DTI ADMINISTRATIVE ORDER NO. 06-03
| SUBJECT | : | Implementing Rules and Regulations of Executive Order No. 180 |
Pursuant to Section 5 of Executive Order No. 180 dated 27 February 2003, devolving to the Autonomous Regional Government of the Autonomous Region in Muslim Mindanao Certain Powers and Functions of the Department of Trade and Industry, the following are hereby prescribed for the information, guidance and compliance of all concerned:
SECTION 1. The rules stipulated under Section 2 of E.O. 180 shall govern the personnel of the DTI assigned in the Province of Basilan (except Isabela City) and the City of Marawi. Since the DTI personnel from these areas are under the DTI Regional Office for Regions 9 and 12, respectively, the Administrative Division of DTI Regions 9 and 12 shall coordinate with their counterparts from the Autonomous Regional Government (ARG). The Civil Service Regional Office concerned should be informed of the developments and final action on all personnel matters for documentation and transfer of records.
The DTI-Head Office, through the GAS Personnel Division, may assist in reviewing the documents to be submitted by the DTI Regional Offices concerned, including the computation of claims to be submitted in the event that the affected personnel opts to retire. Thereafter, the DTI Regional Offices concerned may process the documents.
SECTION 2. In relation to Sections 4 and 6 of E.O. 180, the transfer of assets, equipment, budgetary allocation and properties to the ARG should be in accordance with existing rules on property management, as well as accounting and auditing rules and regulations. The DTI Regional Offices, through its Administrative and Finance Divisions, shall ensure compliance therewith. The respective offices of the Commission on Audit should also be furnished with copies of the reports on these matters.
SECTION 3. The DTI through its offices and bureaus shall continue to provide support and technical assistance to the ARG in facilitating the performance of the economic development mandate.
SECTION 4. The attached Annex "A" is hereby prescribed and ordered implemented by all concerned.
SECTION 5. A Memorandum of Agreement to operationalize the transfer of resources which will include the budget shall be formulated and entered into by and among DTI-9 and ARMM.
SECTION 6. This Department Administrative Order shall take effect after fifteen (15) days from publication in a newspaper of general circulation. EHaCTA
