1.0 Purpose
This Circular is being issued to prescribe rules and regulations to govern the second phase implementation of the new salary structure for the officers and enlisted personnel of the BFP and BJMP pursuant to Section 12 of Republic Act (RA) No. 9263, "An Act Providing for the Professionalization of the BFP and the BJMP Amending Certain Provisions of RA 6975, Providing Funds Thereof and for Other Purposes", Joint Senate-House of Representatives Resolution No. 1 s. 2004, authorizing the salary upgrading of said uniformed personnel and RA No. 9336, the CY 2005 General Appropriations Act (GAA).
2.0 Coverage
This Circular shall cover all officers and enlisted personnel of the BFP and BJMP.
3.0 Implementing Rules
3.1 The base pay adjustment, equivalent to thirty-five percent (35%) of the incremental cost required to fully implement the salary structure prescribed under RA 9263, shall be implemented effective January 1, 2005. However, the funding requirement for the one year implementation shall only be up to the extent of the authorized appropriations under RA 9336.
3.2 The present base pay of the uniformed personnel of the BFP and BJMP for purposes of this Circular shall mean the base pay received as of December 31, 2004 as prescribed under the First Interim Salary Schedule in Annex A of National Budget Circular (NBC) 494 s. 2004. aDcETC
3.3 The adjusted rates in implementing the 35% increment cost between the PNP and BFP/BJMP rates of pay as well as the monthly adjustment in implementing for one year the available appropriations for the purpose under RA 9336 is as prescribed in the Second Interim Salary Schedule hereto attached and marked as Annex A of this Circular.
3.4 The rates contained in said Salary Schedule shall be used as basis for computing longevity pay, year-end bonus and retirement benefits. The existing rates of all other allowances and collateral benefits shall be maintained.
4.0 Funding Source
The amount necessary to implement the Second Interim Salary Schedule shall be charged against the P177,525,000 and P73,468,000 for BFP and BJMP, respectively, appropriated for the purpose under RA 9336.
5.0 Responsibility of the Head of Agency
The Fire/Jail Chief shall be held liable for any payment of salary adjustment not in accordance with the provisions of this Circular, without prejudice however, to the refund of any excess payment by the personnel concerned. HICEca
6.0 Saving Clause
Cases not covered by the provisions of this Circular shall be referred to the Secretary of Budget and Management for resolution.
7.0 Effectivity
This Circular shall take effect January 1, 2005.
