IMPLEMENTING SECTION 5 OF E.O. 45 SERIES OF 2001 RELATIVE TO THE SUBMISSION BY THE APPLICANT DEVELOPER OF AN AFFIDAVIT WITH TECHNICAL STUDIES AND DOCUMENTS BY COMPETENT INDIVIDUALS, IN LIEU OF THE REQUIRED CERTIFICATION, CLEARANCE OR PERMIT FOR THE ISSUANCE OF CERTIFICATE OF REGISTRATION AND LICENSE TO SELL FOR SUBDIVISION AND CONDOMINIUM PROJECTS
WHEREAS, there is a need to expedite the issuance of housing-related permits to meet government targets on housing;
WHEREAS, under E.O. 45 entitled "Prescribing Time Periods for the Issuance of Housing-Related Certifications, Clearances and Permits and Imposing Sanctions for Failure to Observe the Same" more particularly Section 6 prescribes a specific time period to dispose of an application for housing-related certification, clearance or permit;
WHEREAS, Section 5 of E.O. 45 provides that "where the responsible officer of the agencies concerned fails or refuses to dispose of the application within the period prescribed herein, the applicant may, unless expressly prohibited by law, submit an affidavit, with supporting technical studies and documents by competent individuals, in lieu of the certification, clearance or permits";
WHEREAS, the issuance of the Certificate of Registration and License to Sell (CR/LS) by this Board can be further expedited if not for the extended delays on the part of the developers to obtain housing related certifications, clearances or permits with other government agencies; aHADTC
WHEREFORE, be it resolved as it is hereby resolved that this Board may accept the applicant developer's affidavit with supporting technical studies and documents by competent individuals, in lieu of the certification, clearance or permit from the concerned government agencies pursuant to Section 5 of E.O. 45 and proceed to dispose of the application for CR/LS.
