On May 4, 2020, the Philippine Department of Agriculture issued Department Order No. 06-20, granting individual accreditation to 24 foreign meat establishments (FMEs) from Brazil to export pork, beef (excluding certain cuts), and poultry products into the Philippines for three years. This accreditation follows compliance with the Philippine meat inspection and quarantine regulations, as well as the international standards set by the World Organisation for Animal Health. The order emphasizes the need for these establishments to adhere to food safety, animal health, and import/export protocols, ensuring that all imported meat meets stringent health and safety requirements. Non-compliance with these regulations could result in suspension of accreditation or refusal of imports. The order will take effect 15 days after its publication in a national newspaper.

SUBJECT : Individual Accreditation of Twenty-Four (24) Foreign Meat Establishments (FMEs) of the Federal Republic of Brazil as Exporter of Pork, Beef (Except Meat from Head, Industrial, Sangria and Neck Meat) and Poultry Product into the Philippines

 

WHEREAS, Section 12 (a), under Application to Trade of the Joint DA-Department of Health (DOH) Administrative Order (AO) No. 2015-0007 dated February 20, 2015 entitled "The Implementing Rules and Regulations of Republic Act (RA) No. 10611, An Act to Strengthen the Food Safety Regulatory System in the Country to Protect Consumer Health and Facilitate Market Access of Local Foods and Food Products, and for other Purposes otherwise known as The Food Safety Act of 2013," provides food to be imported into the country must come from countries with an equivalent food safety regulatory system and shall comply with international agreements to which the Philippines is a party;

WHEREAS, Section 34, under Accreditation of FME of the Department of Agriculture (DA) Administrative Circular No. 1, Series of 2014 entitled "Revised Implementing Rules and Regulations of Republic Act (RA) No. 9296, otherwise known as 'The Meat Inspection Code of the Philippines,' as amended by RA No. 10536" provides that meat exporters to the Philippines shall secure accreditation of FME at source from DA before being allowed to ship meat in terms of their compliance with the Philippine and internationally-recognized standards;

WHEREAS, Section 36, under Import Requirements of the Department of Agriculture (DA) Administrative Circular No. 01, Series of 2014 entitled "Revised Implementing Rules and Regulations of Republic Act (RA) No. 9296 otherwise known as 'The Meat Inspection Code of the Philippines,' as amended by RA No. 10536" provides imported meat shall be refused entry if they do not meet Philippine Import requirements. The refused entry items shall be re-exported to the country of origin or destroyed at the expense of the importer or owner in order to protect public health and the local animal population;

WHEREAS, Department of Agriculture Administrative Order No. (DA-AO No. 16), series of 2006, otherwise known as the Pre-Border Measures for the Export of Meat and Meat Products to the Philippines provides procedures and guidelines in the accreditation of Foreign Meat Establishments (FMEs) producing meat for export to the Philippines;

WHEREAS, Brazil is recognized as free from FMD with vaccination except the State of Santa Catarina which is recognized as free from FMD without vaccination, hence the Philippine Government shall institute SPS measures in accordance with the conditions established by the World Organisation for Animal Health (Office International des Epizooties-OIE) specifically Chapters 8.8.20 and 8.8.21 of the 2019 Terrestrial Animal Health Code (TAHC) in the importation of meat from Brazil; CAIHTE

WHEREAS, Memorandum Circular No. 24 issued on December 1, 2017 entitled "Lifting of the Temporary Suspension of Accreditation of All Brazilian FMEs to Export Meat to the Philippines" provides the condition on shipment of imported ruminant meat (ex. beef) from Brazil shall exclude meat from the head (such as but not limited to cheek meat). Moreover, SPS Import Clearance application for industrial meat, sangria and neck meat shall placed on-hold until a clear technical definition and tariff heading is established;

WHEREAS, twenty-four (24) FMEs of the Federal Republic of Brazil were inspected/audited by the DA Inspection Mission (DAIM) and were found to comply with the Philippine quarantine and meat inspection systems procedures;

WHEREAS, the Federal Republic of Brazil has complied with the requirements provided in the Terrestrial Animal Health Code of the World Organisation for Animal Health (Office International des Epizooties-OIE);

WHEREAS, after thorough evaluation, the application of Federal Republic of Brazil for individual FME accreditation has been found to be satisfactory and acceptable to export pork, beef and chicken meat into the Philippines;

WHEREAS, the Accreditation Review Body (ARB) through Resolution Number 001-2020 recommends the accreditation of twenty-four (24) Foreign Meat Establishments of Federal Republic of Brazil with the corresponding AHTN codes:

DAR, Secretary of Agriculture, by the powers vested in me by law, do hereby issue this Order of Individual Accreditation to the twenty-four (24) DA Accredited FMEs of the Federal Republic of Brazil to export pork, beef and poultry into Philippines for three (3) years effective April 2, 2020 until April 2, 2023 with full compliance to existing regulations and conditions provided in Philippine meat importation guidelines and other relevant laws.

This ORDER shall take effect 15 days after the publication in one (1) newspaper of national circulation or Official Gazette and filing of a copy at the Office of the National Administrative Register (ONAR) at UP Diliman, Quezon City.

ANNEX 1

ARTICLE I

SCOPE AND DEFINITION OF TERMS AND ACRONYMS

Section 1. SCOPE. —

1.1 This Order shall govern the importation of beef, pork and poultry products from Federal Republic of Brazil into the Philippines.

Section 2. DEFINITION OF TERMS. — For the purpose of this Order, the following terms, words, and phrases herein used shall be construed to mean as follows:

a. Animal production food safety shall cover the programs for the control of biological hazards of animal health and public health importance through ante- and post-mortem inspection. DETACa

b. Animal traceability shall cover animal identification and traceability for the purpose of management of disease outbreaks and food safety incidents, vaccination programs, zoning and compartmentalization, surveillance, early response and notification systems, animal movement controls, inspection and certification procedures.

c. Animal welfare shall cover practices in humane handling of animal during transport, slaughter of animals for food, and the killing of animals for disease.

d. Antimicrobial Resistance covers the surveillance and monitoring programs, taking into considerations the responsible use of antimicrobials in terms of quantities in animal husbandry and veterinary medicine.

e. Diagnostic test for specific diseases shall cover specific diagnostic test adopted as recommended by the Terrestrial Animal Health Code of the OIE.

f. Disease Surveillance covers the established surveillance systems for animal diseases to determine the animal health status of the country, providing information on declaration of freedom from a disease/pathogen in relation to the date of most recent occurrence, and for recognizing historical freedom.

g. Equivalence covers the recognition of significantly different animal health and production systems that can provide equivalent protection for the purpose of international trade.

h. Import risk analysis shall cover hazard identification, risk assessment, risk management and risk communication and guidelines for conducting risk analysis.

i. Import/Export procedures as provided in the Terrestrial Animal Health Code (TAHC) covers the animal health measures applicable, before, at departure from the exporting country, covering animal identification, border and quarantine stations, and containment of pathogens during transport. This shall also cover the import requirements provided in the DA-Administrative Order No. 16, series of 2006, otherwise known as the Pre-Border Measures for the Export of Meat and Meat Products to the Philippines.

j. Inactivation of pathogens and vectors cover procedures for inactivation of foot and mouth disease (FMD) and avian influenza (HPAI).

k. Notification and epidemiological information provides the obligation of the exporting country as the OIE member country to make available whatever information is necessary to minimize the international spread of important animal diseases.

l. Obligations and ethics in international trade cover the responsibilities of the exporting country to make available up-to-date health information, export regulations and providing accurate health certification. aDSIHc

m. Zoning and compartmentalization. Zoning as provided by the OIE TAHC shall cover animal sub-population defined on a geographical basis with reference to natural, artificial or legal boundaries, while compartmentalization applies to animal sub-population defined by management practices related to biosecurity. Information on the established management of both shall be provided such as veterinary services.

Section 3. CONDITIONS TO MAINTAIN ACCREDITATION OF FOREIGN MEAT ESTABLISHMENTS.

3.1 The following documents and/or information shall be submitted by the National Competent Authority (CA) of the Federal Republic of Brazil to the Philippine Department of Agriculture not later than January 31 of the following year:

3.1.1 The Animal Health Status as provided and issued in conformance to the TAHC of the OIE. This shall include updated information on:

3.1.1.1  Animal production food safety

3.1.1.2  Animal traceability

3.1.1.3  Animal welfare

3.1.1.4  Antimicrobial resistance

3.1.1.5  Diagnostic test for specific diseases

3.1.1.6  Disease surveillance

3.1.1.7  Equivalence

3.1.1.8  Import risk analysis

3.1.1.9  Import/Export procedures

3.1.1.10 Inactivation of pathogens and vectors

3.1.1.11 Notification and epidemiological information

3.1.1.12 Obligations and ethics international trade

3.1.1.13 Zoning and compartmentalization

3.1.2 The official Annual report of the CA of the Federal Republic of Brazil on Monitoring Program for Veterinary Drug Residue (VDR).

3.1.3 The official Annual report of the CA of the Federal Republic of Brazil on Monitoring Program for Pathogens and/or pathogen reduction.

3.2 Animal Health Status and Disease Freedom

3.2.1 The CA of the Federal Republic of Brazil shall submit a copy to the Philippine Department of Agriculture (DA) of its animal health status annual report, residue of veterinary drugs monitoring report and other food safety concerns to include product recalls and advisories. ETHIDa

3.3 Meat Establishment Requirement

3.3.1 The FME shall be listed as duly registered meat establishment authorized by the government of the exporting country through the National Competent Authority of the Federal Republic of Brazil to export pork, beef except meat from head, industrial, sangria and neck meat, and poultry products into the Philippines.

3.3.2 The FME shall maintain eligibility to the above mentioned registry with reference to government sanitary and veterinary inspection, GMP/Sanitation Standard Operating Procedures (SSOP) and HACCP certification, subject to verification audit of the Philippine Department of Agriculture Inspection Mission (DAIM) any time within the validity period, without incurring any critical or serious non-conformance/s in which such condition or practice prevents proper plant sanitation, may result in the production of unwholesome product, presents a threat to health and safety of consumers, and compromises general food safety.

3.3.3 The FME shall make available all pertinent documents necessary in the conduct of audits by the DAIM pertaining but not limited to operational concerns on safety of water and ice, condition and cleanliness of food contact surfaces; prevention of cross contamination; hand washing & sanitizing & toilet facilities, protection of food, packaging and food contact surface from adulteration with contaminants; labelling and storage and use of toxic compounds; employees health conditions; exclusion of pests from the ME; calibration of measuring tools; equipment; and other structural facilities.

3.4 Export Requirements

3.4.1 The meat for export shall be derived from healthy animals and slaughtered and fabricated in the FME as provided in the provisions under 3.3.1 of this Order, and inspected and passed for export by the official veterinarian of the CA of the Federal Republic of Brazil.

3.4.2 The source of meat for export shall be from animals born and raised in the Federal Republic of Brazilor from a country/zone accredited by the Philippines to export meat into the Philippines.

3.4.3 The meat shall not be contaminated by infectious and zoonotic diseases and not exceed the acceptable level set by the Philippine standards and/or international standards.

3.4.4 The meat for export shall not contain residues of antibiotics, pesticides, hormones, heavy metals, radioactivity and similar substances that may pose public health and environment hazards.

3.4.5 The meat for export shall bear the official inspection mark on the primary, secondary, and/or shipper packaging showing proof that the meat has been certified inspected and passed by the CA in compliance to the national food control system of the exporting country. The meat shall be packed in plastic packs and cartons printed with the date of slaughter, batch number and other information as prescribed in Section VII of DA AO No. 26, s. 2005, and DA AO No. 24, s. 2010. cSEDTC

3.4.6 The label shall:

3.4.6.1  shall be in the form of stamp or stick-on the immediate container (if it is plastic lined) and also on the outer portion of the box;

3.4.6.2  shall be rectangular in shape with the dimension of 3 inches width by 5 inches length (3x5);

3.4.6.3  shall be printed in BOLD letters and with a font size of #18;

3.4.6.4  shall not be easily defaceable by any solution;

3.4.6.5  shall be written in English or Filipino.

3.4.7 The packaging shall have the minimum information requirements as follows:

3.4.7.1  cartons or the outermost shipper's package shall be stamped with "FOR EXPORT TO THE PHILIPPINES";

3.4.7.2  business name and address of the exporter;

3.4.7.3  FME name, number and address;

3.4.7.4  country of origin;

3.4.7.5  brand name of the product;

3.4.7.6  lot number/identification;

3.4.7.7  product description and list of ingredients;

3.4.7.8  net quantity of contents, in terms of weight, measure or numerical count rounded to the nearest tenths (expressed in METRIC SYSTEM);

3.4.7.9  date of manufacture and packaging;

3.4.7.10 "use-by date" or "use or consume by date" or "expires by" or "expiration date"; and

3.4.7.11 "date of minimum durability" or "best before date" or "best quality before date."

3.4.8 The meat shall be transported, ensuring the wholesomeness and condition of the products by eliminating possibility of/or entry/introduction of contaminants and pests, and ensuring maintenance of product temperature requirements, eliminating thermal abuse. Sealed refrigerated/freezer shipping containers shall have passed the sanitary inspection and certified by the CA for loading.

3.4.9 The CA of the Federal Republic of Brazil shall coordinate with the Philippine National Veterinary Quarantine Service (NVQS) of the Bureau of Animal Industry (BAI) to discuss and agree on the contents and information needed for the International Veterinary Certificate (IVC)/International Health Certificate (IHC) of wholesomeness in reference to the Philippine Acceptable Level of Protection (ALOP) such as but not limited to microbiological limits, minimum residue levels (MRLs), border control measures and others.

3.4.10 The CA of the Federal Republic of Brazil shall issue and submit an English version of International Veterinary Certificate (IVC)/International Health Certificate (IHC) of wholesomeness with the approved information as an output of 3.4.9.

3.4.11 Prior to ship out from ports of Brazil, the CA shall send the electronic copies of the issued International Veterinary Certificate (IVC)/International Health Certificate (IHC) of wholesomeness to [email protected] addressed to the Philippine Chief Veterinary Officer (CVO) of BAI until such time an e-certificate exchange platform/system is established by the Philippine DA.

3.4.12 The meat to be exported shall arrive in the Philippine port not later than six months from the production date as shown in the label, Bill of Loading/Airway Bill, and International Veterinary Certificate.

3.4.13 All importations shall require Sanitary and Phytosanitary Import Clearance (SPSIC) and subject to applicable Philippine Laws, rules and regulations; as such, this Order shall not automatically guarantee that all pork, beef except meat from head, industrial, sangria and neck meat, and poultry products under specific AHTN codes are allowed entry into the Philippines.

3.4.14 This Order shall be governed by the provisions set in the following rules and regulations but not limited to: Republic Act (RA) No. 9296 also known as "The Meat Inspection Code of the Philippines" and its amendment, RA No. 10536 and Implementing Rules and Regulations (IRR); Administrative Order (AO) No. 16, Series of 2006 for the "Pre-Border Measures for the Export of Meat and Meat Products to the Philippines; AO No. 26, Series of 2005 for the "Revised Rules, Regulations, and Standards Governing the Importation of Meat and Meat Products into the Philippines" and AO No. 9, Series of 2013 for the "Supplemental Guidelines to DA-AO No. 26 of 2005, Section III: Accreditation Procedure for Meat Importers." Section 4. SUSPENSION CLAUSE. —

4.1 In case/cases of non-compliance with the requirements and conditions of this Order, and/or any non-conformance in the technical requirements pre-border to and at border entry of any shipment into the Philippines including report of incidence of notifiable disease, the Department of Agriculture through the Office of the Secretary reserves the right to suspend the accreditation and/or refuse acceptance of importation/imports of beef, pork and poultry products.
