Non-Commitment of the Children In Conflict with the Law at the Center for Restorative Activities and Development Learning Experiences
OCA Circular No. 168-11, issued on December 2, 2011, directs judges of Family Courts and Single Sala Second Level Courts in the National Judicial Capital Region and Region IV-A to cease the commitment of Children in Conflict with the Law (CICL) to the Center for Restorative Activities and Development Learning Experiences (CRADLE). The Department of Social Welfare and Development (DSWD) has proposed transferring the management of these children to other licensed Social Welfare and Development Agencies, specifically naming the ERDA-BK RESTORE, Virlanie Foundation, and PREDA Foundation. This decision comes in light of the inadequate resources at CRADLE, which currently has only one social worker overseeing 72 CICL. Compliance with this directive is mandatory as part of the transitional process for managing CICL cases.

The Department of Social Welfare and Development (DSWD) has informed this Office of the proposed transfer of the management of Children in Conflict with the Law (CICL) from the Center for Restorative Activities and Development Learning Experiences (CRADLE) to its other licensed and accredited Social Welfare and Development Agencies.
Relative thereto, the DSWD has initially identified three (3) Non-Government Organizations which are now serving the CICL, namely: (a) ERDA-Buhay Kalikasan Revitalizing and Expanding Towards Rehabilitation and Reintegration (ERDA-BK RESTORE), (b) Virlanie Foundation and (c) PREDA Foundation, and requested that no CICL be committed anymore to the CRADLE. This is in relation to the 72 CICL who are currently committed at the CRADLE which has only one (1) Social Worker from DSWD-NCR who is in charge of the rehabilitation program.
Henceforth, all concerned are hereby DIRECTED, effective immediately, to REFRAIN from COMMITTING any CICL to the CRADLE, considering that there is already a transitional process for the transfer of management of the CICL's cases to the abovementioned certified DSWD licensed and accredited Social Welfare and Development Agencies. cASTED
