IMPLEMENTING RULES AND REGULATIONS (IRR) OF RA 9966, OR AN ACT CONVERTING THE SULTAN KUDARAT POLYTECHNIC STATE COLLEGE (SKPSC) IN THE CITY OF TACURONG AND ITS DESIGNATED CAMPUSES IN THE MUNICIPALITIES OF LUTAYAN, KALAMANSIG, PALIMBANG AND ISULAN, ALL LOCATED IN THE PROVINCE OF SULTAN KUDARAT INTO A STATE UNIVERSITY TO BE KNOWN AS THE SULTAN KUDARAT STATE UNIVERSITY (SKSU) AND APPROPRIATING FUNDS THEREFOR
RULE I
General Provisions
SECTION 1. Short Title. — This rules and regulations shall be known and cited as the "Implementing Rules and Regulations of Republic Act No. 9966" or IRR of the SKSU Charter, in brevity.
SECTION 2. Promulgation. — This Implementing Rules and Regulations is promulgated pursuant to Section 26 of Republic Act No. 9966 otherwise known as "An Act Converting the Sultan Kudarat Polytechnic State College (SKPSC) in the City of Tacurong and Its Designated Campuses in the Municipalities of Lutayan, Kalamansig, Palimbang and Isulan. All located in the Province of Sultan Kudarat into a State University to be known as the Sultan Kudarat State University (SKSU) and Appropriating Funds Therefor."
SECTION 3. Definition of Terms. — Whenever used in the IRR, the following words or phrases shall mean or refer, thus:
a. Absolute majority — refers to a majority of all those who are entitled to vote in a particular election, whether or not they actually cast ballots. It can be a number of votes totaling over 50 per cent. Generally, it means more than half of the group stands together for the same matter.
b. Academic Freedom — It shall be construed on the following aspects:
b.1. For the University — It is the right of the University to determine for itself, on academic grounds, who may teach, what may be taught, how it shall be taught, courses to be offered, and who may be admitted to study.
b.2. For the Faculty or Instructional Staff — It is the right of the faculty member or teacher to teach the subject of his/her specialization according to his/her best lights; to hold in other subjects, such ideas he/she believes sincerely to be right; and to express his/her opinions on public questions in a manner that shall not interfere with his/her studies as member of the faculty or jeopardize his/her loyalty to the University. It also includes the right of the teacher/faculty member or researcher to investigate and discuss the problems of his/her science and to express his/her conclusions, whether through publication or in the instruction of students, without interference from political or administrative officials of the University, unless his/her methods are found by competent authority/authorities of his/her own profession to be clearly incompetent and contrary to professional ethics and generally accepted practices.
b.3. For the Students — Expression of academic freedom shall consist of, but not limited to the following rights:
b.3.1. To choose a field of study and to pursue the quest for truth; to express their opinion on any subject of public or general concern which directly or indirectly affects the students or the educational system;
b.3.2. To conduct researches in connection with academic work, and to freely discuss and publish their findings and recommendations subject to the provisions of the Research and Development Manual of the University;
b.3.3. To conduct curricular and extracurricular activities in conformity with the existing public policies and of national interest;
b.3.4. To express interpretations or dissenting opinions inside and outside the classroom;
b.3.5. To invite off-campus speakers or resource persons to student-sponsor assemblies, fore, symposia, and other activities of similar nature;
b.3.6. To participate, through their duly elected officers, in the drafting of a new curriculum and in the review or revision of the old;
b.3.7. To participate, through their duly elected officers, in the drafting and/or revising of Student Handbook that shall include the University rules and regulations. A copy of which shall be furnished to the students upon payment of reasonable charge/fee thereof and admission to the University to be determined by the Board upon the recommendation by the University President; and
b.3.8. To be free from any form of indoctrination leading to imposed ideological homogeneity.
c. Auxiliary services — refer to all kinds of services pertaining to economic or profit-generating activities done and/or rendered by the University other than academic such as, hospital, garments and tailoring, cafeteria, janitorial, printing press, bookstore, and the like.
d. Chair and Presiding Officer of the SKSU Board of Regents — refers to the CHED Chairperson or a Commissioner duly designated by him/her to serve and perform the powers and duties as regular Chair and Presiding Officer.
e. Commission on Higher Education (CHED) — is the government agency created by Republic Act No. 7722, otherwise known as the "Higher Education Act of 1994" which has jurisdiction over HEIs, whether public or private, in the Philippines.
f. Community laboratory — is a community adopted by the University as part of its extension program where research and civic services are conducted by its students and/or faculty.
g. Distance learning — is a mode of education delivery at a distance with organizational and administrative support.
h. Dual System — refers to teaching-learning approach utilizing both the experiences gained by the students inside and outside of the classroom, sometimes called the in-school, off-school approach.
i. Duly recognized alumni association — is the federation of the fully recognized alumni associations in the different Campuses of the University which has been extended recognition by the SKSU Board of Regents to be its legitimate and lawful organization of its alumni.
j. Duly recognized faculty association — is the federation of the duly recognized faculty associations in the different Campuses of the University which has been extended recognition by the SKSU Board of Regents to be its legitimate and lawful faculty association, and as manifested in its Constitution and By-Laws accordingly ratified by its members.
k. Duly recognized student council — is the federation of the duly recognized student councils, organizations or governments in the different Campuses of the University which has been extended recognition by the SKSU Board of Regents.
l. Extension Campus — is the Campus that responds to special needs/demands (i.e., instruction, research, and extension) with administrative structure duly created by the SKSU Board of Regents or an enabling law. CAIHTE
m. Extension Services — refers to a function of the University and faculty members comprised of programs, projects, studies or activities conducted in accordance with the policies of the University directed towards the improvement on the quality of life of the target clients and further expand the social contributions of the University to the constituents in various localities of Sultan Kudarat or its nearby localities.
n. Instruction — refers to the function of the University and faculty members which include among others, the pedagogy and academic activities necessary for the delivery of educational services and degree programs, or educational services to the students, professionals, and other clients which are in the realization of the mandates, vision, mission and objectives of the University.
o. Main Campus — is the campus where the administrative services of the University are located and/or where the University President holds office permanently.
p. SKSU — refers to the Sultan Kudarat State University.
q. Open-learning — is the philosophy of student-centered learning adopting a great amount of flexibility in the learning process thus, enabling them to learn at the time, place which satisfies their circumstances and requirements.
r. Production services — is a function of the University and faculty members directed to the development, transfer, utilization and commercialization and protection of new knowledge, technologies, methods, procedure, intellectual properties and scholarly works necessary for continuing improvement in the capacity of the University in the realization of its legal mandates, vision, mission and objectives.
s. Prominent Citizens — refer to the two representatives from the private sector in the SKSU Governing Board who were duly selected and appointed by the Board itself.
t. SKSU Board of Regents — refers to the governing board (GB) or Board of the Sultan Kudarat State University.
u. Special Trust Fund — refers to the total amount collected or charged from students for a specific purpose or from sources, other than payment of tuition fees, held in trust by the University.
v. Tertiary Programs — refers to the four or five year degree programs in the undergraduate level and graduate programs such as master's and doctoral degrees offered by the University.
w. University — refers to the Sultan Kudarat State University.
x. University Code — refers to the set of guidelines of the University duly approved by the Board of Regents containing, among others, and but not limited to, the policies on administration, instruction or academic and admission, research, extension, production, employment, financial management, disciplinary measures, and other relevant guidelines of the University.
y. University President — refers to the head or Chief Executive Officer (CEO) of the University duly appointed by the Board of Regents.
RULE II
Conversion, Integration, and the University Campuses
SECTION 4. Conversion and Integration. — The Sultan Kudarat Polytechnic State College (SKPSC) in the City of Tacurong, together with its duly designated campuses in the municipalities of Lutayan, Kalamansig, Palimbang, and Isulan, all located in the Province of Sultan Kudarat, including its new main campus in ACCESS, EJC Montilla, Tacurong City, and extension campuses in the municipalities of Senator Ninoy Aquino, Bagumbayan, SUNAS-Surallah, South Cotabato and Glan in Sarangani are hereby converted into a state university to be known as the Sultan Kudarat State University (SKSU), hereinafter referred to as the University.
SECTION 5. The Main Campus. — The main campus of the University shall be in the Administration Center, Central Educational Site and Services (ACCESS), EJC Montilla, City of Tacurong which shall be called as the SKSU-ACCESS (Main Campus), where the University President and other organic officials of the University shall hold regular office.
SECTION 6. The External Campuses. — The external campuses located in the City of Tacurong, province of Sultan Kudarat shall henceforth be called as the SKSU-Tacurong City Campus; in the municipalities of Lutayan, Kalamansig, Palimbang and Isulan, all located in the Province of Sultan Kudarat shall henceforth be called as the SKSU-Lutayan Campus, SKSU-Kalamansig Campus, SKSU-Palimbang Campus and SKSU-Isulan Campus, respectively.
SECTION 7. The Extension Campuses. — The Extension campuses located in the municipalities of Bagumbayan and Senator Ninoy Aquino, all located in the Province of Sultan Kudarat, shall henceforth be called as the SKSU-Bagumbayan Extension Campus and SKSU-Senator Ninoy Aquino Extension Campus, respectively. The extension campuses located in the municipality of Glan, Sarangani and in SUNAS, Surallah, South Cotabato, shall henceforth be called as the SKSU-Glan Extension Campus and SKSU-SUNAS Extension Campus, respectively.
RULE III
Coverage, Application and Construction
SECTION 8. Coverage. — This IRR shall apply to and cover the Main Campus and External or Extension Campuses, and such other campuses of the University.
SECTION 9. Application and Construction. — The provisions of this IRR shall be applied in order to attain the mandates, intents, vision, mission, objectives, goals and purposes of the University. SKSU shall strive for continuing provisions of quality higher education, attain greater relevance and global competitiveness and maintain its institutional autonomy and academic freedom in accordance with existing laws, rules, regulations and established jurisprudences. Thus, all doubts in the implementation of the provision of this IRR shall be resolved in favor of the University.
In all matters affecting the welfare of teaching and non-teaching personnel, all doubts in the implementation and interpretation of the provisions of this IRR shall be resolved in favor of the faculty members of personnel, subject to existing laws, rules and regulations.
RULE IV
General Mandate, Curricular Offerings, and Functions
SECTION 10. General Mandate. — The University shall primarily provide advanced instruction and professional training in science and technology, agriculture, fisheries, education, and other relevant fields of study. It shall also undertake research and extension services, and provide progressive leadership in its areas of specialization.
SECTION 11. Curricular Offerings. — The University shall offer undergraduate and graduate courses in science and technology, agriculture, fisheries, education, and other related fields of study within its areas of specialization and according to its capabilities as the Board of Regents may deem necessary to carry out its objectives, in order to meet the needs of the Province of Sultan Kudarat and Region XII; Provided, That no degree program shall be offered without the approval of the Commission on Higher Education (CHED) before the same shall be approved by its Board.
SECTION 12. Continuation of the Curricular Offerings Prior to University Conversion. — The University shall continue the curricular offerings that are offered in the SKPSC-Main Campus and its other campuses prior to the University conversion.
SECTION 13. Requisites in the Consideration and Approval of New Curricular Offerings. — The following requisites shall be satisfied before the Board of Regents consider or approve any new curricular offering:
a. Proposed Curriculum Program that is fully compliant with the appropriate CHED Memorandum Order (CMO) and other relevant policies, standards and guidelines which shall be evaluated and recommended by the University Curriculum Revision and Development Committee;
b. Feasibility Study; and
c. Endorsement of the University Academic Council to the Board.
SECTION 14. Retention and Operation of High School. — The University may retain and continue the operation of a reasonable size Laboratory High School under the College of Teacher Education in the main campus.
Provided, that the University President is authorized to deploy faculty members from the tertiary level who may be assigned to ensure proper management and to teach in the laboratory high school.
RULE V
Administration
SECTION 15. Administration. — The University shall have the general powers of a corporation set forth in Batas Pambansa Blg. 68, as amended, otherwise known as "The Corporation Code of the Philippines." The administration of the University and the exercise of its corporate powers shall be vested exclusively in the Board of Regents and the President of the University, in so far as authorized by the Board.
SECTION 16. Chief Executive Officer. — The University President shall serve as the Chief Executive Officer of the University whose primary duties and responsibilities are to faithfully, properly, efficiently, and effectively carry out the policies, guidelines, and programs lay down by the Board in accordance with existing laws, rules, and regulations.
RULE VI
The Governing Board of SKSU; Composition; Manner of Appointment; Term of Office; Meeting And Quorum; Compensation; and Other Related Matters
SECTION 17. The Governing Board. — The governing board of the University shall be the Board of Regents, hereinafter referred to as the Board, which shall be composed of the following:
a. The Chairperson of the Commission on Higher Education (CHED), Chairperson;
b. The President of the University, Vice Chairperson;
c. The Chairperson of the Committee on Education, Arts, and Culture of the Senate, member;
d. The Chairperson of the Committee on Higher and Technical Education of the House of Representatives, member;
e. The Regional Director of the National Economic and Development Authority (NEDA), member;
f. The Regional Director of the Department of Science and Technology (DOST), member;
g. The President of the federation of faculty associations of the University, member;
h. The President of the federation of student councils of the University, member;
i. The President of the federation of alumni associations of the University, member; and
j. Two (2) prominent citizens from the private sector who have distinguished themselves in their profession or fields of specialization, members.
SECTION 18. Representatives of GB Members Coming from the Government. — If the Chairmen of the Congressional Committees on Education, Arts and Culture/Higher and Technical Education could not personally attend any regular meeting or special session of the Board, they may designate in writing their representatives to the said meeting/session which the latter should present to the Board Secretary before the start of the said meeting or session. They shall be entitled to sit, voice and vote.
The other Board members coming from the government shall personally attend the GB meeting/sessions.
SECTION 19. Selection, Appointment, Qualifications and Selection Process of the Two Prominent Citizens. — The Board shall appoint the two (2) prominent citizens in accordance with Section 10 of RA 8292.
a. Search Committee — A Search Committee (SC) shall be formed and constituted by the President, in consultation with the Chairman of the CHED, which shall take charge of recruiting, screening and recommending to its Board at least five (5) prominent citizens for possible appointment.
b. Composition of SC — The SC to be formed and constituted by the President to be approved by the CHED Chairman shall have at least three (3) members, with one representing the academic community, that is, from the faculty and student sectors, one from the private sector, and one from the CHED, and who shall elect from among themselves their Chair.
c. Minimum Qualification and/or Standards for Private Sector Representatives in the Board of Regents — No person shall become a member of the Board representing the private sector unless he meets the qualifications and/or standard set by its Governing Board. DETACa
d. The private sector representatives may come from places, where the external or extension of main campus of the University, are located.
e. Results of search — The SC shall submit the names of at least five (5) nominees to the Board within thirty (30) days from the inception of its search in accordance with the procedures laid down by the SC itself.
f. Selection — The Board shall select the two (2) private sector representatives from among the five (5) recommended by the SC, taking into consideration their respective qualifications and the weight of their possible contribution vis-à-vis knowledge, expertise and depth and breadth of experience to the deliberations of the Board and to the realization of the mission of the university itself.
g. Appointment — After the two (2) private sector representatives shall have been selected by the Governing Board, they shall be appointed through a Resolution duly adopted by the Board itself.
h. The two private representatives are appointed by the Board. As such their appointment should be signed by the Chairman of the Board of Regents.
i. Assumption — The two (2) duly appointed private sector representatives shall assume office after taking their oaths before the Chairman of Board.
SECTION 20. Term of Office of the President of the Federation of Faculty Associations, President of the Federation of Student Councils, President of the Federation of Alumni Associations, and Private Sector Representatives. — The term of office of the President of the Federation of Faculty Associations, President of the Federation of Student Councils/Body Organizations, and President of the Federation of Alumni Associations shall be co-terminus with their terms of office in such capacities in accordance with their respective Constitution and By-laws. Any deviation or modification thereof should be supported by a valid Resolution, and that such action shall be consistent with the provisions of their individual Constitution and By-laws.
The two (2) private sector representatives shall serve for a term of two (2) years. They may be re-appointed for another term only upon approval by an affirmative absolute majority of the SKSU Board of Regents, provided, that they shall be favorably endorsed by the University President after proper consultation with the Chairperson of the SKSU Board of Regents.
SECTION 21. Succession in the Representation to the Board of Regents by the Faculty, Student, and Alumni Sectors. — In the event that the President of the Federation of Faculty Associations loses his/her employment status by way of resignation, retirement, dismissal or transfer from the University, expiration of term as provided in their Constitution and By-laws or such other causes, or in case the President of the Federation of Student Councils/Body Organizations loses his/her status as bona fide student by way of graduation, resignation, dismissal, expulsion, transfer or such other causes, or if the President of the Federation of Alumni Associations loses his/her authority to hold the position by way of resignation or such as other causes, then the representation of their sector shall be in accordance with the rules on succession of the officers provided in their respective Constitution and By-laws.
Provided, that should there be questions on the succession of officers in any sector, and to avoid gap in the representation of any sector, a special election shall be conducted for the representative of the sector after due consultation with the stakeholders of the sector concerned.
The student representative should be a bona fide student during the conduct of election and the semester or school year of his/her representation to the Board. He/she has similar rights, powers and duties as of other members of the Governing Board.
The duly elected representative shall be eligible to represent their respective sectors to the Board with all the rights of a regular member within the period prescribed by the Board upon the recommendation by the University President.
SECTION 22. Meetings and Quorum of the Board. — The Board shall regularly convene at least once every quarter. However, the Chairperson of the Board may, upon three (3)-days' prior written notice, call a maximum of two (2) special meetings whenever necessary.
A quorum of the Board shall consist of majority of all its members holding office at the time of the meeting: Provided, however, that the Chairperson of the Board or the President of the University is among those present in the meeting.
SECTION 23. Representatives of Board Members Coming from the Government. — In the absence of the Chairperson of the CHED, a Commissioner of the CHED, duly designated by him/her, shall represent him/her in the meeting with all the rights and responsibilities of a regular member.
Provided, further, That this proviso notwithstanding, the Chairperson of the CHED is hereby authorized to designate a CHED Commissioner as the regular Chair of the Board, in which case said CHED Commissioner shall act as the Presiding Officer.
In case the Chairpersons of the Congressional Committee on Education shall not be able to attend the Board Meeting, they may duly designate their respective representatives to attend the said meeting, who shall have the same rights and responsibilities as a regular member of the Board. Provided, That they shall be entitled to sit, voice and vote.
SECTION 24. Presiding Officer. — The CHED Chairperson or the CHED Commissioner as duly designated Chair in his/her capacity as Chairperson of the SKSU-Board of Regents shall preside over the regular meetings or special sessions thereof, except as hereinafter provided for.
In the absence of the CHED Chairperson or the CHED Commissioner as Regular Chair of the SKSU-Board of Regents, the University President, who is the Vice-Chairperson of its Board, shall preside in a particular meeting.
SECTION 25. Rights and Responsibilities of Board Members and No Compensation for the Chairperson, Vice-Chairperson, and Members of the Board. — The Board members shall have all the normal rights and responsibilities of a regular member of the Board of Directors/Board of Trustees on a non-stock, non-profit corporation.
The Board Chairperson, Vice-Chairperson and the members coming from the government have the right to sit as Chair, Vice-Chairperson and the members thereof ipso facto upon their assumption to office.
SECTION 26. Entitlement to Honorarium of the Chairperson, Vice-Chairperson and Members of the Board and Its Resource Persons and duly Constituted Committees. — The Chairperson, Vice-Chairperson and Members of the Board shall be entitled to reasonable honorarium in their attendance during meetings of the Board.
The resource persons and the Committee duly constituted by the Board shall likewise be entitled to reasonable honorarium in their attendance during meetings and such other incidental activities.
Provided, That the rate of honorarium shall be in accordance with the guidelines promulgated by the Department of Budget and Management (DBM) and such other relevant issuances thereof.
SECTION 27. Approval of Urgent Resolutions through Referendum. — The University President may request approval through referendum of any urgent resolution/s of matter/s necessary or incidental to the realization of the mandates, vision, mission, and objectives, and ensure continuity in the delivery of the services of the University that require immediate action prior to the holding of the en banc meeting.
Provided, that such resolution shall be signed by an absolute majority of the Board and shall be submitted for confirmation during the next Board meeting. Provided, further, that both the University President and Chairperson of the SKSU Board of Regents shall approve and sign such resolution before the same be routed to other members for their concurrence and signature. The said resolution shall have the same legal effect as approved by the SKSU Board of Regents en banc.
RULE VII
Powers and Duties of Governing Board
SECTION 28. Powers and Duties of the Board of Regents. — The Board shall have the following specific powers and duties, in addition to its general powers of administration and the exercise of all the powers granted to the Board of Directors of a corporation under existing laws:
a. To promulgate, rules and regulations not contrary to law as may be necessary to carry out the purposes and functions of the University;
b. To receive and appropriate all sums as may be provided, for the support of the University in the manner it may determine in its discretion, in order to carry out the purposes and functions of the University;
c. To import duty-free economic, technical, and cultural books and/or publications, upon certification by the CHED that such imported books and/or publications are for economic, technical, vocational, scientific, philosophical, historical or cultural purposes, in accordance with the provisions of the Tariff and Customs Code of the Philippines, as amended;
d. To receive in trust legacies, gifts, and donations of real properties of all kinds and to administer and dispose of the same when necessary for the benefit of the University and, subject to the limitations, directions, and instructions of the donor, if any.
Such donations shall be exempt from the donor's tax and the same shall be considered as allowable deductions from the gross income in the computation of the income tax of the donor, in accordance with the provisions of the National Internal Revenue Code (NIRC) of 1997, as amended: Provided, That such donations shall be disposed of, transferred, or sold;
e. To fix the tuition fees and other necessary school charges such as, but not limited to, matriculation fees, graduation fees, and laboratory fees, as the Board may deem proper to impose, after due consultation with the involved sectors.
Such fees and charges, including government subsidies and other income generated by the University, shall constitute Special Trust Funds and shall be deposited in any authorized government depository bank, and all interests that shall accrue therefrom shall form part of the same funds for the use of the University. aDSIHc
Any provision of existing laws, rules, and regulations to the contrary notwithstanding, any income generated by the University from tuition fees and other charges, as well as from the operation of auxiliary services and land grants, shall be retained by the University and may be disbursed by the Board for instruction, research, extension, or other programs/projects of the University. Provided, That all fiduciary fees shall be disbursed for the specific purpose for which these are collected.
If, for reasons beyond its control, the University shall not be able to pursue any project for which funds have been appropriated and allocated under its approved program of expenditures, the Board may authorize the use of said funds for any reasonable purpose which, in its discretion, may be necessary and urgent for the attainment of the objectives and goals of the University.
f. To adopt and implement a socialized scheme of tuition and other school fees for greater access to poor but deserving students;
g. To authorize the construction or repair of its buildings, machinery, equipment, and other facilities, and the purchase and acquisition of real and personal properties, including necessary supplies, materials, and equipment;
h. To appoint, upon recommendation of the President of the University, Vice Presidents, deans, directors, heads of departments, faculty members, and other officials and employees of the University.
i. To fix and adjust salaries of faculty members and administrative officials and employees, subject to the provisions of the Revised Compensation and Position Classification System and other pertinent budget and compensation laws governing hours of service and such other duties and conditions as it may deem proper; to grant them, at its discretion, leaves of absence under such regulations as it may promulgate, any provision of existing law to the contrary notwithstanding; and to remove them for cause in accordance with the requirements of due process of law;
j. To approve the curricula, instructional programs, and rules of discipline drawn by the Administrative and Academic Councils as herein provided;
k. To set policies on admission and graduation of students;
l. To award honorary degrees upon persons in recognition of their outstanding contribution in the fields of agriculture, public service, arts, science and technology, education or in any field of specialization within the academic competence of the University; and to authorize the awarding of certificates of completion of non-degree and non-traditional courses;
m. To establish and absorb non-chartered tertiary institutions within the Province of Sultan Kudarat as branches and extension centers of the University, in coordination with the CHED and in consultation with the Department of Budget and Management (DBM), and to offer therein programs or courses to promote and carry out equal and greater access to educational opportunities as mandated by the Constitution;
n. To establish research and extension centers of the University where such will promote the development of the latter;
o. To establish professorial chairs in the University and to provide fellowships for qualified faculty members and scholarships to deserving students;
p. To delegate any of its powers and duties provided for hereinabove to the President or Officer-in-Charge and/or other officials of the University as it may deem appropriate, so as to expedite the administration of the affairs of the University;
q. To authorize an external management audit of the University, to be financed by the CHED, subject to the rules and regulations of the Commission on Audit (COA); and to institute reforms, including academic and structural changes on the basis of the audit results and recommendations;
r. To collaborate with other governing boards of state universities and colleges within the Province of Sultan Kudarat or Region XII, under the supervision of the CHED and in consultation with the DBM, and work towards the restructuring of the University to become more efficient, relevant, productive, and competitive;
s. To enter into joint ventures with business and industry for the profitable development and management of the economic assets of the University, the proceeds from which shall be used for the development and strengthening of the same;
t. To develop consortia and other forms of linkages with local government units (LGUs), institutions, and agencies, both public and private, local and foreign, in furtherance of the purposes and objectives of the University.
u. To develop academic arrangements for institutional capability building with appropriate institutions and agencies, public and private, local and foreign and to appoint experts/specialist as consultants, part-time, or visiting or exchange professors, scholars, or researchers, as the case may be;
v. To set up adoption of modern and innovative modes of transmitting knowledge such as the use of information technology, the dual learning system, open learning or distance education, and community laboratory for the promotion of greater access to higher education and graduate studies, as the case may be;
w. To establish policy guidelines and procedures for participative decision-making and transparency within the University;
x. To privatize, where most advantageous to the University, the management of non-academic services such as health, food, building, grounds or property maintenance, and such other similar activities; and
y. To extend the term of the incumbent President of the University beyond the age of retirement but not beyond the age of seventy (70), whose performance has been unanimously rated by the Board as outstanding, based on the guidelines, qualifications and/or standards set by the Board, after unanimous recommendation by the search committee.
In addition, the Board shall review, confirm and/or take appropriate actions in all contracts, deeds, agreements or instruments entered into by the University President with other entities subject to the limitations provided under this IRR and the University Code and its relevant laws, rules and regulations.
RULE VIII
Promulgation and Implementation of Policies
SECTION 29. Promulgation and Implementation of Policies. — The Board shall promulgate and implement policies in accordance with the declared State policies on education and other pertinent provisions of the Philippine Constitution on education, agriculture, science and technology as well as the policies, standards and thrusts of the CHED under Republic Act No. 7722, otherwise known as the "Higher Education Act of 1994."
All services manuals, policies and guidelines necessary and incidental to ensure proper implementation of the mandates, vision, mission, objectives, programs, and plans of the University shall be reviewed and approved by the Board.
RULE IX
The University President; Minimum Qualifications; Selection and Appointment; Re-Appointment; Vacancy in the Office of the President; Powers and Duties; Compensation; and Fall-Back Position
SECTION 30. Minimum Qualifications and Requirements. — The University shall be headed by a President who shall render full-time service. He/She shall be appointed by the Board, subject to the guidelines, qualifications, and/or standards set by the Board, upon the recommendation of a duly constituted search committee.
Provided, That in order to effect a smooth transition to a state university, the incumbent President of the Sultan Kudarat State Polytechnic State College, if qualified, shall serve as the first President of the University.
SECTION 31. Selection Process. — Within six (6) months before the expiration of the term of office of the incumbent President of the University, the Board shall constitute the Search Committee for the Presidency (SCP).
The composition of the SCP shall be determined by the board taking into consideration representatives from the academic community, a private sector representative not in any way connected or associated with the University, PASUC representative, and a CHED representative.
The SCP so constituted shall recruit and screen applicants for the Presidency and shall devise its own procedures for search.
The SCP shall submit the names of at least three (3) nominees to the Board citing therein the strengths and weaknesses of the nominees for guidance and information of the Board as well as the enumeration and description of the criteria and procedures employed in their search.
SECTION 32. Appointment and Terms of Office of the University President. — After the Board shall have selected and appointed the University President by a majority vote of the members present in a meeting called for that purpose, his/her appointment papers shall be signed by the CHED Chairperson or the CHED Commissioner duly designated as regular Chairperson of the Board.
The University President appointed by the Board shall have a term of four (4) years, the beginning and end of which must be clearly specified in the appointment made by the Board.
SECTION 33. Re-Appointment and Extension of the Term of Office of the University President. — The University President shall be eligible for re-appointment for another term only, subject to the review of the performance and such other requirements set forth by the Board. A unanimous vote of the Board of Regents shall be required to re-appoint a University President. ETHIDa
The Board may extend the services of the incumbent President of the University beyond the retirement age but not later than the age of seventy (70), whose performance has been unanimously voted as outstanding and upon unanimous recommendation by the Search Committee for the President of the University duly created by the Board.
SECTION 34. Filling-Up Vacancy in the Presidency and Appointment of New University President after Vacancy Occurs. — In case of vacancy in the Office of the President by reason of death, compulsory retirement, resignation, removal for cause or incapacity of the President to perform the functions of his/her office, the Board shall designate an Officer-in-Charge of the University within six (6) months from the date of vacancy, pending the appointment of a new President.
In case of vacancy in the Office of the President as mentioned in the immediately preceding paragraph, his/her successor or the Officer-in-Charge shall serve only the unexpired portion of the term.
Provided, that this service for unexpired term shall not however, count as one (1) full term for purposes of appointment/re-appointment.
Provided, That in the event the Board cannot meet for the purpose of filling up the vacancy mentioned above, the CHED Chairperson or the CHED Commissioner as Chair of the Board of Regents shall, within fifteen (15) days from the occurrence of such vacancy, designate an Officer-in-Charge (OIC) in the Office of the President of the University, subject to the confirmation by the Board, whose term of such temporary capacity shall be defined by the Board, and subject to such limitation on his/her powers/duties as may be provided by the Board.
SECTION 35. Power and Duties. — The power and duties of the President of the University, in addition to those specifically provided in this IRR, shall be those usually pertaining to the Office of the President of similar universities, and those delegated by the Board.
Corollary, the University President shall be the Chief Executive Officer (CEO) of the University with the following specific powers, functions, duties, and responsibilities:
a. He/she shall provide leadership for the University, preserve and protect its academic integrity and ensure the observance and implementation of the policies laid down by the Board of Regents;
b. Exercises within the framework of the University's policies as approved by the Board of Regents, primary authority and responsibility over the following areas: development planning and resource allocations; grants, endowments and fund raising; external relations and public affairs; and university policy relating to regional development programs, curricula, and matters affecting the rights, privileges, responsibilities and welfare of the University's constituency;
c. Formulates integrated and comprehensive plans for the University, including academic, research, extension, physical development, and fiscal plans, subject to confirmation by the Board of Regents;
d. Coordinates the activities and programs of the University with the other component units and colleges, to review their goals and objectives, to appraise their performance in relation to such goals and recommend appropriate action to the Board of Regents;
e. Exercises general administration and supervision of all business, financial and academic operations of the university, and over all officers, faculty and non-teaching staff of the university;
f. Recommends to the Board of Regents designations of Vice President, Deans, Directors, Heads of Departments, as well as, appointment of faculty members and personnel in the support staff and other officials and employees;
g. Awards fellowships, assistantships, and scholarships to students, faculty members, and other personnel in accordance with the policies prescribed by the Board of Regents;
h. Sets up machinery for the resolution of all disciplinary and non-disciplinary cases involving the personnel of the university, and for the consideration of petitions for redress of grievances;
i. Plans, prepares and implements, upon authority of the Board of Regents, a University program for the training and education of adult citizens and out-of-school youths, and mainstream the gender and development concerns;
j. Submits to the Board of Regents and/or other competent higher authorities an annual report on the operation of the university, and such other reports as may be required;
k. Presides at commencement and other public exercises of the university, and confer such degrees and honors as may be granted by the Board of Regents and all diplomas and certificates issued by the university shall be signed by him/her;
l. Generates funds and grants-in-aid in support of the operation and development projects of the university to augment its annual budgetary allocations;
m. Supervises the preparation of the university's budget, subject to confirmation by the Board of Regents, or for approval of competent higher authorities;
n. Effects the promotion, transfer, detail, secondment, and other personnel action, of university personnel; grant leaves of absence and approve their additional assignments, additional compensation, resignation and retirement, subject to confirmation by the Board of Regents as it may be deemed appropriate;
o. Approves service credits of any member of the academic staff from teacher's leave vacation and sick leave, or, vice versa in the interest of the service, subject to the policies approved by the Board of Regents and other pertinent laws and regulations;
p. Executes and sign in behalf of the university all contracts, deeds and other instruments necessary for the implementation of the mandated functions of the university, provided, that in regular undertakings and transactions where his/her action is virtually ministerial, conditions and terms thereof having been fixed in the University's existing regulations and general laws, he may direct through written instruction, that approval in specified cases be made in his/her behalf by officers of administration or heads of units concerned, subject to such safeguards to his/her power of revocation;
q. Supervises and coordinates, through the Director of Student Affair Services, all organizations and activities of students. In accordance with existing regulations, he/she shall issue adequate safeguards for the operation of student organizations and other student activities; and
r. Exercises other powers and duties delegated to him/her by the Board of Regents as may hereinafter be provided by subsequent laws and regulations.
SECTION 36. Compensation and Benefits. — The salary of the President shall be in accordance with the Revised Compensation and Position Classification System and shall be comparable to that being received by the President of similar higher educational institutions.
The University President shall likewise be entitled to full retirement benefits under existing law.
Furthermore, the President of the University shall be entitled to Representation and Transportation Allowances (RATA) and such other benefits based on the rates prescribed by the DBM.
SECTION 37. Fall-Back Position of the Incumbent University President. — The incumbent President of the University shall have an automatic fall-back position to the appropriate academic rank or position in accordance with the provisions of DBM Circulars and CSC laws, rules and regulations. Within three (3) months before the expiration of the term of office of the University President, the Human Resource Management Officer of the University shall process necessary documents to ensure his/her entitlement of a fall-back position.
RULE X
The Vice Presidents, Directors, College Deans, Heads and Other Officials
SECTION 38. Appointment. — The University President shall, upon authority by the SKSU-Board of Regents, appoint the Vice Presidents, Campus Directors, Deans, Directors, Heads, Chairpersons, Coordinators, and officials of the University from the faculty members and employees of the University.
Provided, That those administrative positions covered by specific laws or guidelines shall be appointed in accordance with the provisions therein. cSEDTC
The President of the University shall be assisted by a Vice President for Academic Affairs (VP-ACA), a Vice President for Finance, Administration, and Resource Generation (VP-FARG), and a Vice President for Research Development and Extension (VP-RD&E). Provided, that the University President may cause the reclassification of the positions of the Vice Presidents subject to the confirmation by the Board.
Each big campus or cluster of small campuses of the University shall be headed by a Campus Director, and each College of said campuses shall be headed by a Dean. The major programs and functions of the University such as, but not limited to, research, extension, production, auxiliary services, student affairs and services, academic related services, financial management, and administrative services, quality assurance management, planning and management information system shall be headed each by a Director.
The University President shall issue an appropriate Special Order to effect the appointment of Vice Presidents, Deans, Campus Directors, Heads, Chairpersons, Coordinators and other officials of the University.
SECTION 39. Duties and Responsibilities. — The University President shall prescribe the duties and responsibilities of the Vice Presidents, Directors, Deans, Heads, Chairpersons, Coordinators and other officials in accordance with the provisions of the University Code and such other existing rules and regulations.
SECTION 40. Term of Office. — The term of office of the Vice Presidents, Directors, Deans, Heads, Chairpersons, Coordinators and other officials of the University shall be two (2) years or may be renewed for another term at the discretion of the University President.
SECTION 41. Entitlement to Representation and Transportation Allowance and Honorarium. — The Vice Presidents, Directors and College Deans may be entitled to a monthly Representation Allowance and Transportation Allowance (RATA) and Honorarium in accordance with the provisions of DBM Circulars, rules and regulations.
Provided, That the Directors and other officials who are not covered by DBM Circulars, rules and regulations may be granted with reasonable honorarium as the University President may prescribe and approved by the SKSU-Board of Regents, subject to the availability of funds, usual accounting and auditing rules and regulations.
Provided, furthermore, That the amount necessary to support the grant for RATA and honorarium may be charged from appropriate funds of the University subject to applicable laws, rules and regulations.
RULE XI
Heads of University Campuses; Qualifications; Selection and Appointment; Term of Office; Re-Appointment; Compensation; and Other Related Matters
SECTION 42. Minimum Qualifications and Requirement. — Campus Directors shall head the University campuses and preferably a Doctorate degree holder and shall render full time service. They shall be appointed by the Board upon recommendation of the search committee and the University President, subject to the guidelines, qualifications and/or standards set by the Search Committee and approved by the Board.
SECTION 43. Selection Process. — Within three (3) months before the expiration of the term of the incumbent Campus Director, the University President shall constitute the Search Committee for the Campus Director (SCCD).
The composition of the SCCD shall be determined by the University President taking into consideration representatives from the academic community, a private sector representative not in any way connected or associated with the University. The duly constituted SCCD shall recruit and screen applicants for the Campus Director and may devise its own procedures for the search.
The SCCD shall submit the names of at least three (3) nominees to the University President citing therein the strengths and weaknesses of the nominees for guidance and information of the University President as well as the enumeration and description of the criteria and procedures adopted in the search.
SECTION 44. Appointment and Terms of Office of the Campus Director. — After the University President shall have selected the Campus Director, it shall be submitted to the BOR for confirmation and his/her appointment papers shall be signed by the University President. Upon issuance of Special Order by the University President, the Campus Director appointed by the President shall have a term of two (2) years or as the latter may determine, the beginning and end of which must be clearly specified in the appointment.
SECTION 45. Re-Appointment of the Campus Director. — The Campus Director shall be eligible for re-appointment for another term only, subject to the review of the performance and such other requirements set forth by the University President and the Board.
SECTION 46. Appointment of New Campus Director after Vacancy Occurs. — In case a new Campus Director is appointed by the University President after a permanent vacancy occurs in the Office of the Campus Director during the term of office of the original appointee by reason of death, resignation, retirement, dismissal or transfer from the University, expiration of term on such other causes, the successor shall hold office only for the unexpired portion of his/her term.
Provided, that this service for the unexpired term shall not however, count as one (1) full term for the purposes of appointment/re-appointment.
SECTION 47. Compensation and Benefits. — The salary of the Campus Director shall be based on his/her plantilla position as a faculty and shall be in accordance with the Revised Compensation and Position Classification System and shall be comparable to that being received by the Campus Director of similar higher educational institutions.
The Campus Director shall likewise be entitled to full retirement benefits under existing laws.
Furthermore, the Campus Director of the University shall be entitled to Representation and Transportation Allowances (RATA) and such other benefits in accordance with the policies and guidelines prescribed by the DBM and depending on the availability of funds.
SECTION 48. Duties and Responsibilities of the Campus Directors. — The Campus Directors shall discharge the duties and responsibilities as the University President may prescribe in the University Code and such other relevant laws, rules and regulations in so far as authorized by the Board.
RULE XI n
The Administrative Council
SECTION 49. Composition, Powers and Duties. — There shall be an Administrative Council consisting of the President of the University as Chairperson, Vice Presidents, Campus Directors, Deans, Division Directors and other officials of equivalent rank as members, whose duty is to review and recommend to the Board the policies governing the administration, management and development of the University for appropriate action.
Provided that, in the absence of the President, the Vice President for Finance, Administration, and Resource Generation shall preside, and in the absence of both, the Vice President for Academic Affairs may preside.
The Administrative Council shall have a Secretary to be designated by the University President from the officials or faculty members of the University. The duly designated Secretary shall keep all records and proceedings of the Administrative Council serve upon each member of the Administrative Council the appropriate notice of the meetings, and discharge such other duties and responsibilities as the Administrative Council and/or University President may determine.
SECTION 50. Meetings and Quorum. — The University President shall fix the schedule and venue of every meeting of the Administrative Council. A special meeting may be called by the President upon the request of the majority of the Administrative Council officials, or upon written request of one-third of the members of the Council.
A quorum for any meeting of the members shall consist of fifty percent (50%) plus one of the members and a majority of such quorum may decide any question at the meeting except those matters that require the affirmative vote of a greater proportion as prescribed by relevant laws, rules and regulations and as provided in the University Code.
SECTION 51. Constitution and Internal Rules of Procedures. — The Administrative Council shall be constituted by the University President. The duly constituted Council may formulate and promulgate internal rules of procedures to ensure proper and orderly conduct of its business and meetings. SDAaTC
RULE XII
The Academic Council
SECTION 52. Composition. — There shall be an Academic Council to be composed of the President of the University, who shall act as Chairperson and all academic staff with the rank of not lower than assistant professor, as members.
Provided that, in the absence of the President, the Vice President for Academic Affairs shall preside.
The Academic Council shall have a Secretary to be designated by the University President from the officials or faculty members of the University. The duly designated Secretary shall keep all the records and proceedings of the Academic Council, serve upon each member of the Academic Council the appropriate notice of meetings, and discharge such other duties and responsibilities as the Academic Council and/or University President may determine.
SECTION 53. Powers. — The Academic Council shall have the power to review and recommend the curricular offerings and rules of discipline of the University, subject to the approval of the Board. It shall fix the requirements for the admission of students, as well as for graduation and conferment of degrees subject to review and/or approval by the Board through the President of the University. It shall have the disciplinary power over students of the University and shall formulate academic policies, procedures rules and regulations on discipline, subject to the approval of the Board of Regents.
SECTION 54. Meetings and Quorum. — The University President shall fix the schedule and venue of every meeting of the Academic Council. A special meeting may be called by the President upon the request of the majority of the Academic Council members, or upon written request of one-third of the members of the Council.
A quorum for any meeting of the members shall consist of fifty percent (50%) plus one of the members and a majority of such quorum may decide any question at the meeting, except those matters that require the affirmative vote of a greater proportion as prescribed by relevant laws, rules and regulations.
SECTION 55. Constitution and Internal Rules of Procedures. — The Academic Council shall be constituted by the University President. The duly constituted Council may formulate and promulgate internal rules of procedures to ensure proper and orderly conduct of its business and meetings.
RULE XIII
University and Board Secretary
SECTION 56. The Secretary of the University and the Board. — The Board shall appoint a secretary, who shall serve as such for both the Board and the University and shall keep all records and proceedings of the Board. He/She shall serve upon each member of the Board the appropriate notice of the Board meetings.
In addition, the University and Board Secretary shall discharge such other duties and responsibilities as the University President and/or Board may prescribe and as provided in the University Code.
RULE XIV
Treasurer of the University
SECTION 57. The Treasurer of the University. — The Treasurer of the Philippines shall be ex officio treasurer of the University.
RULE XV
The Faculty
SECTION 58. Prohibitions in the Selection of Faculty. — No religious opinion or affiliation, creed, gender preference, and political beliefs, cultural community affiliation or ethnic origin, shall be a matter of inquiry in the appointment of faculty members of the University: Provided, That said appointment shall be subject to the guidelines, qualifications, and/or standards set by the Board.
SECTION 59. Appointment, Compensation and Other Benefits of Faculty Members. — The appointment of faculty members shall be subject to the guidelines, qualifications and/or standards set by the Board: Provided further, That no member of the faculty shall teach for or against any particular church or religious sect.
Faculty members of the University shall be entitled to compensation and other benefits prescribed by the existing laws, rules and regulations. They may also be entitled to honorarium for overload services pay and for their actual involvement in research, extension and production services related programs, projects or activities in accordance with applicable laws, rules and regulations in so far as authorized by the Board of Regents upon recommendation by the University President.
RULE XVI
Scholarship Program and Admission
SECTION 60. Scholarship Program. — The University shall provide scholarship programs and other assistanceship programs to assist poor but deserving students who qualify for admission to the University.
SECTION 61. Admission. — No student shall be denied admission to the University by reason of sex, gender preference, religion, cultural or community affiliation or ethnic origin.
RULE XVII
Academic Freedom and Institutional Autonomy
SECTION 62. Academic Freedom and Institutional Autonomy of the University. — The University shall enjoy academic freedom and institutional autonomy, pursuant to paragraph 2, Section 5 of Article XIV of the Constitution of the Republic of the Philippines and as provided under Batas Pambansa Blg. 232 also known as the "Education Act of 1982" and Republic Act No. 8292 otherwise known as the "Higher Education Modernization Act of 1997," and such other applicable laws.
SECTION 63. Academic Freedom of Faculty Members and Students. — Faculty members and students of the University shall enjoy academic freedom as provided for under this IRR, and the University Code, and such other applicable laws.
RULE XVIII
Authority to Loan or Transfer Apparatus, Equipment, Supplies and Detail of Personnel
SECTION 64. Authority to Loan or Transfer. — The heads of the bureaus and offices of the national government are hereby authorized to loan or transfer, upon the request of the President of the University, such apparatus, equipment or supplies as may be needed by the University, and to detail employees for duty therein when, in the judgment of the head of bureau or office, such apparatus, equipment and supplies or services of such employees can be spared without serious detriment to the public service.
The employees so detailed shall perform such duties as required of them by the President of the University, and the time so employed shall be counted as part of their regular services.
RULE XIX
Assets, Liabilities and Personnel
SECTION 65. Transfer of Assets and Liabilities. — All assets, fixed and movable, personnel and records of the Sultan Kudarat Polytechnic State College, as well as liabilities or obligations, are hereby transferred to the University: Provided, however, That the positions, rights and security of tenure of faculty members and personnel therein employed under existing laws prior to the conversion into a University shall be respected.
SECTION 66. Positions, Rights and Security of Tenure of Personnel. — The position, rights and security of tenure of faculty members and personnel therein employed under existing laws shall be respected.
Provided, That the University President may recommend the transfer or detail of any faculty member or employee from one Campus to other Campuses of the University, subject to relevant CSC laws, rules and regulations, to further improve the quality in the delivery of services and the realization of the mandates, vision, mission and objectives of the University.
Provided further, That the selection and promotion and such other personnel action in all campuses of the University shall be subject to the policies and guidelines set forth by the Board. The appointment of personnel assigned by the proper official/s shall be duly approved by the University President.
SECTION 67. Selection and Appointment of the Personnel. — The selection and appointment of any personnel of all Campuses of the University shall be subject to the guidelines, qualifications and/or standards prescribed by the Board, and other applicable CSC laws, rules and regulations.
SECTION 68. Compensation and Other Benefits. — Personnel of the University shall be entitled to compensation and other benefits prescribed under existing laws, rules, and regulations.
He/She may also be entitled to honorarium for overload services with pay and their actual involvement in research, extension, production services related programs, projects or activities in accordance with laws, rules, and regulations in so far as authorized by the Board of Regents upon the recommendation by the University President.
SECTION 69. Ownership and Titling of Properties. — All parcels of land belonging to the government and occupied by the Sultan Kudarat Polytechnic State College are hereby declared to be the property of the University, and shall be titled under that name: Provided, That should the University cease to exist or be abolished, or should such parcels of land aforementioned be no longer needed by the University, the same shall revert to the LGUs concerned.
The University President shall cause the immediate titling of the aforementioned properties in line with existing laws, rules and regulations.
RULE XXI
Appropriations and Financial Management
SECTION 70. Appropriations. — The amount necessary to carry out the provisions of this Act shall be charged against the current year's appropriations of the Sultan Kudarat Polytechnic State College, except the sums needed to continue the operations of the existing high schools. Thereafter, such sums as may be necessary for the continued operation and maintenance of the Sultan Kudarat State University shall be included in the annual General Appropriations Act. acEHCD
SECTION 71. Financial Management. — The financial management of the University shall be in accordance with COA Circulars and such other applicable laws, rules and regulations.
Provided, That the University shall exercise reasonable flexibility on the use of its internally generated income to augment its operations and finance the expenses necessary and incidental to the proper implementation of its major functions such as, instruction, research, extension, and production services.
RULE XXII
CHED Monitoring and Evaluation
SECTION 72. Conduct of Evaluation. — The CHED shall conduct regular monitoring and evaluation to determine continuing compliance with the requirements on university status.
Provided, That the University shall be given prior notice on the conduct of the evaluation.
SECTION 73. Appeal and Implementation of Recommendations. — Any recommendation by the CHED which may adversely affect the University status shall not preclude the right of the University to appeal before the CHED, Senate Committee on Education, Arts and Culture, and the House Committee on Higher and Technical Education in accordance with the existing laws, rules and regulations.
The University shall be given reasonable time to fully comply with the recommendations by the CHED. As much as practicable, the University shall submit appropriate reports to CHED, the Senate Committee on Education Arts and Culture, and the House Committee on Higher and Technical Education for its continuing implementation of the recommendation and compliance with the requirements of the University status.
SECTION 74. Revocation of the University Status. — In the event that the Commission finds that the University does not maintain compliance with the University status, it shall submit the appropriate recommendation for the revocation thereof to the Senate Committee on Education, Arts and Culture, and the House Committee on Higher and Technical Education.
RULE XXIII
Filing of Report
SECTION 75. Filing of Report. — On or before the fifteenth (15th) day of the second (2nd) month after the opening of the regular classes each year, the Board shall file with the Office of the President of the Philippines, through the Chairperson of the CHED and with both Houses of Congress, a detailed report on the progress, conditions, and needs of the University.
Provided, That the University President through its duly designated or authorized officials shall facilitate the preparation and submission of the appropriate report and shall be confirmed by the Board.
RULE XXIV
Miscellaneous and Transitory Provisions
SECTION 76. Designation, Duties and Responsibilities, and Term of Office of the Vice Presidents, Campus Directors, College Deans, Directors, Heads and Other Officials of the University. — The University President shall designate from the faculty members or employees, the Vice Presidents, Campus Directors, College Deans, Division, Directors, Heads, Chairpersons and other officials, where there is no existing available plantilla positions expressly authorized by the DBM for the Vice Presidents, Campus Directors, Directors, College Deans, Head and other officials of the University. He/she shall preferably be a Doctorate degree holder, as the case may be, subject to the confirmation by the Board.
The term of office, and the duties and responsibilities of the duly designated Vice Presidents, Campus Directors, College Deans, Division Directors, Heads, Chairpersons and other officials shall be solely determined by the University President and duly approved by the SKSU-Board of Regents in accordance with the provisions of the University Code and such other applicable laws rules and regulations in so far as authorized by the Board. Provided, That in exigency of service, they shall be eligible for designation to other position in concurrent capacity. Provided, further, That they shall be qualified for re-designation at the sound discretion of the University President.
The University President shall designate any faculty members or employee of the University to act as Officer-in-Charge of the Office of the Campus Director of any campus pending the selection and appointment of a regular Campus Director or such other causes, who shall perform the duties and responsibilities, as the University President may prescribed in accordance with the University Code and applicable laws, rules and regulations in so far as authorized by the Board.
The University President shall issue appropriate Special Orders to effect the designations of the Vice Presidents, Directors, College of Deans, Heads, Chairpersons and other officials of the University.
SECTION 77. Entitlement to Benefits of Designated Officials. — The duly designated Vice Presidents, Officer-in-Charge of the Office of the Campus Directors, College Deans and Directors of the University shall be entitled to representation and transportation allowance (RATA) in accordance with the rates prescribed by the DBM and such other benefits expressly provided under the University Code and pertinent rules and regulations in so far as authorized by the Board.
Provided, That the duly designated Director and other officials who are not covered by the grant of RATA may be entitled to reasonable honorarium as the University President may determine upon approval by the Board subject to availability of funds and usual accounting and auditing rules and regulations.
SECTION 78. Selection of the Campus Directors. — As much as practicable and appropriate, the selection process of the Campus Directors may be undertaken with reasonable time as the University President may determine in accordance with pertinent provisions of this IRR duly approved by the Board.
SECTION 79. Adjustment or Formulation of the Organizational Structure and Filling-Up of the Positions. — The University President shall adjust or formulate the organizational structure of the University, and the positions indicated therein shall be filled-up in accordance with the provisions of this IRR subject to review and approval by the Board.
SECTION 80. Development Plan and Management Audit. — Within the period of one hundred twenty (120) days after the approval of this Act, the University shall formulate a five-year development plan on human resource and physical facilities, to include its corresponding program budget to the CHED, for recommendation to the DBM. Likewise, the University shall prepare itself or a management audit in cooperation with the CHED.
RULE XXV
Suppletory Application
SECTION 81. Suppletory Application of Republic Act No. 8292. — The provisions of Republic Act No. 8292, otherwise known as the "Higher Education Modernization Act of 1997," shall be an integral part of this Act and shall serve as part of the Governing Charter of the University.
SECTION 82. Suppletory Laws, Rules, and Regulations. — All relevant laws, rules, and regulations promulgated by the Commission on Higher Education, Civil Service Commission, Commission on Audit, and such other competent authorities shall suppletorily apply to this IRR in so far as authorized by the Board of Regents.
RULE XXVI
Parity, Separability and Repealing Clauses
SECTION 83. Parity Clause. — All other powers, functions and privileges, responsibilities and limitations to state universities and/or their officials under existing laws shall be deemed granted to or imposed to or imposed upon the University and/or its officials, whenever appropriate.
SECTION 84. Separability Clause. — If, for any reason, any part of provision of this Act is declared invalid or unconstitutional, the remaining parts or provisions not affected thereby shall remain in full force and effect.
SECTION 85. Repealing Clause. — All laws, presidential decrees, executive orders, rules and regulations contrary to or inconsistent with the provisions of this Act are hereby repealed or modified.
RULE XXVII
Revision, Amendment and Effectivity
SECTION 86. Revision. — This IRR may be revised by the SKSU-Board of Regents upon the recommendation by the University President. Provided, That a Committee shall be created to study and review any proposal to revise this IRR before the Board may act thereof. The duly approved revised IRR shall be submitted to the CHED for information.
SECTION 87. Amendment. — Any part or provision of this IRR may be amended by the Board, upon the recommendation by the University President, Provided, That a Committee shall be created to study and review any proposal to amend this IRR before the Board may act thereof. The duly approved amendments shall be submitted to the CHED for information.
SECTION 88. Effectivity. — This IRR shall take effect fifteen (15) days after its publication in two (2) newspapers of general circulation in the Philippines.
Implementing Rules and Regulations (IRR) of RA 9966 was approved through Board Resolution No. 049-2017 on September 13, 2017 during the 105th Regular meeting of SKSU Board of REGENT held at CHED Executive Conference Room, HEDC Building C.P. Garcia Street, UP Campus, Diliman Quezon City.
