| SUBJECT | : | Guidelines for Inhibition of Judges Who are Former Investigating and/or Inquest Prosecutors |
In its Resolution dated 30 August 2022 in A.M. No. 22-08-98-RTC(Re: Guidelines for Inhibition of Judges Who are Former Investigating and/or Inquest Prosecutors), the Court en banc adopted the following guidelines relative to the inhibition of judges who are former prosecutors:
1) A judge who was a former prosecutor shall mandatorily inhibit in the following cases:
a. Where the former prosecutor participated in the preliminary investigation of the case, including a reviewing or approving prosecutor.
b. Where the former prosecutor conducted inquest proceedings in the case, including a reviewing or approving prosecutor.
c. Where the former prosecutor conducted a re-investigation in the case, including a reviewing or approving prosecutor.
d. Where the former prosecutor participated in the trial of the case.
e. Where the former prosecutor acted in any capacity as a substitute prosecutor for the assigned trial prosecutor in the case, except if the action relates solely to the postponement or resetting of the case.
2) A judge who inhibits pursuant to these guidelines shall be assigned a replacement case by raffle, which shall, as far as practicable, be of the same nature and at the same stage as the inhibited case.
3) On the other hand, a judge to whom the case inhibited from is assigned by raffle shall be entitled to a reduction of the cases to be assigned to his or her court equal to the number of inhibited cases assigned to him or her by raffle.
4) The Clerk of Court shall keep a tabulation of inhibitions, as well as of the replacement cases, and circulate them to all affected judges of the station every month.
5) Any false statement or claim in invoking these guidelines as a ground for inhibition shall be prima facie evidence of Gross Misconduct on the part of the Judge declarant.
Any prior circular from the Office of the Court Administrator on this matter which is contrary to the foregoing is hereby deemed superseded.
These guidelines shall take effect immediately.
