Sirs/Mesdames :
Please take notice that the Court en banc issued a Resolution dated June 13, 2012, which reads as follows: EITcaD
"A.M. No. 12-6-13-SC
GUIDELINES ON REQUESTS FOR TRAVEL ABROAD OF ALL MEMBERS AND PERSONNEL OF THE APPELLATE COURTS AND TRIAL COURTS, AND OFFICIALS AND PERSONNEL OF THE SUPREME COURT AND THE OFFICE OF THE COURT ADMINISTRATOR
WHEREAS, Memorandum Order No. 26 dated 31 July 1986, modifying Executive Order No. 6, provided that the Supreme Court may promulgate guidelines on travels abroad for its members and for those of the lower courts and their respective employees;
WHEREAS, the Supreme Court issued on 12 September 2000 a Resolution amending A.M. No. 96-3-06-0, providing for the "Guidelines on Requests for Travel Abroad on Official Business or Official Time by all Members and Personnel of the Judiciary," which does not apply for non-official travel abroad or for a private purpose;
WHEREAS, OCA Circular No. 49-2003 dated 20 May 2003, providing for the "Guidelines on Requests for Travel Abroad and Extensions for Travel/Stay Abroad," applies only to trial court judges and personnel;
WHEREAS, pending a wholistic review of the guidelines for travels abroad of all members and personnel of the Judiciary, there is a need to issue a resolution on the guidelines on requests for travel abroad of Appellate Court Justices, Trial Court Judges, Court Administrator, and their respective personnel, and of the officials and personnel of the Supreme Court to streamline the existing procedures in the disposition of requests for travel abroad.
WHEREFORE, the Court resolves to adopt a more efficient and expedient method of processing requests for travel abroad of members and personnel of the appellate courts and trial courts, and officials and personnel of the Supreme Court and the Office of the Court Administrator; viz.:
1. All requests for travel abroad of the Justices and personnel of the appellate courts (Court of Appeals, Sandiganbayan, and Court of Tax Appeals), other than requests for travel abroad on official business or official time which are covered by A.M. No. 96-3-06-0, as amended, shall be acted upon by the Presiding Justice of the concerned appellate court without anymore referring the matter to the Supreme Court. However, all requests for travel abroad of the Presiding Justices of the Court of Appeals, Sandiganbayan, and the Court of Tax Appeals shall be submitted to the Supreme Court, and shall be referred to the Chairmen of the Divisions for their appropriate action. 2. All requests for travel abroad of trial court judges and personnel, other than requests for travel abroad on official business or official time which are covered by A.M. No. 96-3-06-0, as amended, shall be filed with the Office of the Court Administrator (OCA), in accordance with OCA Circular No. 49-2003. Such requests shall be acted upon by the OCA, which shall no longer refer such matter to the Supreme Court.
3. All requests for travel abroad of Supreme Court personnel, other than requests for travel abroad on official business or official time which are covered by A.M. No. 96-3-06-0, as amended, shall be submitted to the Office of Administrative Services of the Supreme Court for evaluation and recommendation, and referred to the Supreme Court Clerk of Court for appropriate action. However, all requests for travel abroad of the Clerk of Court of the Supreme Court shall be referred to the Chairmen of the Divisions for their appropriate action.
4. All requests for travel abroad of OCA personnel, other than requests for travel abroad on official business or official time which are covered by A.M. No. 96-3-06-0, as amended, shall be submitted to the Office of Administrative Services of the Supreme Court for evaluation and recommendation, and referred to the Court Administrator for appropriate action. However, all requests for travel abroad of the Court Administrator, Deputy Court Administrators, and Assistant Court Administrators shall be submitted to the Supreme Court, and shall be referred to the Chairmen of the Divisions for their appropriate action.
The provisions of previous circulars, resolutions, or orders inconsistent herewith are deemed repealed or modified accordingly.
This resolution shall take effect immediately. cADaIH
