LTO MEMORANDUM CIRCULAR NO. AVT-2014-1887

Pursuant to the provisions of Sec. 4 (b) and 4 (c) of Administrative Order No. 3 dated 24 September 1980 on the Rules and Regulations of the New System of Registration Pursuant to Batas Pambansa Bilang 43 and 74 Amending Related Provisions of RA No. 4136, Otherwise Known as the Land Transportation and Traffic Code which states that:
"New motor vehicles shall be registered on or before the seventh (7th) day following the date when they were purchased or acquired;" and, "Locally-assembled vehicles like jeeps, jeepneys, trucks, etc. shall be registered on or before the seventh (7th) day following the completion of such assembly"
All new, rebuilt and used imported motor vehicles shall first be registered as private before they can be registered as for hire.
For tricycles, this requirement is explicitly provided for in the Guidelines to Implement the Devolution of LTFRB's Franchising Authority Over Tricycles-for-Hire to Local Government Units Pursuant to the Local Government Code (RA No. 7160) which states that:
"No Motorized Tricycle Operator's Permit (MTOP) shall be granted unless the applicant is in possession of units with valid registration papers from the Land Transportation Office (LTO).
Hence, all tricycles or motorcycles with side cars shall first be initially registered as private before they can be registered as for-hire.
Any official/employee found violating this Memorandum Circular shall be subjected to administrative sanction in accordance with existing CSC Rules and Regulations. aTCAcI
This takes effect immediately and all issuances in conflict herewith are deemed superseded.
