LETTER OF INSTRUCTIONS NO. 1390
PRESCRIBING GUIDELINES AND STANDARDS TO ACCELERATE DEVELOPMENT OF THE "HALIK-ALON" OR FIRST NEIGHBORHOOD UNIT (FNU) PROJECT WITHIN THE RECLAIMED LAND AREA IN THE FORESHORE AND OFFSHORE OF MANILA BAY (THE MANILA-CAVITE COASTAL ROAD PROJECT)
WHEREAS, the Marina Properties Corporation ("MPC"), a corporation wholly-owned by the National Development Company ("NDC"), was acquired by NDC from the Construction and Development Corporation of the Philippines ("CDCP") for the purpose of developing MPC's property situated within the reclaimed land area in the foreshore and offshore of Manila Bay (the Manila-Cavite Coastal Road Project) into a viable self-contained community with a unique development concept; ETISAc
WHEREAS, pursuant to Presidential Decree No. 1085, it is in the public interest to convert the land reclaimed into a modern city and develop it into a governmental, commercial, residential and recreational complex;
WHEREAS, in consonance with the aforementioned policy objective of Presidential Decree No. 1085, the project presently being undertaken by MPC through and with the assistance of NDC within the Manila Bay reclaimed land area, known as the "Halik-Alon" or First Neighborhood Unit (FNU) Project (hereinafter referred to as the "MPC Reclaimed Land Project"), is intended by the Government to serve as a pilot project and model in urban planning and development;
WHEREAS, it is imperative that the said NDC-assisted MPC Reclaimed Land Project be pursued to completion within the earliest possible time and with the least possible constraints.
NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers vested in me by the Constitution, do hereby order and direct the following:
1. For as long as ownership of MPC vests with NDC and provided that NDC owns at least seventy-five percent (75%) of the capital stock or any interest in said capital stock of MPC, the following provisions shall apply:
a) All the government agencies concerned with regulating real estate subdivision and development and the business of selling subdivision lots, condominiums and townhomes shall exempt MPC from their usual regulatory requirements and, when requested by MPC, shall immediately issue the necessary approvals, certificates of registration, permits and clearances for the project and the subdivision plan or plans for each phase or phases thereof in compliance with applicable statutory and administrative requirements, except for those requirements in respect of which compliance shall not be required as hereinafter ordered and directed. The approvals, registrations, permits and clearances already given by the government functionaries and agencies concerned covering the original subdivision plans for Phase I and Phase IV of the project shall stand and shall constitute the basis for the issuance of the necessary subsequent approvals, registrations, permits and clearances for any amendments or modifications to the original plan and other detailed or supplementary plans in respect of the other phases of the project. b) The MPC Reclaimed Land Project being a government-supervised and assisted project through the NDC, and to the end that the MPC and NDC shall have the full discretion to effectively pursue the project's unique development concept and to fully implement, construct and complete the project in accordance with the developmental plans, guidelines, specifications and standards for the project as specially conceived and designed by the MPC and as approved by NDC considering the configuration of the project site, the surrounding channels and the extensive shoreline fronting Manila Bay, the government functionaries and agencies concerned shall desist from enforcing compliance with the usual requirements normally applicable to private real estate subdivision and condominium projects such as the licensing to sell, publication, and performance bond requirements, and those relating to design standards and criteria, alteration of plans, time of completion, open spaces and planting of trees, as prescribed by the pertinent provisions of Presidential Decree Nos. 953, 957 and 1216; Provided, however, that the NDC shall be responsible for seeing to it that the project is fully developed and completed with the least possible delay in strict conformity with the developmental plans, guidelines, specifications and standards specially conceived and designed by MPC and as approved by NDC for the project; and Provided, further, that rights and benefits and safeguards under existing statutory enactments granted to and designed for the protection of buyers of subdivision lots, condominium units and townhomes in the project, such as those embodied in Sections 23, 24, 25, 26, 27, 28, 29 and 30 of Presidential Decree No. 957, shall be respected and shall remain unimpaired.
2. The Public Estates Authority is hereby instructed to assign, cede and transfer to MPC all rights, titles, interests and ownership to such portion or portions of the FNU which have not been previously assigned, ceded and transferred to MPC, without need of any indemnity to the PEA.
The Public Estates Authority (PEA) and/or Ministry of Public Works and Highways (MPWH) or any other agency which is undertaking or shall undertake the supervision of the construction and completion of the Manila-Cavite Coastal Road and the accessory road interchanges and expressways of the complex are hereby instructed to reserve a portion of the reclaimed area under the jurisdiction of the PEA, with sufficient hectarage and at such appropriate location compatible with the developmental plans of the MPC Reclaimed Land Project as determined by the MPC and NDC in consultation with the PEA and MPWH, for the establishment of a permanent passage with connection to the nearest public highway or expressway to provide access to and from the MPC development and subdivision site. This permanent passage shall be in the nature of a compulsory public easement, without need of any indemnity to the PEA.
The Ministry of Public Works and Highways (MPWH) is hereby instructed to provide passage to the FNU with two access bridges of the design and construction compatible with the development in the FNU and appropriately situated in accordance with MPC's development plans. EaISTD
3. The Metropolitan Waterworks and Sewerage System (MWSS) is hereby directed to provide adequate water supply systems in the MPC development and subdivision site and to take the necessary measures to ensure that the systems are operational in accordance with the required standards. In this connection, the MWSS is directed to take steps for the expeditious completion of the PG-7 water supply systems project leading to the MPC development and subdivision site. Pending such completion, the MWSS shall effect the necessary water supply connections to the MPC development and subdivision site through existing available pipelines along Roxas Boulevard within the vicinity of and nearest to the site.
4. All the exemptions, rights and privileges herein provided are hereby accorded to the MPC and NDC to facilitate the development of the MPC Reclaimed Land Project, under government supervision and with government assistance, into a pilot project and model in urban planning and development in keeping with the Government's vision of converting the land reclaimed into a governmental, commercial, residential and recreational complex. Such exemptions, rights, and privileges shall not be extended to any other development project to be undertaken on the reclaimed land, or any portion thereof, pertaining to the project by virtue of an agreement, joint venture or any other arrangement entered into by any other individual or entity the pursuance of which conflicts with the project's unique development concept and contravenes the developmental plans, guidelines, specifications and standards for the project as specially conceived and designed by the MPC and approved by the NDC.
These instructions shall take effect immediately.
Any and all orders, instructions, issuances, memoranda, rules and regulations inconsistent herewith are hereby repealed or modified accordingly.
