Power of the Board of Energy to Regulate and Fix Rates of Pipeline Concessionaires

PRESIDENTIAL DECREE NO. 1700

GRANTING THE BOARD OF ENERGY THE POWER TO REGULATE AND FIX THE RATES OF PIPELINE CONCESSIONAIRES AND AMENDING FOR THAT PURPOSE SECTION 9 OF PRESIDENTIAL DECREE NO. 1206

WHEREAS, the determination of the rates of pipeline concessionaires is a quasi-judicial and quasi-legislative function;

WHEREAS, the jurisdiction over the determination of the rates of pipeline concessionaires must be specifically stated and provided for by law;

WHEREAS, in view of the foregoing consideration, it is necessary to amend Section 9 of Presidential Decree No. 1206;

NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers vested in me by the Constitution, do hereby order and decree as follows: cd

 In addition to the powers enumerated under Section 9 of Presidential Decree No. 1206, the Board of Energy shall have the power to regulate and fix the rates of pipeline concessionaires under the provisions of Republic Act No. 387, as amended, otherwise known as the Petroleum Act, and the said Board shall prescribe and promulgate the necessary rules and regulations on this matter. The provisions of Section 9 of Presidential Decree No. 1206 shall be deemed amended in accordance with this Decree.

SECTION 2. All existing laws, orders, rules and regulations contrary or inconsistent with the provisions of this Decree are hereby repealed or modified accordingly. cdt

SECTION 3. This Decree shall take effect immediately.
