BPS MEMORANDUM CIRCULAR NO. 003-19

| SUBJECT | : | Guidelines for the Implementation of DAO 19-05 Series of 2019 |
WHEREAS, the Department Administrative Order (DAO) 19-05 Series of 2019 took effect on 21 April 2019, the objective of which is to strictly ensure that glass products comply with the specified safety and/or quality requirement/s as prescribed therein;
WHEREAS, as provided in the transitory provisions (Rule 25) of DAO 19-05:2019, all manufacturers with existing valid PS License shall comply with the procedures and requirements of the DAO 19-05:2019 on the subsequent surveillance audit immediately upon effectivity of the said DAO. Likewise, all PS license applications received after the effectivity of DAO 19-05:2019 shall be subject to the procedures and requirements prescribed therein;
WHEREAS, the interested parties consisting of manufacturers and importers expressed their support in the intention of the Department of Trade and Industry to ensure consumer protection through mandatory certification of glass products;
WHEREAS, taking into consideration the number of glass products covered by the implementation of DAO 19-05:2019 as well as the request from various stakeholders, the transitory period provided therein needs to be extended to give all stakeholders reasonable time to make the necessary preparations and adjustment to comply with the requirements; aScITE
WHEREAS, Rule 23 of DAO 19-05:2019 prescribes that the BPS may issue procedural guidelines as may be necessary in the implementation of the said DAO;
WHEREFORE, foregoing premises considered, this supplemental guideline is hereby issued for the guidance of all concerned;
1. All local/foreign manufacturers and importers of glass products covered under DAO 19-05:2019 may voluntarily comply with the procedures and requirements prescribed in the said DAO until 08 August 2019.
2. All importation of glass products covered under DAO 19-05:2019 sourced from foreign manufacturers without a valid PS License shall be allowed until 08 August 2019. However, all importers shall be required to secure Certificate of Exemption from the Bureau of Philippine Standards, subject to compliance with the following requirements:
a. Submission of accomplished Product Certification Information Management System (PCIMS) account registration form (one time only unless there are changes);
b. Submission of accomplished Import Commodity Clearance application form through the Product Certification Information Management System of the BPS, together with the required attachments;
c. Payment of the prescribed application and processing fees consistent with Table 2 of DAO 19-05:2019;
3. Distribution of glass products covered under DAO 19-05:2019 sourced from local manufacturers/producers without a valid PS License/Mark shall be allowed until 08 August 2019. However, all local manufacturers shall be required to secure Certificate of Exemption from the BPS subject to compliance with the following requirements:
a. Submission of accomplished PCIMS registration form (one time only unless there are changes);
b. Submission of accomplished Philippine Standard (PS) Certification Mark License application form, together with the required attachments (if available).
4. Starting 09 August 2019, all local/foreign manufacturers and importers of glass products covered by DAO 19-05:2019 shall be subject to the process and requirements prescribed therein. As such, all imported glass products shall be sourced only from a foreign manufacturing company holding a valid PS License. Likewise, all shipments shall be required to undergo the Statement of Confirmation process as stated in the aforementioned DAO. DETACa
In addition, only local manufacturers holding a valid PS License shall be allowed to manufacture and distribute covered glass products.
5. Starting 09 May 2020, all glass products covered by DAO 19-05:2019 that shall be distributed in the local market shall bear a valid PS Mark. Compliance therewith shall be verified through the conduct of market monitoring and enforcement activities. All non-compliant product shall be subject to the appropriate legal actions.
6. To facilitate faster turn-around time in processing SOC application, Humidity Test shall be excluded from the Critical Test requirement.
7. For the Radiation Test, conduct of the same shall be required only during surveillance audits. This requirement shall be waived during initial and re-certification audits but the manufacturer should submit copy of a third party test report showing conformance to the Radiation Test requirement.
This Memorandum Circular shall be effective immediately after its publication in the Official Gazette and DTI website, a copy of which shall be submitted to the UP Office of the National Administrative Register. HEITAD
