Pursuant to Republic Act No. 4136, otherwise known as the Land Transportation and Traffic Code, as amended by Batas Pambansa Bilang 398, the following rules and regulations governing the accreditation of physicians by the Land Transportation Office as mandated in Administrative Order No. 85AO-005, series of 1985, are hereby revised accordingly:
SECTION I. Definition of Terms. — For purposes of this Order, the following terms as used herein shall mean as follows:
1. Accreditation — an act certifying that a physician meets the standards required by LTO to establish and operate a medical clinic within a certain geographical location for applicants of drivers and conductors licenses.
2. Accreditation Certificate — a Certificate which is valid for one-year from its issuance granting authority to physicians to conduct actual physical examinations/issue medical certificates to drivers/conductors applying for their license with LTO.
3. Clinic — refers to a place where medical examination of drivers/conductors applying for license is being conducted. It shall have an area of at least 10 square feet in area and located at least within 100-200 meter radius from the LTO Licensing Office. The clinic shall have at least the following medical equipment: Snellen's chart, Ishihara plate, blood pressure apparatus, height and weighing scale and a waiting area for applicants. aCSTDc
4. Disabled person — a person suffering from restriction or lack of ability to perform an activity in the manner within the range considered normal for a human being as a result of mental, physical or sensory impairment.
5. Emergency leave of absence — taking a leave of absence without securing prior permission provided the emergency shall be fully supported by documentary evidence.
6. Leave of Absence — absence of two (2) or more consecutive days.
7. Office — means the Land Transportation Office.
8. Physician — a reputable doctor of medicine duly licensed to practice in the Philippines and a member in good standing as attested by the Philippine Medical Association.
9. Specialized physician — refers to a reputable doctor of medicine duly licensed to practice in the Philippines with any of the following lines of specialization wherein driver's/conductors license applicants with disability could seek further evaluation.
a. Ophthalmologist — specialist for visually impaired applicant.
b. Rehabilitation Medicine Specialist — specialist for orthopedically impaired applicant.
c. Ears, Nose and Throat Specialist — specialist for speech and hearing impaired applicant.
SECTION II. Documentary Requirements (New/Renewal). —
1. Duly accomplished Application Form;
2. Certification of good moral standing to be issued by the Philippine Medical Association, Incorporated or its chapter in the locality where said physician is practicing his profession;
3. Certified true copy of Professional Regulation Commission (PRC) license as physician;
4. Certified true copy of Mayor's Permit; ETISAc
5. Original and photocopy of Tax Identification Number (TIN);
6. Original and photocopy of the latest Income Tax Return;
7. Physician's Official Receipts duly stamped and recorded by the BIR;
8. Three specimen signatures of applicant-physician;
9. Schematic floor plan of the medical clinic indicating its size and the location of the various equipments used in the conduct of the medical examination;
10. Color pictures (5R size) of the interior and exterior area of the medical clinic showing the required tables, instruments and waiting area for applicants for driver's/conductors license; and
11. Three (3) pieces passport size pictures of physician taken within three (3) months before the filing of his application/renewal.
Note: All original documents presented shall be returned to the applicants.
SECTION III. Procedure in Applying for Accreditation. —
A physician who desires to apply for accreditation with the Land Transportation Office must submit the required documents and follow this procedure, to wit:
1. The physician — applicant must secure an Application Form with LTO Regional Office where he intends to establish his clinic upon payment of One Hundred Pesos (Php100.00) Philippine currency;
2. The duly accomplished application form together with all the documentary requirements shall be submitted to the Regional Committee on Accreditation of Physicians who will evaluate the documents and conduct an ocular inspection of the medical clinic facilities and equipment. Thereafter, the Regional Director shall prepare and submit his findings/recommendation within ten (10) working days from receipt of ocular inspection report to the LTO Central Office's Committee on Accreditation of Physicians. In case of renewal, the Regional Director has a ten (10) working days within which to act on the application for accreditation.
3. The Central Office Committee on Accreditation of Physicians shall re-evaluate the documents, conduct random ocular inspection (if necessary) and submit its recommendation to the Office of the Assistant Secretary.
4. A Certificate of Accreditation shall then be issued in favor of accredited physicians and shall be valid for one (1) year from the date of its issuance. The same may be renewed within a month before its expiration date.
An expired accreditation certificate shall mean that the accredited physician cannot issue a valid medical certificate; hence, the same shall not be honored by LTO.
5. The Accreditation Certificate shall be forwarded to the Regional Office who shall charge the amount of One Thousand Pesos (Php1,000.00) Philippine currency from accredited physicians, representing accreditation fee.
SECTION IV. Duties/Responsibilities of an Accredited Physician
1. He shall personally hold clinic within the same municipality or city of the licensing center/agency where he is accredited.
In case he opted to transfer his clinic, the accredited physician must secure first the permission/approval of the Regional Committee on Accreditation of Physicians before actual transfer has to be done. In case the request for transfer is denied, the Regional Director must place his decision in writing. The accredited physician may file an appeal with the Assistant Secretary within fifteen (15) days from receipt of said denial.
2. The accredited physician after personally having examined the drivers/conductors shall issue medical certificates. The minimum requirements that need to be incorporated to the medical certificate is hereto attached and made as integral part of this Administrative Order.
In certain exceptional cases as filing of re-examination to another LTO District Office with a valid medical certificate, the medical certificate may be accepted in another licensing agency outside the accredited physician's jurisdiction provided the Head of district Offices refers or endorses the same. 3. Professional fee per medical certificate issued to drivers/conductors must not exceed One Hundred Pesos (Php100.00) Philippine currency.
4. The accredited physician shall keep medical records of all his clients/patients and his findings and recommendations, copies of which shall be submitted to the Regional Committee on Accreditation of Physician within fifteen (15) days at the end of every month, copy furnished LTO Central Office Accreditation Committee.
5. The accredited physician shall display his Accreditation Certificate with his recent photograph and displayed at a conspicuous place in his clinic.
6. In case the accredited physician decides to take leave of absence, or discontinue his operation, a written notice within ten (10) days prior to his proposed leave must be filed with the LTO District Office, Regional and Central Office Committee on Accreditation so as the latter will be given ample time to address the gap that may be created because of such absence.
7. The accredited physician undertakes to comply with all the rules and regulations promulgated by the Land Transportation Office.
SECTION V. Penalties/Sanctions. —
The Land Transportation Office may suspend/revoke and impose fines after proper notice and hearing, in any of the following instances:
1. Revocation/Cancellation of Accreditation
a) In case of fraud or misrepresentation in procuring the accreditation certificate.
b) The presence of pre-signed Medical Certificate in the clinic.
c) Allowing other person/physician to conduct the required medical examination.
d) In case of conviction of a crime involving moral turpitude. HcDATC
e) Conducting medical examination outside the jurisdiction where he/she is accredited.
2. Suspension for Six (6) Months of Accreditation.
a) Failure to indicate appropriate driving restriction/condition.
b) Medical certificate issued to persons with disability and was recommended to be issued a professional driver's license.
3. Failure to submit a monthly report of all applicants examined and their recommendations:

SECTION VI. Repealing Clause. —
All rules and regulations inconsistent with this Administration Order are hereby deemed repealed, revoked or modified accordingly.
SECTION VII. Effectivity. —
This Administrative Order shall take effect fifteen (15) days from the date of its publication in a newspaper of general circulation.
