POEA GOVERNING BOARD RESOLUTION NO. 09-06
WHEREAS, Section 1, Rule I, Part III of the 2002 POEA Rules and Regulations Governing the Recruitment and Employment of Land-Based Overseas Workers requires the verification by the Philippine Overseas Labor Office (POLO) of recruitment documents of foreign principals, employers and projects; TIaDHE
WHEREAS, the verification of documents done by the POLO is a protective mechanism for overseas Filipino workers which ascertains the existence of the principal/employer and its capability to hire workers at acceptable rates at desirable working conditions, in conformity with the minimum standards of POEA and the labor laws of the host country;
WHEREAS, only employment contracts of household workers are verified individually by the POLO but not contracts of low/semi-skilled female workers;
WHEREAS, manpower request/job orders for low skilled categories can be utilized to process and deploy household workers to circumvent the verification requirement for individual employment contracts of household workers;
WHEREAS, Section 4 of the same Rules allows the submission of subsequent manpower request/job orders of registered principals/projects without verification by the POLO; DHcESI
WHEREAS, there is a need to verify not only the individual employment contracts of Filipino household workers but also those of low/semi-skilled female workers including subsequent manpower requests/job orders for such positions, to prevent the misuse of these manpower requests and further ensure the worker's protection and welfare.
NOW, THEREFORE, the POEA Governing Board, in a meeting duly convened, RESOLVES AS IT IS HEREBY RESOLVED, to amend Sections 1 and 4, Rule I, Part III of the 2002 POEA Rules and Regulations to require the verification by the POLO of the following:
1. Individual employment contracts and subsequent job orders of Filipino household workers, regardless of whether they are to be deployed through a foreign placement agency or direct to an employer; and
2. Individual employment contracts and subsequent job orders of low/semi-skilled female workers hired through foreign placement agencies or hired thru the name-hire facility;
POEA is directed to formulate the necessary procedures and requirements to ensure compliance of the above policies.
Administrative issuance inconsistent with this resolution are hereby repealed or modified accordingly. AECDHS
