LTFRB MEMORANDUM CIRCULAR NO. 010-17
| SUBJECT | : | Policy Enjoining All Operators/Owners of Public Transport Terminals (PTT) Including Stations and Stop Over Rest Areas to Provide Passengers Free Access and Use of Sanitary Facilities on All Terminals, Stations and Stop Over Rest Areas |
WHEREAS, pursuant to Section 5 (k) of Executive Order No. 202 and in relation to Section 16 (b) of Commonwealth Act 146, otherwise known as the Public Service Law (as amended), providing the jurisdiction, powers and duties of the Commission (now the Board), hereby promulgates this policy in the operation and maintenance of PUV terminals.
WHEREAS, it has come to the attention of the Board that quite a number of public utility vehicle terminals, stations and stop over rest areas, whether owned and operated by the grantee (PUV operator) or owned by separate entity, collect fees on the use of restroom/sanitary facilities.
WHEREAS, Memorandum Circular No. 2008-013 provided the Standard Classification and Guidelines in the Establishment, Maintenance and Operations of Public Transport Terminals and the same includes the establishment and maintenance of separate restrooms for male and female and disabled passengers which must, at all times, be clean, sufficiently lighted, foul odor-free, ventilated with clean running water, flush system, toilet seat with cover, lavatory, waste bin, toilet paper, mirror, dispenser with soap, hand dryer, dry flooring, functional door lock and janitorial/maintenance personnel;
NOW THEREFORE, in order to guarantee the efficiency of service and ensure convenience to the riding public, all operators/owners of Public Transport Terminals (PTT) including stations and stop over rest areas, shall provide FREE and UNIMPEDED access and use of restrooms/sanitary facilities. Collection of fees from passengers in any form or amount including voluntary donations is strictly prohibited.
The Board through its concerned Regional Directors shall conduct inspections of the terminals within their jurisdiction at least twice a year.
A fine in the amount of FIVE THOUSAND (P5,000.00) shall be imposed against the public terminal operator caught in violation of this Memorandum Circular for the first offense; FIFTEEN THOUSAND PESOS (P15,000.00) for the second offense; and closure of the public terminal for the third and/or and succeeding violation. Such closure may be lifted upon recommendation of the Board or the concerned Regional Director based on their respective inspections.
Further, all Regional Directors are hereby directed to post a copy of this Circular in two (2) conspicuous places within their premises/offices for at least one (1) month from its effectivity.
This Memorandum Circular supersedes any and all issuances inconsistent herewith and shall be effective fifteen (15) days following the filing of three (3) copies hereof with the UP Law Center pursuant to Presidential Memorandum Circular No. 11 dated 09 October 1992.
