Preference to Local Concerns and Products in Purchase of Government Supplies
Act No. 3967, enacted on December 2, 1932, mandates that government procurement officers prioritize the purchase of local products and materials produced in the Philippines or the United States. This preference is contingent upon local supplies not exceeding the lowest foreign bids by more than five percent. Additionally, products that have undergone significant manufacturing outside the Philippines or the United States do not qualify for this preference. ACT NO. 3967
AN ACT GIVING PREFERENCE FOR LOCAL CONCERNS AND LOCAL PRODUCTS IN THE PURCHASE OF GOVERNMENT SUPPLIES
SECTION 1. The Insular Purchasing Agent, the director or chief of a bureau or office, the president of a board or commission, or any public officer charged with the purchase of materials and supplies for any public use, shall give preference to materials and supplies grown, made, and manufactured in the Philippine Islands or in the United States: Provided, That the prices of such materials and supplies do not exceed by more than five per cent the lowest bids presented for articles of foreign manufacture: And provided, further, That no supplies and materials shall be entitled to preference on which the major portion of the work of manufacturing was done outside the Philippine Islands or the United States.
SECTION 2. This Act shall take effect on its approval.
