EMB MEMORANDUM CIRCULAR NO. 001-16
| SUBJECT | : | Requiring Online Submission of Compliance Monitoring Reports (CMR) Under the Philippine Environmental Impact Statement System (PEISS) |
WHEREAS, it is the policy of the state to attain and maintain a rational and orderly balance between socio-economic growth and environmental protection;
WHEREAS, the attainment of the aforementioned objectives by the PEISS necessarily includes an efficient and effective monitoring of projects that were issued Environmental Compliance Certificates (ECCs), the implementation of which is anchored on strict compliance by the proponents with their committed Environmental Management Plan (EMP) as well as agreement with the conditions stipulated in the said ECCs;
WHEREAS, DENR Administrative Order No. 2003-30 recognizes the importance of the participation by the project proponents in conducting self-monitoring and submitting semi-annual monitoring reports to this Bureau;
WHEREAS, the submitted reports shall be submitted online for the efficient evaluation by this Bureau of the CMRs filed, as well as to establish a database to create trends and accurately monitor project proponents' performance; DETACa
WHEREAS, the foregoing requirement is consistent with Presidential Administrative Order No. 42 which provides for the strengthening of the implementation of PEISS particularly on developing information systems on policy, program and projects levels to among others effectively disseminate critical information to the public;
WHEREFORE, in view of achieving the foregoing objectives, the proponent shall submit its compliance monitoring report through the online information system;
SECTION I. Applicability. —
Online submission of CMR shall be limited to Environmentally Critical Projects (ECPs) with ECCs issued by the EMB — Central Office.
SECTION II. Procedures. —
1. Visit the EMB-EIA website and register to obtain a CMR online account;
2. Attach PDF file of the following in support of the registration:
a. Government and/or company ID
b. Notarized authorization from the project proponent
c. SEC or DTI registration
3. Provide the project ECC reference number to connect to the existing information system of EIA;
4. Fill-up the CMR form provided by the online system;
5. Attach the electronic/pdf file of the following:
a. Laboratory Results of Analysis from DENR-EMB recognized laboratory;
b. Impact Mitigation Plan in the EIS/other EIS update documents;
c. Environmental Monitoring Plan in the EIS/other EIS Update Documents;
d. Accomplished project environmental monitoring and audit prioritization scheme (PEMAPS) questionnaire;
e. Notarized Sworn Accountability Statement of Proponent.
6. The EMB Central Office will evaluate the CMR submitted online, the proponent shall be informed of the evaluation through its online account.
SECTION III. Frequency of Submission. —
The first CMR shall be submitted on July covering the first and second quarter while the second CMR covering the third and fourth quarter shall be submitted January of the following year.
SECTION IV. Transitory Provision. —
The submission of second CMR (January 2016) covering compliance during the second semester (July to December) of the year 2015 shall be done through both the online system as well as filing hard copies with the EMB Central Office.
SECTION V. Penalty. —
Non-submission or submission of falsified CMRs shall be dealt with severely in accordance with the penal provisions of Presidential Decree No. 1586 and the implementing rules and regulations thereof. TIADCc
SECTION VI. Repealing Clause. —
All provisions in the Memorandum Circular No. 2007-02 or the Revised Procedural Manual of DAO 2003-30 and other issuances inconsistent herewith are deemed repealed, superseded and/or modified accordingly.
If any provision of this Memorandum Circular is declared unconstitutional or invalid by a competent court, other sections or provisions hereof which are not affected thereby shall continue to be in full force and effect as if the provisions/sections so cancelled had never been incorporated herein.
SECTION VII. Effectivity. —
This Memorandum Circular shall take effect five (5) days after publication in a newspaper of general circulation.
