SUBJECT : Guidelines in the Processing of Sketch Plan (Sk)/Special Plan (Sp) in Support to the Issuance of Proclamation for Information Technology (IT) Buildings under the Philippine Economic Zone Authority (PEZA)

 

Pursuant to Executive Order (EO) No. 192 or the Reorganization Act of DENR, which mandates the Land Management Bureau (LMB) to recommend policies and programs for the efficient and effective administration, survey, management and disposition of alienable and disposable lands of the public domain and other lands outside the responsibilities of other government agencies, DENR Memorandum Circular (DMC) No. 2010-13 or the Adoption of the Manual on Land Survey Procedures, and consistent with PEZA Resolution No. 00-411 entitled, "Guidelines on the Registration of Information Technology (IT) Enterprises and the Establishment and Operation of IT Parks/Buildings," the following procedures are hereby prescribed for the guidance of all concerned:

SECTION 1. Basic Policy. — It is the policy of the State to ensure the efficient management, development, equitable distribution and use of the country's environment and natural resources.

SECTION 2. Objective. — This Circular aims to provide a uniform guideline in processing request for Sketch plan/Special plan of the land as a requirement for the issuance of Proclamation specifically for IT Buildings under PEZA.

SECTION 3. Scope and Coverage. — This Circular shall apply to all requests for Sk/Sp for the issuance of Proclamation for IT Buildings nationwide under PEZA.

SECTION 4. Sketch Plan/Special Plan Processing Scheme. — Consistent with PEZA Resolution No. 00-411, the following shall be observed and implemented:

4.1 Sketch Plan for untitled properties or Special Plan for titled properties shall be issued by the DENR to be included as one of the requirements for PEZA Board consideration on the proposed IT Building. The plan shall have a survey symbol and numbering using the Philippine Standard Geographic Codes (PSGC) as follows:

a. For Sketch Plan (untitled properties) — Sk-Regional code-serial number (IT building)

Example Entry No. Sk-130000000-001 (IT building)

Where:

Sk — Sketch plan for untitled properties

130000000 — PSGC code for NCR

001 — sequence number of sketch plan

b. For Special Plan (titled properties) — Sp-Regional code-serial number (IT building)

Example Entry No. Sp-060000000-001 (IT building)

Where:

Sp — Special plan for titled properties

060000000 — Regional code for Region VI

001 — sequence number of special plan

4.2 All portion of lands occupied by the IT building shall have a corresponding Technical Description (TD).

4.3 All Sk/Sp shall reflect a notation "for reference only, not for titling and registration purposes."

4.4 All Sk/Sp shall be approved by the Assistant Regional Director (ARD) for Technical Services. These plans shall be entered into the LAMS Philippines and shall be tagged as a separate file/database.

4.5 In case where the IT Building transects one or more lot, all affected lots should be plotted with dotted lines.

SECTION 5. Effectivity. — This Circular takes effect immediately.
