SUPREME COURT MEMORANDUM ORDER NO. 06-07
PRESCRIBING THE GUIDELINES ON THE USE OF THE MOBILE COURT BUSES, FUEL CONSUMPTION, AND AVAILMENT OF AUTOMOTIVE MAINTENANCE SERVICES
WHEREAS, Section 361, Chapter 4 (Use, Repair and Maintenance of Government Vehicles), Title 6, Book III, Volume I of the Government Accounting and Auditing Manual lays down the rules on the use of government vehicles and fuel consumption;
WHEREAS, the use of the three (3) Mobile Court buses must be properly controlled and regulated, and fuel consumption in relation thereto must be properly monitored;
WHEREFORE, these guidelines on the use of the Mobile Court buses, fuel consumption, and availment of maintenance service are hereby adopted:
SECTION 1. Coverage. — These guidelines shall apply to the three (3) Mobile Court buses.
SECTION 2. Guidelines. — The following guidelines shall be observed in the use of the Mobile Court buses, as well as fuel consumption and availment of automotive maintenance services:
a. All Mobile Court buses shall be used for official purposes only. Unless properly and duly authorized, the use of said vehicles on Saturdays, Sundays, legal holidays, beyond the regular hours for going to and from the office, or outside the route of the officials or employees authorized to use them is strictly prohibited.
b. No Mobile Court bus shall be used for purely private social functions or for other personal purposes, or for the spouse, children, relatives, or friends of the official and employees of the courts.
c. The Mobile bus assigned to Metro Manila must be kept in the Supreme Court's compound except when in use for strictly official purposes while the two (2) Mobile Court buses deployed outside of Metro Manila must be kept in a safe and secured place as determined by the Executive Judge concerned in coordination with the Provincial PNP as agreed upon in the MOA for that purpose.
d. Requisition for diesel fuel, petroleum oil and other related products (Annex "A") for the use of the Mobile Court shall be duly accomplished by the Clerk of Court and approved by the Executive Judge In-Charge of the Mobile Court. No requisition for gasoline or diesel shall be dispensed and paid by the Court unless there has been a prior approval.
e. Minor repairs and maintenance of the Mobile Court buses shall be undertaken by the contracted fuel supplier upon written authorization of the Executive Judge In-Charge.
f. Electrical, mechanical and other related services necessary to maintain the roadworthiness of the Mobile Court buses which repair cannot be handled/undertaken by the contracted fuel supplier (except those under warranty), is subject to the required pre-repair inspection report duly approved by the Court Administrator (Annex "B") and should be done only by the duly accredited/authorized service repair center of Phil Hino. In the event that there is no available authorized repair center in the locality, shopping/canvass of prices from at least three (3) reputable repair centers must be obtained and thereafter the same should be forwarded to the Property Division, OAS, OCA for evaluation and recommendation. Should the Court Administrator approve the repair, the Property Division, OAS, OCA shall notify the Executive Judge immediately for implementation.
g. The Clerk of Court concerned shall submit a monthly report of fuel consumption of the Mobile Court bus to the Property Division, OAS, OCA. The Clerk of Court shall maintain a file of all the reports on fuel consumption and availment of maintenance services.
SECTION 3. Applicability of the General Accounting and Auditing Manual. — Whenever applicable, the provisions of the General Accounting and Auditing Manual shall govern. cIEHAC
SECTION 4. Implementing Office. — The Executive Judge In-Charge of the MC bus must ensure compliance with these Guidelines and other pertinent rules on the use of government vehicles and fuel consumption.
SECTION 5. Effectivity. — These guidelines shall take effect on the 2nd day of February 2007.
