Revised New Fees/Rates of Fees and Charges Relative to the Regulation of Firearms and Ammunition
PNP Fiscal Directive No. 012-15, dated October 19, 2015, outlines the revised fees and charges associated with the regulation of firearms and ammunition in the Philippines, as mandated by Republic Act No. 10591. The directive introduces a new Special Bank Receipt Less System (SBRLS) and an Electronic Payment Portal (EPP) to facilitate online payments for licenses and registrations, enhancing convenience and efficiency. REVISED NEW FEES/RATES OF FEES AND CHARGES RELATIVE TO THE REGULATION OF FIREARMS AND AMMUNITION
I. References:
a. Republic Act No. 10591 entitled "The Comprehensive Firearms and Ammunition Regulation Act" and its Implementing Rules and Regulations;
b. Fiscal Directive No. 20-002 dated February 9, 2000 entitled "New Payment Scheme of the PNP Trust Receipts" (For FED and SAGSD);
c. Undated Fiscal Directive No. 2014-03 entitled "New Policies and Procedures in the Collection of Payments for Firearm License Cards and other Similar Cards, and the Utilization Thereof";and
d. Approved Revision of Fees Committee Resolution No. 01-2014 entitled "Resolution Recommending the Approval of the Proposed New Fees/Rates of Fees and Charges Relative to the Regulation of Firearms and Ammunition".
II. Purpose:
This Fiscal Directive prescribes the new fees/rates of fees and charges relative to the regulation of firearms and ammunition in the country in order to defray the expenses related to the effective implementation of the provisions of RA No. 10591.
Likewise the Landbank Camp Crame Branch and the PNP shall implement the new Special Bank Receipt Less System (SBRLS) to provide a more convenient and paperless mode of issuance of Order of Payment (OP) for the payment of License to Own and Possess Firearms (LTOPF) and Firearms Registration.
Additionally, this Fiscal Directive prescribes the procedure for Electronic Payment Portal (EPP) designed and operated by Landbank, an internet based payment system that allows PNP clients and stakeholders to pay the new fees/charges relative to the regulation of firearms and ammunition via internet and view payment/transaction in real time.
III. Definition of Terms:
Order of Payment (OP) — is a controlled form issued by the proper Processing and Licensing Office of the PNP to the LBP and its designated branches directing the latter to accept payment of the fees and charges imposed by the PNP in pursuit of its statutory and regulatory functions.
Special Bank Receipt (SBR) — is an accountable form transferred by the PNP to the Land Bank of the Philippines (LBP) through a Memorandum Receipt (MR) which shall be issued as proof of payment in the collection of fees and charges imposed in pursuit of the statutory and regulatory functions of the PNP. Special Bank Receipt Less System (SBRLS) — a paperless system of issuance of SBR/OP to provide a more convenient mode of Acceptance of Payment for License to Own and Possess Firearms (LTOPF) and Firearms Registration.
Rates/Fees — schedule of fees fixed by this directive for payment of firearms license cards and other similar cards.
Electronic Payment Portal (ePP) — an internet based payment system that allows clients to pay for products/services of both government and private institutions and allows partner-merchants to view payment transaction in real time.
Licensed Citizen — refers to any Filipino who complies with the qualifications set forth in RA No. 10591 and duly issued with a license to own and possess or carry firearms outside of the residence in accordance with RA No. 10591 and its IRR.
License to Own and Possess Firearms (LTOPF) — refers to a written authority granted by the Chief, PNP through the Chief, FEO to a qualified individual for him/her to own and possess firearm in accordance with this IRR.
IV. Scope:
a. This covers all active PNP/AFP personnel, LGUs, security agencies, firearms stakeholders, other duly authorized and all qualified individuals/organizations firearm holders nationwide, including members of the Philippine Bar, certified public accountants, accredited media practitioners, bank tellers, priests, ministers, rabbi, imams, physicians, nurses, engineers and businessmen;
b. All government employees and retirees from the government service and military reservists shall have 50% discount on fees for License to Own and Possess Firearms and registration of firearms;
c. Senior citizens who are not active or retired government employees, shall have 20% discount on fees for License to Own and Possess Firearms and registration of firearms;
d. All government employees and retirees from the government service, military reservists or senior citizens shall only pay the card fee for PTCFOR.
V. Procedural Guidelines:
A. On Collection:
1. Online Collection Facility (Oncoll)
a. The PNP shall maintain with Landbank Camp Crame Circle Branch a current account under the name "PNP Firearms Scholarship Fund" which shall be the PNP's main deposit account wherein all collections/payments accepted over the counter by Landbank branches for firearms shall be credited. The main deposit account shall be subject to Landbank's existing rules and regulations governing opening/maintenance of deposit account.
b. The PNP shall system generate an OP number and send the same to the applicant via SMS containing the following information:
1) PNP FEO Account Name and Number;
2) Reference No. 1: Name of Applicant;
3) Reference No. 2: OP Number;
4) Reference No. 3: None;
5) Total amount to be paid.
c. The CSG-FEO shall release LTOPF and Firearms Registration ID cards to applicant if payment is made. (see Diagram on Tab "C").
d. The PNP shall maintain with the Landbank clearing account No. 1862-2220-71 which shall be used for all payments/collections received by collecting on-line branches in behalf of the PNP. After end of the day batch processing, total credits of the clearing account shall be transferred automatically to the PNP current account.
2. Electronic Payment Portal (ePP)
a. The PNP shall ensure the availability of its internet facility to Landbank, provide relevant data, information and technical support for the implementation of Landbank ePP.
b. The PNP clients/stakeholders to make use of ePP shall have a maintaining peso denomination accounts with LANDBANK.
c. The system shall issue a transaction Reference Number to clients via Payment Confirmation Slip and electronic official receipt (OR) relating to the online transactions.
d. The PNP clients shall present the Payment Confirmation Slip or OR relating to the transaction for the printing of LTOPF and Firearms Registration ID cards.
3. Payment through OP and SBR:
a. The PNP Finance Service shall use the existing PNP Trust Receipts account dedicated purely for the collection of payments generated from the new fees/rates of fees and charges relative to the implementation of RA No. 10591. AScHCD
b. The PNP Finance Service shall centrally manage the procurement and printing of the Special Bank Receipts (SBRs) thru the National Printing Office and transfer the Accountability of the Forms to the Manager, LBP Camp Crame Branch thru an MR. The SBRs shall be printed in quadruplicate copies and carbonized.
c. Upon approval of the application, the duly designated responsible officer of FEO/concern unit shall return to the applicant a copy of the approved application form and issue Order of Payment for License to Own and Possess Firearms and Registration of Firearms.
d. The FEO/concern unit upon receipt of validated copies of OPs, SBRs and approved application papers, shall print the LTOPF card/other Firearm Registration cards and shall cause issuance of LTOPF/Firearms Registration ID card.
B. On Accounting:
Accounting of fees/rates of fees and charges generated from firearms new fees/rates of fees and charges relative to the implementation of RA No. 10591.
1. The CSG (Attn: Budget and Fiscal Section) shall download daily from Landbank weAccess via the secured file transfer protocol (SFTP) the online collection report and prepare a monthly report not later than every 15th of the following month on processed LTOPF/Firearms Registration applications and reconcile with the report of The Directorate for Comptrollership (Attention: Accounting Division).
2. On payments made through ePP, the CSG-BFO shall inquire through the system on the number and total amount of transaction per day in accordance with the Report Format similar to the Merchant Payment Inquiry screen.
3. The CSG (Attn: Budget and Fiscal section) shall receive from LBP Camp Crame the monthly processed copies of OPs and SBRs not later than the 15th day of the following month. Likewise, DC (Attn: Accounting Division) shall receive the Auditor's Copy of the OPs and SBRs for audit and reconciliation.
4. The Directorate for Comptrollership (Attn: Accounting Division) shall reconcile the bank statements with the Credit Advice, Abstracts of Daily Collections, Consolidated Order of Payment Forms and the machine validated Special Bank Receipts not later than the last day of the month for the payment received from the 1st day to the 15th day of the month and not later than the 15th day of the following month for the payment received from the 16th to the last day of the month.
5. The Directorate for Comptrollership (Attn: Accounting Division) shall issue a certificate of monthly collection generated from License to Own and Possess Firearms (LTOPF) and Registration of Firearms to CSG (Attn: Budget and Fiscal Section) copy furnish Management Division, DC not later than the 25th day of the month for payments received from the previous month.
C. On Utilization of Fees
The FEO and other PNP Offices/Units involved in the processing of documents and monitoring of firearms and explosives shall retain twenty (20%) of the total collections for firearms and explosives fees and charges to fund direct operational expenses pursuant to Section 3 of EO 256 dated December 21, 1995.
D. Disbursement
All disbursements shall be made in accordance with the approved POE, subject to existing accounting and auditing rules and regulations. The corresponding supporting documents shall be identified and likewise bear the sub-responsibility Code "184-AO257".
VI. Rates of Fees and Charges of Firearms and Ammunition:
a. For License to Own and Possess Firearms (LTOPF) which shall be paid by the qualified individual and will be valid for two (2) years:

f. Licensed antique firearm collector shall register serviceable antique firearm and renew the same with the FEO with the following Schedule of Fees and will be valid for four (4) years:

The aforementioned new fees/rates of fees and charges have been deliberated upon by the PNP and firearm stakeholders in a series of meetings during the last stages in the formulation of the implementing rules and regulations of RA No. 10591. cDHAES
VII. Coordinating Instructions:
a. The Director, Civil Security Group (CSG) shall issue the Order of Payment forms to all processing offices and units in series for monitoring and control. Director, CSG will submit to DC (Attn: Accounting Division) a Monthly Summary Lists of OPs issued NLT the 15th day of the following month.
b. The Director, PNP Finance Service shall designate a responsible officer who will be in charge of the custody and accounting of the collection of LTOPF/Firearms Registration fees and charges. The designated responsible officer must be properly bonded.
c. The Director, PNP Finance Service shall submit to DC (Attn: Accounting Division) a Monthly Report of Accountability for Accountable Forms for used and unused SBRs, NLT the 15th day of the following month.
d. The DC (Attn: C, Accounting Division) shall reconcile the Bank statements with the Credit Advice, Abstract of Daily Collections, Consolidated Order of Payment Forms and the machine validated Special Bank Receipts not later than the last day of the month for payment received from the 1st day to the 15th day of the month and not later than the 15th day of the following month for the payment received from the 16th to the last day of the month.
VIII. Recission:
All issuance, directives, and policies which are inconsistent with this Directive are hereby repealed and modified accordingly.
IX. Effectivity:
This Directive shall take effect after fifteen (15) days from filing of a copy with the University of the Philippines Law Center pursuant to Section 3 and 4, Chapter 2, Book VII, Executive Order No. 292, otherwise known as "The Revised Administrative Code of 1987" as amended.
