IMPLEMENTING FRAMEWORK OF EXECUTIVE ORDER NO. 156, S. 2021
WHEREAS, Republic Act (RA) No. 9136 or the "Electric Power Industry Reform Act of 2001" declares it a policy of the State to accelerate the total electrification of the country and ensure the quality, reliability and affordability of power; HTcADC
WHEREAS, RA No. 10531 or the "National Electrification Administration (NEA) Reform Act of 2013," declares it a State policy to empower and enable electric cooperatives to pursue rural electrification, especially in economically unviable areas;
WHEREAS, consistent with the commitment of the Philippines to support the United Nations General Assembly Sustainable Development Goal of attaining universal energy access, this Administration aims to achieve inclusive and nationwide access to electricity, and ensure total household electrification by 2022;
WHEREAS, RA No. 9136 empowers the Department of Energy (DOE) to ensure the reliability, quality and security of the supply of electric power, and facilitate and encourage reforms in the structure and operations of distribution utilities for greater efficiency and lower costs;
WHEREAS, NEA exercises supervision over electric cooperatives and is empowered under RA No. 10531 to exercise step-in rights and take over the operations of any ailing electric cooperative;
WHEREAS, on 24 May 2018, the DOE issued the Department Order No. D02018-05-0010 entitled "Creation of a Task Force to Ensure Access to Electricity for the Communities that Remain Unserved and Underserved by Distribution Utilities" for the purpose of ensuring access to electricity for the communities that remain unserved and underserved by distribution utilities and electric cooperatives as mandated by their respective franchises;
WHEREAS, Executive Order (EO) No. 156 entitled "Instituting Measures to Ensure Consistent and Reliable Electricity Service in Inadequately Served Areas, Improve Performance of Ineffective Distribution Utilities, and Achieve Total Electrification of the Country" was issued by the Office of the President on 09 December 2021;
WHEREAS, in the 14 December 2021 Memorandum from the Executive Secretary, the DOE shall exercise the step-in rights and take over the operations of ailing electric cooperatives.
NOW THEREFORE, in consideration of the foregoing premises, the following are hereby ordered:
SECTION 1. Creation of the DOE EO 156 Composite Team. —
Under the direct supervision and guidance of the DOE, the DOE EO 156 Composite Team is hereby created with the following functions:
1.1 To implement EO 156;
1.2 To provide further details in the manner of implementation including the timeline with due consideration to short term achievables in the next six (6) months;
1.3 Identify sources of funding to implement the programs under EO 156; and
1.4 Perform such other functions to accelerate the implementation of the mandate as provided for in EO 156.
SECTION 2. Special Considerations. —
In relation to the task and the timeline mentioned in the foregoing provision, the EO 156 Composite Team must be able to:
2.1 Identify the unviable, unserved, underserved, and poorly served areas the soonest possible preferably in two (2) months and must have accordingly identified the corresponding action plan in connection thereto based on the Comprehensive Electrification Master Plan (CEMP) and other related and pertinent documentations;
2.2 Complete the framework and process in the takeover of ailing electric cooperatives within two (2) months for immediate implementation; and
2.3 In anticipation of the details to set forth by above-stated frameworks, the DOE and/or the DOE EO 156 Composite Team may start to operationalize and execute the mandate of EO 156 in the interest of time. To realize full implementation, actions taken prior to the issuance of the above-stated framework must be aligned and consistent with the finalized and approved guidelines.
SECTION 3. Composition. —
The DOE EO 156 Composite Team shall be composed of the following:

SECTION 4. DOE EO 156 Technical Working Groups (DOE EO 156 TWG). —
A TWG, composed of representatives from DOE and its attached agencies and from other government agencies as may be required by the composite team, shall be established and will provide technical support to the DOE EO 156 Composite Team. All DOE Bureaus and Field Office shall assist and support the planning and operation of the DOE EO 156 Composite Team. aScITE

Moreso, the TWG shall have the following responsibilities:
4.1 Monitoring the implementation of all program components/activities;
4.2 Consolidate/integrate accomplishments and output of each program components;
4.3 Maintain Program Database;
4.4 Conduct regular evaluation/assessment of the program to identify and address issues affecting the implementation of the program; and
4.5 Prepare reports, presentation materials and other documents relative to the program.
SECTION 5. DOE EO 156 Secretariat. —
The DOE EO 156 Composite Team and its TWG, in all of its regular and special meetings shall have an administrative support from its Secretariat which shall be led by DOE EPIMB-REAMD and DOE EPIMB-PPDD, EPIMB-PMDD and EPPB-PD representatives as members.
SECTION 6. Reportorial Requirements. —
The DOE EO 156 Composite Team is directed to submit weekly reports to the DOE Secretary in relation to the implementation of EO 156.
The DOE EO 156 Composite Team shall prepare for DOE a report to the President on the programs and corresponding timelines adopted by distribution utilities/electric cooperatives within sixty (60) n from the issuance of EO 156 and a status report on the implementation of the EO six (6) months after the initial report.
SECTION 7. Coordination with the Energy Regulatory Commission and NEA. —
The DOE EO 156 Composite Team is tasked to coordinate with ERC and NEA with respect to their respective mandates under EO 156.
SECTION 8. Assistance and Cooperation. —
The DOE EO 156 Composite Team may request assistance and cooperation from other agencies to carry out its task under this Department Order pursuant to EO 156.
SECTION 9. Repealing Clause. —
Given that all responsibilities assigned to the TFEM were already part of the responsibilities of DOE EO 156 Composite Team, Department Order No. DO2018-05-0010 is expressly repealed and all other issuances inconsistent with this Department Order are hereby revoked or modified accordingly. HEITAD
SECTION 10. Separability. —
Should any provision of this Department Order or any part thereof be declared invalid, the other provisions, shall remain in full force and effect.
SECTION 11. Effectivity. —
This Department Order shall be effective immediately upon signing.
