PRESIDENTIAL DECREE NO. 1735
IMPOSING ADDITIONAL PENALTIES FOR REBELLION, INSURRECTION, SEDITION AND SUBVERSION COMMITTED WITHIN OR OUTSIDE PHILIPPINE TERRITORY *
WHEREAS, it is imperative in the public interest to impose for the offenses of rebellion, insurrection, sedition and subversion whether committed within or outside the territory of the Republic of the Philippines, the additional penalties of forfeiture of the rights of citizenship, and of real or personal property belonging to the accused.
NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines by virtue of the powers in me vested by the Constitution, do hereby decree and order the following:
SECTION 1. Any person found guilty of subversion, rebellion or insurrection, or sedition, or conspiracy to commit rebellion, or insurrection, or sedition whether Committed within or outside the territorial jurisdiction of the Philippines, shall suffer the penalty of forfeiture of his rights as a citizen of the Philippines, if he is a Philippine citizen, and confiscation of his property, real or personal, in favor of the State, in addition to the penalties prescribed for the offense under existing law. cd i
SECTION 2. After the arraignment of an accused who is charged with any of the offenses mentioned in Section 1, the trial may proceed notwithstanding the absence of the accused, provided that he has been duly notified and his failure to appear is unjustified. Judgment may be promulgated in absentia and the penalty of confiscation of his properties in the Philippines may be immediately executed.
