OMBUDSMAN ADMINISTRATIVE ORDER NO. 01-99
Consistent with Sections 18, 23 and 24 of Republic Act No. 6770, otherwise known as the Ombudsman Act of 1989, empowering the Office of the Ombudsman to promulgate its own rules and regulations and its subsequent revision or modification as warranted, this Office, after a judicious review of such rules and regulations and finding some portions thereof to be inadequate, deems it essential and necessary in order to make the same clear and unequivocal to revise and amend, as it is hereby revised and amended, the provisions of Administrative Order No. 07, Series of 1990, more particularly, Section 9 thereof, to wit:
Section 9. Preventive suspension. — Pending investigation, the respondent may be preventively suspended without pay for a period of not more than six (6) months if, in the judgment of the Ombudsman or his proper deputy, the evidence of guilt is strong, and (a) the charge against such officer or employee involves dishonesty, oppression or gross misconduct, or neglect in the performance of duty; or (b) the charge would warrant removal from the service; or (c) the respondent's continued stay in office may prejudice the case filed against him. If the administrative investigation is not terminated within the period the respondent is suspended, SAID PERIOD SHALL BE EXTENDED UNTIL THE CASE IS TERMINATED BUT NOT TO EXCEED SIX (6) MONTHS EXCEPT WHEN THE DELAY IN THE DISPOSITION OF THE CASE IS DUE TO THE FAULT, NEGLIGENCE, OR ANY CAUSE ATTRIBUTABLE TO THE RESPONDENT, IN WHICH CASE THE PERIOD OF SUCH DELAY SHALL NOT BE COUNTED IN COMPUTING THE PERIOD OF SUSPENSION.
IF THE MAXIMUM PERIOD OF SUSPENSION HAS BEEN SERVED AND THE CASE REMAINS PENDING. THE RESPONDENT SHALL BE AUTOMATICALLY REINSTATED.
Accordingly, any provision of Administrative Order No. 07 or any or such other issuance by this Office shall be deemed superseded or otherwise modified insofar as it is inconsistent herewith.
This Order shall take effect after fifteen days following its publication in a newspaper of general circulation.
