CESB RESOLUTION NO. 1639

IMPLEMENTING GUIDELINES OF EXECUTIVE ORDER NO. 145 (S. 2021), ENTITLED, "REINFORCING THE POLICY ON THE GRANT OF CAREER EXECUTIVE SERVICE OFFICER RANK TO GRADUATES OF THE NATIONAL DEFENSE COLLEGE OF THE PHILIPPINES, FURTHER AMENDING EXECUTIVE ORDER NO. 696 (S. 1981), AS AMENDED FOR THE PURPOSE"

WHEREAS, Section 17, Article VII of the 1987 Philippine Constitution, provides that the President shall have control of all executive departments, bureaus, and offices;

WHEREAS, Article IV, Part III of the Integrated Reorganization Plan, as approved by Presidential Decree No. 1 (s. 1972), as amended, created the Career Executive Service Board (CESB) to serve as the governing body of the Career Executive Service (CES), and is mandated by law to promulgate rules, standards and procedures on selection, classification, compensation and career development of members of the CES;

WHEREAS, Presidential Decree No. 1, as amended, provides that members of the CES shall be classified according to rank based on broad levels of responsibility, personal qualifications, and demonstrated competence;

WHEREAS, the National Defense College of the Philippines (NDCP) which was created under Presidential Decree No. 190 (s. 1973), as amended, has prescribed a Masters in National Security Administration (MNSA) Program where key military and civilian officials of the government, as well as executives in the private sector may qualify for admission;

WHEREAS, Executive Order No. 696 (s. 1981), as amended by Executive Order No. 771 (s. 1982), granted CES rank to MNSA graduates of the NDCP belonging to the civil service with corresponding compensation and other benefits;

WHEREAS, Memorandum Order No. 372 (s. 1991), established a modified ranking structure and salary schedule in the CES, CES Rank I with a corresponding salary grade of 30 as the highest rank, and CES Rank VI with a corresponding salary grade of 25 as the lowest rank;

WHEREAS, Executive Order No. 145 (s. 2021) amended Executive Order No. 696 (s. 1981), which provided:

"SECTION 1. Amendment to EO No. 696, as amended. Section 2 of EO 696, as amended, is further amended to read as follows:

"SECTION 2. Grant of Career Executive Service Officer (CESO) Rank. Graduates of the Master in National Security Administration Program of the National Defense College of the Philippines who are appointed to Career Executive Service positions shall be granted the CESO rank that is commensurate to their respective CES positions, subject to requirements to be prescribed and mandated by the Career Executive Service Board.";

NOW THEREFORE, foregoing premises considered, the Board RESOLVES, as it is hereby RESOLVED, to adopt the following Implementing Guidelines of Executive Order No. 145, Series of 2021, entitled, "Reinforcing the Policy on the Grant of Career Executive Service Officer Rank to Graduates of the National Defense College of the Philippines, Further Amending Executive Order No. 696 (s. 1981), as Amended for the Purpose":

A. Coverage

These guidelines shall be applicable only to graduates of the MNSA program of the NDCP, who are appointed to CES positions, as well as those who occupy regular positions in the national government, and who have not yet been appointed to a CES rank.

B. MNSA Graduates Occupying CES Positions

1. Original Appointment. An MNSA graduate appointed to a CES position shall be granted the CESO rank that is commensurate to his/her respective CES position subject to the requirements prescribed herein.

2. Requirements for Original Appointment. To be appointed to the CES rank, the MNSA graduate shall comply with the following requirements:

a. Incumbent to a CES position;

b. At least "Very Satisfactory (VS) Performance Rating for previous MNSA Graduates;

c. Documentary Requirements:

(i) Copy of the MNSA diploma duly certified by an authorized official of the NDCP;

(ii) Endorsement of Department Secretary/Head for previous MNSA Graduates. Provided, however, that for recent MNSA Graduates, the endorsement letter from their respective agencies to the MNSA program shall suffice;

(iii) Clearances from the: (i) Department or Agency of the MNSA Graduate; (ii) Office of the Ombudsman; (iii) Sandiganbayan; (iv) Civil Service Commission; (v) National Bureau of Investigation;

(iv) Agency certification that he/she has not been formally charged;

(v) Drug test certificates issued by any government forensic laboratories or by any of the drug-testing laboratories accredited and monitored by the Department of Health;

(vi) Notarized self-certification that the applicant did not receive nor solicit any donation/s, gift/s, gratuity, favor or anything of monetary value from or made any unnecessary interaction for any financial or material interest with the Tobacco industry;

(vii) Certificate of no disallowance/s and unliquidated cash advance/s from the Finance/Administrative Division of the agency of the applicant;

(viii) Recent sworn Statement of Assets and Liabilities, and Net Worth, Disclosure of Business Interests and Financial Connections and Identification of Relatives in the Government Service and Certification from the SALN Review and Compliance Committee (RCC) attesting to the full compliance as to the timeliness, completeness and in proper form of the candidate's submission of his/her SALN;

(ix) Copy of the appointing paper of his/her present position duly authenticated by the HR/Administrative Department/Personnel;

(x) Updated Personal Data Sheet (CS Form 212); and

(xi) Copies of training certificates.

3. Non-Compliance with Requirements. Until all the requirements are complied with, he/she shall not be recommended by the Board for appointment to a commensurate CES rank.

4. Conferment of CES Eligibility. Upon approval by the Board of the resolution recommending to the President the appointment of an MNSA graduate who is appointed to a CES position to a commensurate CES rank, a conferment of CES Eligibility shall likewise be conferred unto him/her. By virtue thereof, he/she shall be registered in the Roster of CES Eligibles, and a corresponding certificate shall be issued to him/her.

5. Effect of CES Rank Appointment. Once he/she is appointed to a commensurate CES Rank, he/she shall immediately comply with the following training requirements corresponding to his appointed rank:

 

CESO I

Completion of Leadership and Management Proficiency (LAMP) Program and three (3) accredited training programs and its equivalent

CESO II

Completion of LAMP Program and two (2) accredited training programs and its equivalent

CESO III

Completion of LAMP Program and one (1) accredited training programs and its equivalent

CESO IV

Completion of Salamin, Diwa, and Gabay ng Paglilingkod Training Courses

CESO V

Completion of Salamin and Diwa ng Paglilingkod Courses

CESO VI

Completion of Salamin ng Paglilingkod Course

 

He/she may also opt to take MNSA electives equivalent to LAMP Modules, or avail of the Equivalency and Recognition of Prior Learning as provided for by CESB Resolution Number 1281, s. 2016, entitled, "Supplemental Policy on the CES Accreditation and Equivalency System (CESAES), as amended by CESB Resolutions 1447 and 1478, s. 2019.

Furthermore, MNSA graduates, including those from the military, who wish to enter the civilian government, shall take the CESB Assessment Center, as a mechanism to determine their areas for professional development based on the competency requirements of a CESO.

The CESB rules on promotional appointment, revocation/demotion in CES rank, reactivation of CES rank, and all related future issuances shall be applicable to him/her. Provided further, that the MNSA graduate who has been granted a commensurate CESO rank shall be required to maintain at least "Very Satisfactory (VS)" performance rating thereafter.

C. MNSA Graduates Occupying Non-CES Positions

1. Grant of CES Eligibility. Upon submission of the documentary requirements under Paragraph B, 2. b and c of these guidelines, an MNSA graduate occupying a non-CES position shall be conferred CES eligibility following the approval of the resolution by the Board. He/She shall be registered in the Roster of CES eligibles, and a corresponding certificate shall be issued to him/her.

2. Requirements for Original Appointment. His/Her appointment to a CES rank is preconditioned upon compliance with Section B (2) of these Guidelines.

D. Salary Adjustment

1. Grant of Salary Equivalent. Salary equivalent to Salary Grade (SG) 25 shall be granted to an MNSA graduate who occupies a regular position that is at least a division chief level with SG 24, provided he is still in the service as of the time of assessment.

2. Exemption. Officials and employees of agencies which are exempted by law from the Position Classification and Compensation System (PCCS) and/or do not follow the salary schedule prescribed for government personnel are not entitled to salary adjustment herein authorized.

3. Salary Adjustment Process. The Human Resource Management Officer/Administrative Officer of the concerned agency shall prepare the Notice of Salary Adjustment herein attached as Annex "A" for approval by the Head of Agency. Copies of this approval shall be distributed, as follows:

a. One (1) copy to the Department of Budget and Management (DBM);

b. One (1) copy to the Commission on Audit (COA);

c. One (1) copy to the Civil Service Commission (CSC);

d. One (1) copy to the Government Service Insurance System (GSIS), if he/she is a member thereof;

e. One (1) copy to the MNSA Graduate; and

f. The original shall remain with the concerned agency.

4. Funding Source. The funding requirements of the salary adjustments shall be charged against the available Personnel Services (PS) allotments of the concerned agency, subject to budgeting, accounting, and auditing laws, rules and regulations. The additional amount necessary shall be reported immediately to the DBM for issuance of appropriate advice.

RESOLVED ALSO, that the CSC, DBM, and COA shall be furnished a copy of this resolution for its information and guidance.

RESOLVED FURTHER, that if any section or part of this resolution shall be held invalid, the remaining provisions shall be given full force and effect.

RESOLVED FINALLY, that all existing CESB issuances inconsistent with this resolution, such as CESB Resolution No. 764 (s. 2008) that accredited the MNSA degree as equivalent to the CES Written Examination, are hereby repealed, modified or amended accordingly.

This Resolution shall take effect immediately upon publication.
