SUPREME COURT MEMORANDUM ORDER NO. 32-11

WHEREAS, under the existing policy of the Court on foreign travels which was issued on November 6, 2000 through Memorandum Circular No. 14-2000, it provides that "no official or employee of the Supreme Court in particular and the Judiciary in general shall leave for any foreign country, whether on official business or official time or at one's own expense, without first obtaining permission from the Supreme Court through the Chief Justice and the Chairmen of the Divisions pursuant to the resolution of the Court in A.M. No. 99-12-08-SC dated January 18, 2000." HIETAc
WHEREAS, the Court En Banc in its Resolution in A.M. No. 09-7-03-O (Amended) dated February 1, 2011, has set the maximum period for vacation leave of absence of officials and employees of the Judiciary, including the extension thereof, to thirty (30) working days, except in cases of study leave/scholarship grants or sick leave with medical certificate.
WHEREAS, it has been reported to the Court that some personnel of the Supreme Court had gone to foreign countries without obtaining prior permission to travel. The applications for vacation leave of absence for purposes of travelling abroad are even belatedly filed by employees upon their return from such leave.
WHEREAS, oftentimes, this practice repeatedly goes on. This is a gross violation of the said policy on foreign travels of government employees and of the leave laws, rules and regulations in the Civil Service which can be a ground for disciplinary action.
NOW, THEREFORE, for consistency and uniformity and to protect the interest of the public service, the Court reiterates the policy of securing prior permission or authority from the Court for foreign travels of its officials and employees even at the travellers' expense. Applications for foreign travel shall be coursed through, and evaluated and recommended for appropriate action by the Chiefs of Offices for Supreme Court officials and employees. Applications for leave of absence for travel outside the country without the required permission or authority shall forthwith be denied.
This Memorandum Order shall take effect upon its approval.
The Office of Administrative Services (OAS) shall strictly implement this Memorandum Order. THDIaC
