IPO OFFICE ORDER NO. 02-04
| SUBJECT | : | Requirement of Notice of Registration of Trademarks, Patents, Utility Models, Industrial Designs and Layout Designs (Topographies) of Integrated Circuits |
WHEREAS, it is important to give notice to the public that a particular trademark, invention, utility model, industrial design and layout design (topography) of integrated circuits is registered with the Intellectual Property Office of the Philippines (IPOPHIL) in order to recover damages pursuant to Sections 80 and 158 of Republic Act No. 8293, otherwise known as the Intellectual Property Code of the Philippines;
WHEREAS, notices of registration appearing in the goods and/or packaging thereof registered with IPOPHIL still bear the name of Philippine Patent Office that no longer exists at present and which was succeeded by the IPOPHIL pursuant to the IP Code;
WHEREAS, there is a need to correct the old notices of registration in accordance with law;
WHEREFORE, the following rules are hereby promulgated as follows:
1. The registrant of a trademark, invention, utility model, industrial design and layout design (topography) of integrated circuits shall give notice that the same is registered by displaying with the mark the words "Registered Mark" or the letter R within a circle or "Reg. IPOPHIL" or on the registered or patented product or on the container or packaging thereof or on the advertising material relating thereto the words "Philippine Patent" or "Reg. IPOPHIL" and the patent number, as the case may be.
2. Ms. Eleanor B. Meñez, Administrative Officer III, is hereby directed to immediately file three (3) certified copies of these Rules with the University of the Philippines Law Center, and, one (1) certified copy each to the Office of the President, the Senate of the Philippines, the House of Representatives, the Supreme Court of the Philippines, and the National Library.
3. Mr. Restituto E. Maligaya, Division Chief, Operations and Maintenance Division, MIS-EDP Bureau, is hereby directed to post this Office Order in the IPO website immediately upon receipt hereof.
These rules and regulations shall take effect on 01 February 2004 after publication in a newspaper of general circulation not later than 15 January 2004.
