EXECUTIVE ORDER NO. 907
DIRECTING THE REORGANIZATION OF THE PHILIPPINE TOURISM AUTHORITY AS THE TOURISM INFRASTRUCTURE AND ENTERPRISE ZONE AUTHORITY AND PROVIDING INCENTIVES FOR ITS EMPLOYEES WHO MAY BE AFFECTED BY THE REORGANIZATION
WHEREAS, pursuant to Republic Act No. 9593 otherwise known as the Tourism Act of 2009, the Philippine Tourism Authority (PTA) has been reorganized as the Tourism Infrastructure and Enterprise Zone Authority (TIEZA); DHacTC
WHEREAS, there is a need for the TIEZA to examine its role, scope and focus and determine the appropriate institutional arrangements that will enable it to best carry out its mandate;
WHEREAS, such re-engineering efforts may result in the design of a new organization, staffing and compensation structures;
NOW THEREFORE, I, GLORIA MACAPAGAL-ARROYO, President of the Republic of the Philippines, by virtue of the powers vested upon me by law, do hereby order the strategic review of the operation and organization of the Philippine Tourism Authority (PTA) herein reorganized into the Tourism Infrastructure and Enterprise Zone Authority (TIEZA), as follows:
SECTION 1. Objective. — The reorganization of the PTA shall be undertaken to review and improve its operations as TIEZA to enable it to become more purposive in the pursuance of expanded services and functions.
SECTION 2. Staffing. — The TIEZA shall establish the most appropriate staffing pattern and qualification standards for all positions under the new structure. The revised organization structure and staffing pattern (OSSP) shall be subject to the approval of the TIEZA Board of Directors and the Department of Budget and Management (DBM).
The DBM shall review and issue the final OSSP within ten (10) days from the signing of this Executive Order.
SECTION 3. Compensation Plan. — Consistent with Section 105 of Republic Act 9593, the compensation plan of the reorganized TIEZA shall be comparable with the prevailing compensation plans in the private sector to the extent practicable within the law.
SECTION 4. Personnel-Related Movements. — All personnel movements resulting from the reorganization shall be implemented within the provision of Republic Act No. 6656, entitled "An Act to Protect the Security of Tenure of Civil Service Officers and Employees in the Implementation of Government Reorganization," and its implementing guidelines, specifically Memorandum Circular No. 13 of the Civil Service Commission.
SECTION 5. Retirement/Separation. — Any PTA employee who elects to leave the service or retire or who may be adversely affected by the Corporation's reorganization as TIEZA shall be entitled to separation benefits as may be provided under existing laws governing the Civil Service or other laws or issuances, whichever may be beneficial to the employee concerned. Such separation benefits shall be in addition to all gratuities and benefits to which they may be entitled under the law. AEITDH
SECTION 6. Incentive and Assistance. — The TIEZA, subject to the approval, of its Board of Directors, may adopt and implement an incentive and assistance package for those who may opt to voluntarily leave or retire from the service within the period provided for the purpose and for those who may be adversely affected thereby, such as, but not limited to, those whose positions will be declared redundant, without prejudice to other benefits provided under existing laws.
SECTION 7. If any provision of this Executive Order shall be declared unconstitutional, the remainder of the Order not otherwise affected shall remain in effect.
SECTION 8. This Executive Order shall take effect immediately.
