DDB BOARD REGULATION NO. 02-15
| SUBJECT | : | Inclusion of 1, 2-Dimethyl-3-Phenyl Aziridine and its CIS and Trans Isomers in the List of Controlled Precursors and Essential Chemicals |
WHEREAS, pursuant to Section 93, Article XI of Republic Act No. 9165 or "The Comprehensive Dangerous Drugs Act of 2002", the Dangerous Drugs Board is given the power to reclassify, add to or remove any chemical from the list of dangerous drugs and controlled precursors and essential chemicals;
WHEREAS, under the same section of said law, the Board, in the exercise of this power, shall take into accord its obligations and commitments to international treaties, conventions and agreements to which the Philippines is a signatory;
WHEREAS, 1, 2-Dimethyl-3-Phenyl Aziridine is a chemical which is used in the manufacture of methamphetamine and is also identified as an impurity in the manufacture of methamphetamine hydrochloride or "shabu", and that it is carcinogenic when physically abused or digested;
WHEREAS, on September 12, 2014, a team from the Philippine Drug Enforcement Agency and the Philippine National Police-Anti-Illegal Drugs Special Operations Task Force caused the dismantling of two (2) illegal chemical warehouses in the province of Pampanga, and seized from said warehouses were vast amounts of methamphetamine, liquid methamphetamine, ephedrine and precursors, including 654.460 kilograms of 1, 2-Dimethyl-3-Phenyl Aziridine;
WHEREAS, the aforesaid seizure follows the trend recently observed by the International Narcotics Control Board ("INCB") of the emergence of various non-scheduled chemicals for use in the manufacture of illegal synthetic drugs such as "shabu";
WHEREAS, given the seizure of said chemical in relation to the warning offered by the INCB, it is essential that importation, sale, manufacture possession and use of 1, 2-Dimethyl-3-Phenyl Aziridine should be regulated by the state;
WHEREAS, on September 14, 2015, the Public Hearing Committee of the Board conducted a public hearing on the proposed classification of 1, 2-Dimethyl-3-Phenyl Aziridine as a controlled precursor and essential chemical, and the proposal was agreed upon by the invited stakeholders.
WHEREFORE, be it RESOLVED, as it is hereby RESOLVED that 1, 2-Dimethyl-3-Phenyl Aziridine and its Cis and Trans isomers be classified as a controlled precursor and essential chemical and the importation, sale, manufacture, possession and use thereof be subject to all regulatory and control measures provided for in the Comprehensive Dangerous Drugs Act of 2002, as amended, and rules and regulations promulgated by the Dangerous Drugs Board.
This Regulation shall take effect fifteen (15) days after its publication in two (2) newspapers of general circulation and after its registration with the Office of the National Administrative Register (ONAR), UP Law Center, Quezon City.
APPROVED and ADOPTED, this 9th day of September, in the year of Our Lord, 2015 in Quezon City.
