Despite the issuance of OCA Circular No. 105-2021 dated 27 July 2021 (Re: Delay in the Resolution of Rehabilitation, Insolvency, and Liquidation Cases) which strongly reminded the concerned judges that:
x x x pursuant to Sec. 72, Republic Act No. 10142, 1 courts "shall have a maximum period of one (1) year from the date of the filing of the petition to confirm a Rehabilitation Plan."
reports have reached this Office that there are still delays in the resolution of rehabilitation, insolvency, and liquidation cases. To monitor the compliance of the concerned courts with the above-quoted mandate, all special commercial courts and courts handing rehabilitation, insolvency, and liquidation cases are hereby DIRECTED to submit an inventory of the subject pending cases by accomplishing the Inventory Form on All Pending Rehabilitation, Insolvency, and Liquidation CasesviaMS Forms. The report shall be routinely updated until the pending rehabilitation, insolvency, and liquidation cases are terminated. However, as directed in OCA Circular No. 122-2022 dated 26 May 2022, if the concerned court has nothing to report, the submission of the subject inventory/report is not necessary.
