Guidelines for Local Government Units in the Implementation of the Social Amelioration Program for the Second (2nd) Tranche

DILG MEMORANDUM CIRCULAR NO. 092-20

 

1. Background/Legal Basis

1.1. Various provisions in the 1987 Constitution (Article II, Sections 4, 5, 9 and 15; Article XIII, Sections 11 and 12; and Article XV, Section 4);

1.2. Republic Act No. 10121 or Philippine Disaster Risk Reduction and Management Act of 2010

1.3. Republic Act No. 11469 or the Bayanihan to Heal as One Act;

1.4. Various Inter-Agency Task Force Resolutions (Nos. 16 and 31), Series of 2020;

1.5. Presidential Proclamation No. 922, Declaring a State of Public Health Emergency Throughout the Philippines;

1.6. Inter-Agency Task Force Enhanced Community Quarantine Operational Guidelines (Item 8);

1.7. Memorandum from the Executive Secretary, dated 22 May 2020, on the Inclusion of Additional Households as Beneficiaries of the Social Amelioration Program and Reconfiguration of the Budget for the Second Tranche; and,

1.8. Joint Memorandum Circular (JMC) No. 2, Series of 2020, by this Department, Philippine National Police (PNP),Department of Budget and Management (DBM),Department of Labor and Employment (DOLE),Department of Social Welfare and Development (DSWD),Department of Agriculture (DA),Department of Trade and Industry (DTI),Department of Finance (DOF),Department of National Defense (DND),and Armed Forces of the Philippines (AFP),or the Joint Implementing Guidelines for the Implementation of the Social Amelioration Program for the Second (2nd) Tranche.

2. Policy Contents and Guidelines

2.1. All LGUs are expected to have completed the distribution or pay-out of the 1st tranche of the Social Amelioration Program (SAP).

2.2. All LGUs are expected to provide (or have provided already) the DSWD with the following:

a. List of paid beneficiaries for the 1st tranche, supported by a signed Barangay Council Resolution, 1 and

b. List of additional beneficiaries certified by the Local Social Welfare and Development Officer (LSWDO) and Local Chief Executive (LCE) concerned.

Note: Without prejudice to the submission of liquidation reports, the necessary documents shall include the corresponding accomplished and encoded SAC forms of the beneficiaries along with the list/s.

2.3. The LGUs shall provide assistance to the beneficiaries in the ReliefAgad Registration. ReliefAgad is an online system developed by DSWD and other partner institutions to aid the generation of the beneficiaries' information and subsequently, fast-track the implementation of the SAP.

2.4. The LGUs shall assist the DSWD, through the LSWDO or any personnel that may be assigned by the LCE, in the distribution of the emergency subsidy.

2.5. The LGUs shall identify and prepare a venue where the payout will be conducted, taking into consideration the minimum health standards (such as, but not limited to, observance of social distancing measures, enforcement of wearing of face masks, etc.) set by the IATF, and if needed, provide necessary shuttle services, assistance, and logistical support to the DSWD and the beneficiaries, especially those belonging to the vulnerable sectors.

2.6. The LGUs shall post in the LGU official websites, social media accounts, and at conspicuous places the list of beneficiaries who have already received the emergency subsidy, with information limited to the following: a) given and last names of the registered head of the family, and b) barangay and district only.

2.7. The LGUs are expected to perform other functions or activities consistent with the provisions of JMC No. 2, series of 2020.

2.8. All LGUs shall closely coordinate with the DSWD, as lead implementer, and the AFP and the PNP, as support to DSWD, in ensuring the expeditious and orderly implementation of the SAP for the 2nd tranche.

2.9. Any irregularity found to be committed by the LGUs in the implementation of the 2nd tranche of SAP shall be dealt with in accordance to RA 11469 and other relevant laws and policies.

2.10. All DILG Regional Directors and the BARMM Minister for Local Government are hereby directed to cause the widest dissemination of this Memorandum Circular within their respective areas of jurisdiction.

3. Effectivity

This Memorandum Circular shall take immediately.

1. In line with COA letter dated 28 May 2020 approving the request of DSWD to rely on the signed Sangguniang Barangay or Barangay Council Resolution attesting that the identified beneficiaries are eligible and qualified in lieu of the liquidation of funds for the release of funds for the second tranche of the SAP. The LCEs shall submit a complete and full liquidation within a period of three (3) months from the lifting of the declaration of the State of Calamity.
