PRESCRIBING THE HARMONIZATION OF PROCESSES IN THE APPROVAL OF RESOLUTIONS FOR PROMOTION OF PNP UNIFORMED PERSONNEL TO THIRD LEVEL POSITIONS, CONFIRMATION OF DESIGNATION TO KEY POSITIONS OF PNP SENIOR OFFICERS, CONFIRMATION OF RANK ADJUSTMENT OF PNP UNIFORMED PERSONNEL, CONFIRMATION OF DESIGNATION OR DETAIL AS POLICE ATTACHÉ AND GRANTING OF EXEMPTION FROM ATTRITION OF PNP UNIFORMED PERSONNEL

WHEREAS, Republic Act No. 6975, as amended by Republic Act No. 8551, placed the Philippine National Police (PNP) under the administrative control and operational supervision of the National Police Commission (NAPOLCOM); HTcADC

WHEREAS, Section 5 of Republic Act No. 8551, the NAPOLCOM's administrative control and operational supervision over the PNP includes the authority to "develop policies xxx prescribing rules and regulations for efficient organization, administration, and operation, including xxx recruitment, selection, promotion, and retirement of personnel xxx";

WHEREAS, in order to ensure the expeditious and prompt approval by the NAPOLCOM of Resolutions for the promotion of PNP personnel to third level positions, confirmation of designation to key positions of PNP senior officers, confirmation of rank adjustment of PNP uniformed personnel, confirmation of designation or detail as Police Attaché, and granting of exemption from attrition of PNP uniformed personnel, there is a need to prescribe an enhanced and expedited system that encourages a harmonization of PNP and NAPOLCOM processes in relation thereto;

NOW, THEREFORE, the NAPOLCOM, pursuant to its constitutional and statutory mandates, HEREBY RESOLVES to prescribe the harmonization of processes for the approval by the Commission En Banc of Resolutions for placement and promotion of PNP uniformed personnel, as follows:

SECTION 1. Resolutions on Promotion, Placement and Grant of Waiver from Attrition of PNP Uniformed Personnel. — When forwarding to the NAPOLCOM applications for promotion to third-level positions, confirmation of designation to key positions, confirmation of rank adjustment and grant of waiver from attrition of PNP uniformed personnel, the Senior Officer Placement and Promotion Division (SOPPD), the Recruitment and Selection Division (RSD), and the Discipline, Law and Order Division (DLOD), all of the Directorate for Personnel and Records Management (DPRM), PNP, shall include in the respective individual application folders a prepared draft NAPOLCOM Resolution, signed by the Chief, PNP. aScITE

The NAPOLCOM, upon receipt of the respective individual application, shall forward the same to its Personnel and Administrative Service (PAS) for review and evaluation. The PAS shall, after determination that the application and the documentary requirements submitted are in order, immediately forward the prepared draft NAPOLCOM Resolution already signed by the Chief, PNP, and other pertinent documentary attachments, to the other members of the Commission En Banc for their signature and approval.

In the event, however, that the PAS observes deficiencies during its evaluation and review, it shall immediately cause the return of the application to the SOPPD, the RSD or DLOD, as the case may be, indicating therein, through a pro-forma checklist, the lacking documentary requirements. Once the deficiencies are addressed, the SOPPD, the RSD or the DLOD shall cause the immediate return of the application to the PAS for another round of review and evaluation.

In no case shall the signature of the Chief, PNP in the Attached prepared draft NAPOLCOM Resolution be construed and considered as a waiver on the part of the PAS and NAPOLCOM to conduct a review and evaluation of the application.

SECTION 2. Resolutions on Designation or Detail as Police Attaché. — When forwarding to the NAPOLCOM applications for confirmation of designation or detail as Police Attaché of PNP uniformed personnel, the Foreign Liaison Division (FLD), Directorate for Intelligence (DI), PNP, shall include therein a prepared draft NAPOLCOM Resolution, signed by the Chief, PNP.

The NAPOLCOM, upon receipt of the application, shall forward the same to its Personnel and Administrative Service (PAS) for review and evaluation. The PAS shall, after determination that the application and the documentary requirements submitted are in order, immediately forward the prepared draft NAPOLCOM Resolution already signed by the Chief, PNP, and other pertinent documentary attachments, to the other members of the Commission En Banc for their signature and approval.

In the event, however, that the PAS observes deficiencies during its evaluation and review, it shall immediately cause the return of the application for confirmation of designation or detail as Police Attaché to the FLD, indicating therein, through a pro-forma checklist, the lacking documentary requirements. Once the deficiencies are addressed, the FLD shall cause the immediate return of the application to the PAS for another round of review and evaluation.

In no case shall the signature of the Chief, PNP in the Attached prepared draft NAPOLCOM Resolution be construed and considered as a waiver on the part of the PAS and NAPOLCOM to conduct a review and evaluation of the application.

SECTION 3. Effectivity. — This Resolution shall take effect fifteen (15) days upon its filing with the Office of the National Administrative Register. HEITAD
