NWPC RESOLUTION NO. 02-14
RESOLUTION AMENDING SECTION 16 OF THE RULES OF PROCEDURE ON MINIMUM WAGE FIXING FOR DOMESTIC WORKERS
WHEREAS, in NWPC Guidelines No. 01, Series of 2014 (Rules of Procedure on Minimum Wage Fixing for Domestic Workers) issued by the Commission on 28 August 2014 the provision of Section 16 thereof regarding quorum and voting requirement was inadvertently formulated based on Rule VI, NWPC Guidelines No. 01, Series of 2007 (Amended Rules of Procedure on Minimum Wage Fixing);
WHEREAS, Rule VI of the Amended Rules of Procedure on Minimum Wage Fixing is no longer applicable due to amendment under NWPC Resolution No. 05 Series of 2011 issued on 10 June 2011.
RESOLVED THEREFORE, as it is hereby resolved that Section 16 of NWPC Guidelines No. 01, Series of 2014 or Rules of Procedure on Minimum Wage Fixing for Domestic Workers be amended to conform with the NWPC Resolution No. 05, Series of 2011 which reads, as follows:
"Section 16. Quorum and Voting Requirements. — The affirmative vote of the majority of the members constituting a quorum shall be necessary to carry an action or decision of the Board in any wage issues, subject to the following conditions:
a. The meeting shall have a quorum wherein the Chairman or Vice-Chairman shall act as the presiding officer. To constitute a quorum, at least four (4) members of the Commission or Board must be present, provided each sector shall be represented. However, the commission or board may dispense with the presence of any sectoral representation if the latter shall fail to attend two (2) consecutive scheduled meetings with proper notice.
b. In voting, majority of the quorum shall carry an action or decision of the Commission or Board, provided that at least two (2) sectors voted for the decision." cDCEIA
