REQUEST OF RETIRED SUPREME COURT AND COURT OF APPEALS JUSTICES FOR INCREASE/ADJUSTMENT OF THEIR DECEMBER 1998 PENSIONS
RESOLUTION
Acting on the Memorandum dated 5 May 2003 of Ms. Adoracion S. Yulo and upon recommendation of the Office of the Chief Attorney, the Court Resolved to:
(a) DECLARE that the resolution of 11 March 2003 took effect in 1998;
(b) REQUIRE the reimbursement/refund of Christmas bonuses erroneously released to and received by the retired but re-employed Justices of this Court and the Court of Appeals; and
(c) DIRECT the Fiscal Management and Budget Office to (i) furnish all re-appointed retired Justices who erroneously received extra Christmas bonuses with copies of this resolution and the resolution of 11 March 2003 and (ii) communicate with said Justices for the purpose of giving them the option of reimbursing erroneously received Christmas bonuses by such means as (1) immediate and full refund thereof, (2) reimbursement by monthly installments whereby the FM BO and the recipient should forge an agreement on the manner by which payment should be made, or (3) waiver of receipt of future Christmas bonuses, provided that in no way should reimbursements/refunds be made through withholding of their pensions or retirement gratuities or portions thereof."
