Procedure for Issuance of Certificate of Registration Pursuant to Arts. 16 and 18 of RA 9520 in Relation to Sec. 16 (a) of MC 2011-15
CDA Memorandum Circular No. 003-13 outlines the procedures for issuing a Certificate of Registration for cooperatives under R.A. 9520. It mandates that the Authority must decide on registration applications within 60 days, or the application is deemed approved unless delays are due to the applicant. If an application is not acted upon in this time frame, the cooperative must submit a written request to the Authority, which will then verify the completeness of the documents submitted. For amendments to Articles of Cooperation and By-Laws, a similar process applies but with a 30-day decision period.

Article 18. Amendment of Articles of Cooperation and By-Laws. —
Unless otherwise prescribed by this Code and for legitimate purposes, any provision or matter stated in the articles of cooperation and by-laws may be amended by two-thirds (2/3) vote of all the members with voting rights without prejudice to the right of the dissenting members to exercise their right to withdraw their membership under Article 30.
