IMPLEMENTING RULES AND REGULATIONS (IRR) OF REPUBLIC ACT (RA) NO. 9083 (AN ACT ESTABLISHING THE STA. ROSA SCIENCE AND TECHNOLOGY HIGH SCHOOL IN STA. ROSA, LAGUNA AND APPROPRIATING FUNDS THEREFOR)

1. For the information and guidance of all concerned, enclosed is a copy of the Implementing Rules and Regulations (IRR) of Republic Act (RA) No. 9083 entitled An Act Establishing the Sta. Rosa Science and Technology High School in Sta. Rosa, Laguna and Appropriating Funds Therefor.
2. The IRR of RA 9083 shall cover the organization, administration, operations and management of Sta. Rosa Science and Technology High School of Sta. Rosa City, Laguna.
3. The IRR shall take effect 15 days after its publication in the Official Gazette or in a newspaper of general circulation. For this purpose, the Public Affairs Service-Publications Division (PAS-PD) is hereby directed to facilitate such publication and immediately register this IRR with the Office of the National Administrative Register (ONAR) of the University of the Philippines (UP) Law Center, UP Diliman, Quezon City.
4. All DepEd Orders and other related issuances, rules and regulations and provisions which are inconsistent with these guidelines are hereby repealed, rescinded, or modified accordingly.
5. Immediate dissemination of and strict compliance with this Order is directed.

Implementing Rules and Regulations of Republic Act No. 9083Sta. Rosa Science and Technology High School in Sta.
RULE I
Preliminary Provisions
SECTION 1. Creation and Establishment. — Pursuant to Section 1 of Republic Act No. 9083, the Santa Rosa Science and Technology High School (SRSTHS), is hereby established at Sta. Rosa, Laguna, now City of Santa Rosa, under the direct administrative supervision of the Department of Education (DepEd). CAIHTE
SECTION 2. Purpose. — The SRSTHS shall offer a free secondary course with special emphasis on subjects pertaining to science and technology with the end in view of preparing its students for careers in science and technology.
SECTION 3. Interpretation. — These Implementing Rules and Regulations (IRR) shall be interpreted in the light and purpose of R.A. No. 9083, consistent with the provisions of R.A. No. 9155, R.A. No. 10533, and all other basic education-related laws enacted thereafter.
SECTION 4. Scope and Coverage. — These rules shall cover the organization, administration, operations and management of SRSTHS.
RULE II
Definition of Terms
SECTION 5. As used in these rules, the following terms shall be defined as:
a) Act — refers to Republic Act No. 9083, otherwise known as "An Act Establishing the Sta. Rosa Science and Technology High School in Sta. Rosa, Laguna and Appropriating Funds Therefor."
b) RA 9155 — refers to Republic Act No. 9155, entitled: "An Act Instituting a Framework of Governance for Basic Education, Establishing Authority and Accountability, Renaming the Department of Education, Culture and Sports as the Department of Education, and for Other Purposes", otherwise known as the "Governance of Basic Education Act of 2001."
c) RA 10533 — refers to Republic Act No. 10533, entitled: "An Act Enhancing The Philippine Basic Education System by Strengthening its Curriculum and Increasing the Number of Years for Basic Education, Appropriating Funds Therefor, and for Other Purposes," or the "Enhanced Basic Education Act of 2013."
d) School Head — refers to the Head of the SRSTHS whose functions, powers and duties, in addition to those specifically provided for in the Act and this IRR, shall be those usually pertaining to the office of the principal of a public high school.
RULE III
Organization and Management
SECTION 6. School Head. — The SRSTHS shall be headed by a School Head whose authority, accountability and responsibility shall be in accordance with R.A. No. 9155 and other related rules and regulations.
SECTION 7. School Governing Council. — The School Governing Council (SGC), of SRSTHS, shall be organized consistent with the principles of School Based Management (SBM), as approved by the DepEd. The Board of Trustees as mentioned in Section 4 of the Act shall act as the advisory council of the SGC.
SECTION 8. Executive Council. — There shall be an Executive Council consisting of the School Head, the heads of the departments, and such other ranking faculty members or officials of the SRSTHS, as may be determined by the School Head. The Council shall ensure the delivery of quality education programs, projects and services.
The Council shall have the following functions:
a. Screen and select students to be admitted to SRSTHS;
b. Select students who shall be recipients of financial assistance;
c. Enhance and contextualize the curricula, course of study and school rules of discipline;
d. Recommend students eligible for graduation; and
e. Perform such other functions as may be determined by the SGC.
SECTION 9. Other Personnel and Staff. — In addition to the personnel provided in this IRR, the Schools Division of Sta. Rosa City shall hire teachers and other necessary personnel and support staff in the operation of SRSTHS, in accordance with the existing rules and regulations of the DepEd.
SECTION 10. Appointment and Compensation. — Appointment and compensation of the abovementioned personnel and staff shall be in accordance with DepEd guidelines and Civil Service laws, rules and regulations.
RULE IV
Finance and Management
SECTION 11. SRSTHS as Implementing Unit. — The Office of the Undersecretary for Finance and Administration and the Office of the Regional Director of DepEd shall ensure that the SRSTHS shall continue to be classified as an Implementing Unit to effectively manage its finances and ensure fiscal autonomy and accountability.
SECTION 12. Partnership and External Linkages. — Through partnership and external linkages, the SRSTHS may enter into agreements with the national government agencies, government-owned and/or controlled corporations, local government units, non-government organizations, civil society organizations, whether local, national or international, and such other institutions for purposes of providing scholarship grants, stipends and allowances for the students of SRSTHS, and other benefits and donations. SECTION 13. All Legacies, Gifts and Donations. — All legacies, gifts and donations for the benefit of the SRSTHS for its support and maintenance or for aid to any of its students shall be tax-exempt and shall be an allowable deduction from the gross income of the donors.
RULE V
Curriculum and Instruction
SECTION 14. Curriculum. — The SRSTHS shall implement the existing special curriculum in science and technology and such other special programs as may be formulated and designed by the DepEd. The SRSTHS may localize, contextualize and enhance its curriculum.
SECTION 15. Instruction. — The curricular learning areas shall be handled only by teachers with relevant specialization.
RULE VI
Learning Environment
SECTION 16. Educational Resources. — The DepEd shall provide SRSTHS with adequate and open educational resources appropriate for the special curriculum in science and technology to ensure accessible and quality basic education services.
SECTION 17. Other Facilities and Structures. — Other buildings, structures and facilities, which include but not limited to, dormitory, canteen, sports facilities, multi-purpose building and clinic, may be sourced from other funding agencies and local government units, if not included under the DepEd national budget.
RULE VII
Monitoring and Evaluation
SECTION 18. Monitoring and Evaluation. — Consistent with the monitoring and evaluation (M&E) system of DepEd, the Schools Division of Santa Rosa City, in coordination with DepEd Region IV-A, shall monitor and evaluate the performance of SRSTHS.
SECTION 19. School Report Card. — Using the School Report Card, the School Head shall cause the publication of the performance of SRSTHS annually for all stakeholders to ensure transparency and accountability.
RULE VIII
Transitory Provisions
SECTION 20. School Sites. — The SRSTHS shall immediately initiate the formal acquisition of its school site.
RULE IX
Miscellaneous Provisions
SECTION 21. Repealing Clause. — All DepEd Orders and other related issuances, rules and regulations which are inconsistent with this IRR are hereby repealed, rescinded, or modified accordingly.
SECTION 22. Effectivity. — This IRR shall take effect fifteen (15) days after its publication in the Official Gazette or a newspaper of general circulation. This shall be registered with the Office of the National Administrative Register (ONAR) at the University of the Philippines Law Center, UP Diliman, Quezon City.
