Attached for your information and appropriate action is the Implementing Rules and Regulations of Section 40 of R.A. 9401 on the Protection of Meager Income of HLURB Employees, approved on September 23, 2008.
Concerned group heads are directed to submit programs and projects geared towards the effective implementation of these Rules.

RULES AND REGULATIONS IMPLEMENTING SECTION 40 OF REPUBLIC ACT 9401 ON THE PROTECTION OF MEAGER INCOME OF HLURB EMPLOYEES
ARTICLE I
Title, Authority, Purpose, Construction and Scope
SECTION 1. Title. — These rules shall be known as the Rules and Regulations Implementing Executive Order No. 462 (S. 2005) and Section 40 of Republic Act 9401 ON THE PROTECTION OF MEAGER INCOME OF HLURB EMPLOYEES. HEaCcD
SECTION 2. Authority. — By virtue of Section 40 of R.A. 9401 and Section 1 of E.O. 462, the HLURB is hereby tasked to promulgate the rules and regulations implementing the program," PROTECTION OF MEAGER INCOME OF HLURB EMPLOYEES."
SECTION 3. Purpose. — These rules and regulations shall provide the HLURB officers and employees with guidelines for the implementation, and compliance with the program of protecting the meager income of HLURB Officers and employees.
SECTION 4. Construction. — These rules shall be construed in accordance with the policy and objectives of the law. In case of conflict and/or ambiguity the same shall be construed liberally in favor of the HLURB officers and employees.
SECTION 5. Scope. — These rules and regulations shall cover all measures adopted to protect the welfare of HLURB officers and employees specifically through measures and safety nets that will protect the meager income in order to strengthen their commitment to public service and improve their work efficiently and effectiveness.
SECTION 6. Objectives. — These rules and regulations shall ensure the attainment of the following objectives:
a. To implement and monitor programs and projects that would provide assistance to HLURB to promote their morale and welfare;
b. To minimize systems and practices that lead to negative bureaucratic behavior, such as debt-culture;
c. To adopt the net-take home pay as defined under Section 40 of R.A. 9401 as limitation for purposes of deduction from salaries of HLURB officers and employees for payment of loan amortization and services fees for private association and lenders.
ARTICLE II
Definition of Terms
SECTION 7. Definition of Terms. — As used in these Rules, the following terms shall mean as follows: CTacSE
(a) Net take-home pay — refers to the gross monthly salary minus the mandatory/statutory deductions.
(b) Authorized deductions — pertains to deductions from salaries, emoluments or other benefits accruing to any government employee chargeable against the appropriations for personal services which may be allowed for the payment of individual employee's contribution or obligations due to the following:
b.1 The BIR, GSIS, HDMF and Phil. Health;
b.2 Mutual benefits associations duly operating under existing laws managed by, and for the benefit of, government employees not be covered by compulsory membership in the GSIS; and
b.3 Associations/cooperatives organized and managed by government employees for their benefit and welfare.
PROVIDED that such deductions shall not reduce the employee's monthly net take-home pay to an amount lower than Three Thousand Pesos (P3,000.00), after all authorized deductions.
PROVIDED FURTHER, that in the event the total authorized deductions under item (a) shall enjoy first preference, those under item (b) shall enjoy second preference, and so forth.
(c) Minimum net take-home pay — refers to the net monthly salary of government employees as defined under Section 40 of R.A. 9401.
(d) HLURB officers and employees — pertain to the officers and employees of the HLURB with existing employer and employee relationship. HESCcA
ARTICLE III
Guidelines on the Implementation of the Program "Protection of Meager Income of HLURB Employees"
SECTION 8. Implementing Guidelines. — The hereunder guidelines on the implementation of the program "Protection of Meager Income of HLURB Employees" shall be adopted:
1. Adoption of net take-home pay
a. The Personnel and Finance Divisions shall maintain ledgers and/or database of HLURB officers and employees containing their monthly salaries and authorized monthly deductions as defined under Section 7.b;
b. The Personnel and Finance Divisions shall use the ledgers/database as their reference in determining the net-take home pay of HLURB officers and employees;
c. Any HLURB officer and employee applying for loans with HDMF, GSIS, and associations/cooperatives operating under existing laws, managed by and for the benefit of government employees shall first secure clearance from the Personnel Division and Finance Division to determine if the net take-home pay after the availment of said loan is still within the limit set-forth under Section 40 of R.A. 9401;
d. The Personnel and Finance Divisions upon receipt of employees' loan applications shall determine the required monthly deductions for the said loan and check if the net take-home pay is stilt within the required minimum take home pay. If the take home pay is below the required minimum take home pay, the Personnel and Finance Divisions shall not favorably endorse the loan applications to any HLURB authorized signatories for approval; TcCDIS
e. The HLURB authorized signatories shall ensure that the loan application is already cleared by the Personnel Administration and Finance Divisions prior to signing;
f. The Finance Division shall not allow deductions of loans contracted out by HLURB officers and employees from the institution not covered under Section 7.b; and
g. The Personnel Division shall issue a notification to the employees concerned stating the reason/s for the non-processing of his/her loan application.
2. Eradication of systems and procedures that lead to negative bureaucratic behavior.
a. Conduct studies and analysis of HLURB work systems and procedures and identify those areas that contribute to negative bureaucratic behavior of HLURB officers and employees;
b. Continue the implementation of the following support systems and procedures to inculcate positive behavior among HLURB officers and employees:
b.1 Timely payment of salaries and allowances at least every 15th and 30th of the month;
b.2 Ensuring and implementing of provisions of the HLURB Collective Negotiation Agreement subject to COA Rules and Regulations.
b.3 Continuing the use of Automated Teller Machine (ATM) for crediting the salaries and allowances of HLURB officers and employees for easy access and convenience;
b.4 Implement existing rules and regulations on habitual absenteeism and tardiness to minimize unnecessary deductions in the monthly net take home pay;
b.5 Prohibiting HLURB officers and employees to engage in lending/obtaining loans using ATM as collateral/pledge and the use of ATM as collateral/pledge for loans.
3. Promotion of HLURB officers and employees' morale and welfare to increase satisfaction of work
a. Formulate the HLURB Code of Conduct and Ethical Standards consistent with R.A. 6713 and its Implementing Rules and Regulations;
b. Prioritize the conduct of ethics training, spiritual formation and moral recovery program;
c. Utilize media e.g., video, films, etc. showing the importance of having ethical standards in the workplace and the negative effect of having debt culture in the organization; and cSEDTC
d. Institutionalize prayer time and gospel sharing among HLURB officers and employees.
4. Formulation of social safety nets, morale and welfare programs
a. Institutionalize the creation of HLURB Provident Fund to provide supplementary benefits and improve productivity of HLURB officers and employees;
b. Provide housing units with minimal rental near their work place or provide free transportation to points of destination.
c. Strengthen cooperation of HLURB Employees Associations; and
d. Coordinate with government and private financial institutions providing livelihood opportunities.
ARTICLE IV
Final Provisions
SECTION 9. Implementation. — The Personnel Division and Finance Division shall implement the program on the Protection of Meager Income of HLURB Employees.
SECTION 10. Monitoring and Evaluation. — The Personnel Division and Finance Division shall evaluate the implementation of these Implementing Rules and Regulations (IRRs).
SECTION 11. Effectivity. — These Implementing Rules and Regulations shall take effect immediately.
