MIA MEMORANDUM CIRCULAR NO. 192

WHEREAS, MARINA Memorandum Circular No. 189 (Re: Rules Providing Indemnity of P100,000.00 to each Unmanifested Passenger Onboard Passenger-Carrying, Ships in the Domestic Trade) was approved during the 164th Regular Board Meeting held last 09 July 2003;
WHEREAS, the aforementioned Memorandum Circular was published in the Manila Standard, a newspaper of general circulation, on 19 July 2003, and became effective on the same date, pursuant to Section VII of the said Memorandum Circular;
WHEREAS, the grant of full indemnity to Unmanifested Passengers in the amount of P100,000.00 to be shouldered jointly and solidarily by the shipowner/ship operator and/or insurance company, as provided under Section III of said Memorandum Circular, will put a premium on "unmanifested" passengers and will not prevent the occurrence of unticketed/unmanifested passengers onboard domestic passenger vessels;
WHEREFORE, pursuant to the provisions of the Public Service Act, as amended, Presidential Decree No. 474 and Executive Order No. 125, as amended, it is hereby approved, as follows:
1. "Unmanifested" passengers shall not be entitled to claim payment of the indemnity under the passenger insurance policy;
2. MARINA Memorandum Circular 189 is hereby repealed IN TOTO, and MARINA Memorandum Circular Nos. 180 and 149 are amended/modified accordingly; HCSEIT
3. The Philippine Ports Authority (PPA) is directed to ensure the installation of passenger terminal/s in each port nationwide to ensure that every passenger should be manifested;
4. The riding passengers are required to be at the port terminal/point of embarkation at least one (1) hour before their scheduled departure; and,
5. In ports where there are no passenger terminals, the PPA is directed to address the problem of unmanifested passenger/s and overcrowding. SEIDAC
EFFECTIVITY
This Memorandum Circular shall take effect immediately upon its publication once in a newspaper of general circulation.
