SENATE RESOLUTION NO. 099
RESOLUTION CONCURRING IN THE ACCEPTANCE OF THE AGREEMENT TO PROMOTE COMPLIANCE WITH INTERNATIONAL CONSERVATION AND MANAGEMENT MEASURES BY FISHING VESSELS ON THE HIGH SEAS
WHEREAS, the Constitution, Article VII, Section 21, states: "No treaty or international agreement shall be valid and effective unless concurred in by at least two-thirds of all the Members of the Senate";
WHEREAS, the Agreement to Promote Compliance with International Conservation and Management Measures by Fishing Vessels on the High Seas was signed on 24 November 1993;
WHEREAS, the Agreement applies to all fishing vessels authorized by the State Party to fly its flag on the high seas for fishing operations;
WHEREAS, the Agreement establishes flag State responsibility in ensuring that fishing vessels, entitled to fly the flag of a State Party, do not engage in activities that undermine the effectiveness of international conservation and management measures;
WHEREAS, the President of the Philippines ratified the Agreement on 10 August 2017 and submitted it to the Senate for concurrence, in accordance with the Constitution;
WHEREAS, in the hearing conducted by the Senate Committee on Foreign Relations on 20 February 2018, the following government agencies endorsed the concurrence to the acceptance of the Agreement:
1) Department of Foreign Affairs;
2) Department of Justice;
3) Philippine Ports Authority;
4) Maritime Industry Authority;
5) Bureau of Fisheries and Aquatic Resources;
6) Philippine Fisheries Development Authority; and
7) Philippine Navy.
Now, therefore, be it
Resolved, That the Philippine Senate concur, as it hereby concurs, in the Philippine acceptance of the Agreement to Promote Compliance with International Conservation and Management Measures by Fishing Vessels on the High Seas.
Resolved, finally, That the President of the Philippines may, with the concurrence of two-thirds of all the Members of the Senate, withdraw from the Agreement. ICHDca
