DOF DEPARTMENT ORDER NO. 114-91

By authority of Section 3513 of the Tariff and Customs Code, as amended, the following rules and regulations are hereby issued to implement the provision on the grant of cash rewards to the officers and men and informers who are instrumental in the discovery and seizure of smuggled goods:
SECTION 1. Section 3 of Department Order No. 92-66 is hereby amended to read as follows:
"Section 3. Rewards Payable from the Proceeds of the Sale of Goods at Public Auction/Redemption. — The reward, which is equivalent to twenty percent (20%) of the fair market value of the confiscated goods, shall be determined and paid for as follows:
1. If the goods are sold at public auction, negotiated sale or other forms of sale, the reward shall be equivalent to 20% of the total proceeds of such sale; and
2. If the goods are allowed to be REDEEMED pursuant to Section 2307 of the TCCP, as amended, the reward shall be equivalent to 20% of the Domestic Market Value actually paid for the release of the shipment following the forfeiture."
SECTION 2. In the matter of distributing the rewards under Sec. 1 of this Order between the informers and apprehending officers, Sec. 2 (d) of DOF Order No. 92-66 is hereby amended to read as follows:
"(d) Cash reward of twenty percent of the fair market value/DOMESTIC MARKET value to the given to officers and informers instrumental in the discovery and seizure shall mean to be ten percent (10%) thereof to be distributed among officers and men instrumental in the discovery and seizure of smuggled goods, share and share alike, and the remaining ten percent (10%) thereof shall be given to the informer. In the absence of any informer, the twenty percent (20%) cash reward shall be divided share and share alike among the officers and men instrumental in the discovery and seizure of smuggled goods." cdt
SECTION 3. All previous orders, rules and regulations inconsistent with this Order are hereby amended and/or modified accordingly.
SECTION 4. These rules and regulations shall take effect after fifteen (15) days following the completion of their publication in the Official Gazette.
