Guidelines in the Implementation and Control of Domestic Shipping Rates during Public Health Emergency

MARINA ADVISORY NO. 2020-19

In line with Proclamation No. 922 declaring the entire country under a state of public health emergency due to the outbreak of Corona Virus Disease (COVID-19) and pursuant to Section 10 (10.12), Rule III of The 2014 Amendments to the Revised Rules and Regulations Implementing Republic Act No. 9295 mandating the MARINA to adopt such rules and regulations which ensures the reasonable stability of passenger and freight rates and if necessary, to intervene in order to protect public interest, and in order not to impede the continued movement of essential goods, most especially in times of national emergency, the following are hereby implemented:
1. All ship owners/operators/charterers and other concerned operating in the liner service are encouraged to perform their corresponding duty under the law to provide the necessary shipping services in order to meet emergency sealift requirements or when public interest so requires.
2. The MARINA appeals for your kindness and generosity in accordance with your company's corporate social responsibility particularly in this time of crisis to maintain the CPC-authorized cargo and freight rates being implemented or charged prior to the declaration of public health emergency and enforcement of enhanced community quarantine.
3. Any upward rate adjustment therefore is hereby discouraged.
This MARINA Advisory shall take effect immediately and shall remain valid and subsisting until otherwise revoked/amended/modified or until further notice.
