Quoted hereunder, for your information, is a resolution of the Court En Banc dated 23 August 2005 IDTSEH
A.M. No. 03-12-04-SC (Re: Possible Means to Implement the Special Allowance under R.A. 9227 and to Increase the JDF)
This refers to the letter dated May 25, 2004 of retired justices Minerva G. Reyes, B.S. De la Fuente and Efren I. Plana inquiring whether the retired Justices are entitled to the special allowances stipulated in Republic Act No. 9227 (An Act Granting Additional Compensation in the Form of Special Allowances for Justices, Judges and all other Positions in the Judiciary with the Equivalent Rank of Justices of the Court of Appeals and Judges of the Regional Trial Court, and for Other Purposes).
The Court has resolved the subject matter in its Resolution dated December 1, 2004 in A.M. No. 04-11-06-SC (Re: Request of Retired Justices of the Supreme Court for the Upgrading of Their Retirement Gratuities) wherein the Court granted the request of retired Justice Abraham F. Sarmiento, President of The Association of Retired Justices of the Supreme Court of the Philippines, to upgrade the retirement gratuities of the retired Justices so that the additional compensation granted by Republic Act No. 9227 to incumbent Justices be likewise given to the retired justices. The dispositive portion of said Resolution reads:
WHEREFORE, the request of the retired justices is APPROVED. The retirement gratuities of the retired justices of the Supreme Court shall include the special allowances given to incumbent justices pursuant to Republic Act No. 9227. A retiree who received a 5-year lump sum payment is likewise entitled to automatic adjustments after retirement.
WHEREFORE, retired Justices Minerva G. Reyes, B.S. De la Fuente and Efren I. Plana are held entitled to the necessary adjustments in their respective retirement gratuities to include the special allowances given to incumbent Justices pursuant to Republic Act No. 9227.
