualified professional group to undertake a specific work or project requiring special or technical skills not available in the library, including the library's barangay and school projects, to be accomplished within a specific period which in no case shall exceed one (1) year with a minimum of direction and supervision from the NLP. SECTION 9. Services. — Subject to applicable Government rules and regulations, the Director of the NLP is hereby authorized to enter into service contracts with private agencies to provide security and janitorial services to the library, chargeable against appropriations for SKL.

SECTION 10. Discipline. — The rules and regulations of the Civil Service Commission on the discipline of all library personnel shall be enforced by the Director of the NLP.

RULE IV

Additional Role of the Library

SECTION 11. Related Project. — The SENTRO NG KARUNUNGAN LIBRARY is hereby authorized to undertake such other related projects as may be consistent with the Declaration of Policy in Republic Act No. 7743 and in the furtherance of the VISION of the SENTRO NG KARUNUNGAN LIBRARY.

RULE V

Appropriations

SECTION 12. Appropriations. — The amount necessary for the continued operation of the Sentro ng Karunungan Library shall be charged against the current year's appropriations which shall not be less than Five million pesos (P5,000,000.00) and shall be included in the annual General Appropriations Act.

SECTION 13. Report to Congress. — NLP shall submit to Congress an Annual Report on the activities of the SENTRO NG KARUNUNGAN LIBRARY which may include, among other things, policy recommendations which require legislative action towards the total eradication of literacy.

RULE VII

Final Provisions

SECTION 14. Amendment. — These Rules and regulations may be amended but no amendment shall take effect until after fifteen (15) days following its publication in the Official Gazette or in a newspaper of general circulation.

SECTION 15. Separability Clause. — If any provision of these rules or the application thereof to any person or circumstance is held to be invalid, the provisions of the rest of the rules and the application thereof to other persons or circumstances, shall not be affected thereby.

SECTION 16. Effectivity. — These rules shall take effect fifteen (15) days after the publication thereof in the Official Gazette or in at least one (1) newspaper of general circulation. HEITAD
