IMPLEMENTING RULES AND REGULATIONS OF REPUBLIC ACT NO. 8059
(AN ACT DECLARING BARANGAY PATAG IN SILAY CITY, PROVINCE OF NEGROS OCCIDENTAL, A TOURIST ZONE)
PART I
General Provisions
Pursuant to the provisions of Republic Act No. 8059, dated June 15, 1995 otherwise known as "An Act declaring Barangay in Silay City, Province of Negros Occidental, a tourist zone", the following rules and regulations are hereby promulgated and adopted:
RULE I
Declaration of Policy
SECTION 1. It is hereby declared the policy of the State to develop, promote and encourage Philippine tourism as a major national activity with the end-in-view of generating foreign exchange and local employment as well as the expansion of domestic travel to various local tourist destinations so that the country's natural beauty, history and culture will be appreciated and enjoyed. SECTION 2. The 20-year Philippine Tourism Master Plan (PTMP) as adopted by the Government through Proclamation No. 188, dated June 02, 1993 shall serve as the framework for the overall development of the tourism sector. The PTMP shall be implemented through the concerted efforts of concerned national government agencies (NGAs) and local government units (LGUs), non-governmental organizations (NGOs), and the private sector.
RULE II
Basic Principles, Policies and Objectives
SECTION 1. It is hereby declared the Policy of the State to develop Barangay Patag in Silay City, Negros Occidental as a tourist zone.
SECTION 2. The Department of Tourism (DOT), in close coordination with the Philippine Tourism Authority (PTA), other concerned NGAs, LGUs and NGOs shall have the responsibility and/or jurisdiction over the area declared as tourist zone and shall accordingly plan, develop and promote Barangay Patag in the City of Silay, Province of Negros Occidental as a tourist zone. RULE III
Concepts and Definitions
SECTION 1. Concept of tourist zone. — A tourist zone shall mean a geographic area with well defined boundaries proclaimed as such by the President and/or by acts of Congress, upon the recommendation of the DOT and placed under its administration and control in coordination with PTA. No development projects for any purpose shall be introduced within the zone prior to the formulation of a Tourism Master Development Plan Tourism Zones are established for the conservation of natural and man-made resources as well as the preservation of cultural and historical heritage for the appreciation and enjoyment of the local population, as well as of the tourists.
SECTION 2. Tourism Development Plan. — refers to specific courses of action to be undertaken over a period of time in a defined area with specific boundaries which involves the development of the area, the enhancement of the aesthetics and recreational features of existing tourism resources and the requisite infusion of public and private investments.

The Barangay Patag Master Tourism Development Plan
RULE IV
Formulation of a Master Tourism Development Plan
SECTION 1. The DOT, in coordination with PTA, concerned NGAs, LGUs, and private sector shall formulate a Master Tourism Development Plan (MTDP) for Barangay Patag, Silay City, Negros Occidental.
SECTION 2. The Plan shall, among others, provide the framework for the overall development of the area components, sourcing of financial and budgetary resources and the creation of appropriate institutional mechanism to carry out the intent of the MTDP in accordance with RA 8059. The Plan, shall, likewise, delineate the responsibility of all concerned agencies in the development of the area into a tourist destination.
SECTION 3. The PTA, as implementing arm of the DOT for physical development shall be the primary government agency to undertake the implementation of the MTDP in the tourist zone.
RULE V
Implementation of the MTDP
SECTION 1. The DOT shall incorporate in its annual budget the required funds for projects identified in the Plan as priority for implementation in the next fiscal year and succeeding years as may be provided.
SECTION 2. The PTA shall include in its annual work program the implementation of identified priority tourism projects in the Plan as specified in DOT's Annual Budget included in the General Appropriations Act (GAA).
SECTION 3. After completion of the construction of identified tourism facilities within the tourist zone, the DOT/PTA shall enter into a memorandum of agreement with the concerned LGU for the purpose of turning over the management/maintenance of said tourism facilities to the latter.
SECTION 4. Upon acceptance of the project, the concerned LGU shall include in its annual budget and program of work necessary financial outlay to fund the operation, maintenance and improvement of said tourism facilities. TcHCIS
SECTION 5. The LGU, in accordance with the provisions of the Local Government Code as provided for in RA 7160, dated October 10, 1991 and with the assistance of the DOT, shall undertake the promulgation of necessary rules and regulations on all tourism related activities and the enforcement thereof in order to promote and preserve the area as a tourist zone.
SECTION 6. The DOT and the concerned LGUs shall undertake the appropriate marketing strategies and programs to promote the zone as a tourist destination.
PART III.
Final Provisions
RULE VI
Effectivity
SECTION 1. These Implementing rules and regulations shall take effect upon approval and publication in the Official Gazette or in at least two (2) newspapers of national circulation.
