Regulating the Tax-Free Importation of Government Agencies
Presidential Decree No. 882, enacted on January 30, 1976, regulates the tax-free importation of goods by government agencies and government-owned or controlled corporations in the Philippines. It mandates that such importations require prior approval from an Inter-Agency Committee, which ensures that no locally available products can meet the needs of the importing agency and that the goods are essential for their operations. The decree prohibits the sale or disposal of tax-free imported articles without prior approval, and any transfer to a taxable entity incurs customs duties and taxes. Appeals against the Committee's decisions can be made to the Office of the President, with the importation suspended during the appeal process. The decree is effective immediately.
