P.D. No. 2004 (s. 1985) Re: Sale Without Public Auction of Public Lands of the Republic of the Philippines
Presidential Decree No. 2004, issued on December 30, 1985, amends Section Two of Republic Act No. 730, allowing the sale of public lands for residential purposes without public auction to qualified applicants. The amendment removes onerous restrictions on these lands, enabling their encumbrance or alienation both before and after the issuance of land patents. 1. For the information and guidance of all concerned, there is quoted hereunder in full Presidential Decree No. 2004 dated December 30, 1985, to wit:
"PRESIDENTIAL DECREE NO. 2004 AMENDING SECTION TWO OF REPUBLIC ACT NUMBERED SEVEN HUNDRED AND THIRTY RELATIVE TO THE SALE WITHOUT PUBLIC AUCTION OF PUBLIC LANDS OF THE REPUBLIC OF THE PHILIPPINES FOR RESIDENTIAL PURPOSES TO QUALIFIED APPLICANTS UNDER CERTAIN CONDITIONS"
WHEREAS, Republic Act No. 730 permits the sale without public auction of public lands of the Republic of the Philippines for residential purposes to qualified applicants under certain conditions;
WHEREAS, lands acquired thereunder are subject to onerous restrictions against encumbrances or alienation; and
WHEREAS, it is necessary to remove these onerous restriction to allow the effective utilization of these lands.
NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, pursuant to the powers vested in me by the constitution, do hereby decree.
SECTION 1. Section two (2) of Republic Act Numbered Seven Hundred and thirty is hereby amended to read as follows:
"SEC. 2. Lands acquired under the provisions of this Act shall not be subject to any restrictions against encumbrance or alienation before and after the issuance of the patents thereon."
SECTION 2. This decree shall take effect immediately.

2. Land patent in Judicial Forms being issued pursuant to the provision of Republic Act No. 730 should be modified accordingly.
3. All officials and employees of the Bureau of Lands are hereby enjoined to be guide accordingly.
4. This circular shall take effect immediately.
