CDA MEMORANDUM CIRCULAR NO. 2006-10
GUIDELINES FOR THE DELISTING OF COOPERATIVE NAME FROM REGISTRY OF COOPERATIVES
Pursuant to Article 69 of RA 6938, Section 3(g) of Republic Act No. 6939, the Cooperative Development Authority hereby adopts and promulgates the following Guidelines for delisting of cooperative name.
SECTION 1. Scope. — This Guideline shall cover the delisting of the cooperative name from the updated registry of cooperatives.
SECTION 2. Definition. — The following definitions shall govern in the uniform interpretation of these guidelines:
a. Registration — is the operative act of the Authority granting juridical personality to a proposed cooperative and is evidenced by the certificate of registration under its seal.
b. Certificate of Registration — A document evidencing the due execution of registration and conferment of juridical personality to a cooperative.
c. Permanent Registry of Cooperatives — is a complete and cumulative list of registered/confirmed cooperatives at; a) the Central Office, and b) Regional Offices beginning from the establishment of CDA in 1990.
d. Registry of Existing Cooperatives — is the current list of existing cooperatives at the Central and Regional Offices as of a particular period.
e. Posting — shall refer to the act of publishing the quarterly list of existing and delisted cooperatives in the conspicuous place or bulletin board of the Central/Regional Office concerned.
f. Cancellation — The final phase by which the legal existence and juridical personality of a cooperative is terminated and all its powers, functions, rights, privileges granted to such cooperative are extinguished.
g. Delisting — The act of striking out or deleting the registered/confirmed cooperative name from the Registry of Existing Cooperatives after its certificate of registration/confirmation have been ordered cancelled. DacASC
SECTION 3. Procedure for Delisting. —
For Central Office
a. The Registration Division (RD) shall submit report/list of tertiary/special cooperatives recommended for delisting duly noted by LRD Director;
b. ED recommends approval of recommended cooperatives for delisting to the Board of Administrators (BOA);
c. BOA issues resolution for delisting of recommended list; and
d. RD delist cooperative name from registry.
For Extension Offices
a. The Area Extension Office Director (AED) shall submit report/list of primary/secondary cooperatives recommended for delisting to the ED through the RD;
b. The RD prepares memorandum to the BOA through the ED;
c. The BOA issues Resolution for the delisting of recommended cooperatives;
d. RD communicates to Extension Office concerned notifying the approved recommendation for delisting of cooperatives; and
e. Registration Unit delist the cooperative name upon the instruction of the AED.
SECTION 4. Maintenance of Cooperative Registry Required. — The CDA Central Office and all Extension Offices shall respectively maintain a nationwide/regionwide registry of permanent, updated, and delisted cooperatives
SECTION 5. Registry of Existing Cooperatives. — Since a permanent registry cannot be altered, the delisting can only be made in the Registry of Existing Cooperatives of the national/regional cooperative registry which is updated monthly. Any information of registered/confirmed cooperative which will be reported/furnished to the public must be approved by the Executive Director/Area Extension Director and shall come from the Registry of Existing Cooperatives.
SECTION 6. General Provision. — The delisted cooperative name shall not be used/registered anymore.
SECTION 7. Effectivity. — These Guidelines shall be effective fifteen (15) days after publication in the Official Gazette.
