NAPOLCOM MEMORANDUM CIRCULAR NO. 14-93

| SUBJECT | : | Granting Preferential Consideration for Appointment in the PNP to the Widow/Widower, or Any of the Beneficiaries, of a PNP Member, who Died or Incurred Total and Permanent Disability while in the Performance of Duty |
Frequently, the death or disability of a PNP member in line of duty results in financial and economic dislocation for the surviving heirs, in view of the death or loss of the bread earner of the family.
In order to alleviate the economic difficulties of such heirs, and to promote their economic and physical security, it appears advisable and necessary to adopt a policy granting them preferential consideration for recruitment in the PNP.
In the view thereof, the widow/widower, or any of the beneficiaries, of a PNP member who died or incurred total and permanent disability in line of duty, shall be given preferential consideration for recruitment in the PNP, subject to the following rules and regulations:
SECTION 1. Definition of Terms. — As used in this Circular, the following terms shall mean and be interpreted as follows:
a. Widow/Widower — refers to the legitimate spouse of the PNP member who died or was killed in line of duty.
b. Beneficiaries/heirs — means the legitimate spouse and children, including the adopted child, of the deceased or totally disabled PNP member.
SECTION 2. Qualifications for Appointment. — To be eligible for preferential consideration for appointment in the PNP under this Circular, the widow/widower, or beneficiary, of deceased/disabled PNP member must meet the minimum qualifications for appointment prescribed in Section 30, R.A. No. 6975, specifically, to wit:
a. A citizen of the Philippines;
b. A person of good moral conduct;
c. Of sound mind and body;
d. Must possess of formal baccalaureate degree for appointment as officer and must have finished at least second year college or the equivalent of seventy-two (72) collegiate units for appointment as non-officer;
e. Must be eligible in accordance with the standards set by the Commission;
f. Must not have been dishonorably discharged from military employment or dismissed for cause from any civilian position in the government;
g. Must not have been convicted by final judgement of an offense or crime involving moral turpitude;
h. Must be at least one meter and sixty-two centimeters (162 m.) in height for male and one meter and fifty-seven centimeters (1.57 m) for female;
i. Must weigh not more than five kilograms (5 kg.) of the standard weight corresponding to his or her height, age and sex; and
j. Must not be less than twenty-one (21) nor more than thirty (30) years of age.
SECTION 3. Preference for the Widow/Widower Over Other Beneficiaries. — The widow/widower has the first priority in the recruitment. However, the widow/widower can waive said privilege in favor of any of the qualified beneficiaries.
SECTION 4. Procedure. — The following procedures shall be observed before the issuance of appointment:
a. Upon death or total and permanent disability in line of duty of a PNP personnel, the widow/widower, or any of the beneficiaries, shall submit an application in writing at the PNP Station or unit where the deceased was last assigned;
b. Unit Chief shall refer the request direct to CPNP/Respective RD, Attn.: DP/ARDP;
c. DP/ARDP shall check the attachment of the following pertinent documents:
1. Written application from widow/beneficiary;
2. Summary of Information or Bio-Data of widow/beneficiary, Marriage Contract and Birth Certificate;
3. Recommendation of Unit Chief;
4. Line of Duty Status;
5. Investigation Report;
6. Certification that the deceased has not committed any crime or human rights violation coming from the PLEB Chairman, or Mayor, or from the Unit Chief when the PNP personnel is not assigned in a police station;
d. When all the attachments are complete, DP/ARDP shall recommend the widow/beneficiary to the Recruitment Board;
e. Recruitment Board shall recommend individual application for approval of CPNP/RD;
f. CPNP/RD shall approve the recommendation and forward the same to NAPOLCOM for confirmation; and
g. CPNP/RD shall issue the corresponding appointment and assign the recruitment widow/widower, or beneficiary, to the station where the deceased was last assigned. However, officers shall be sent to the first available Orientation/Officers Candidates Course and non-officers to the PBC.
SECTION 5. Preferential Consideration for Appointment. — If the widow/widower, or beneficiary, after the requisite processing, is found to possess the minimum qualifications prescribed in Section 30, R.A. 6975, including the appropriate eligibility, said widow/widower, or beneficiary, shall be given preferential consideration for permanent appointment as PO1, with probationary status for a period of one year; Provided, further, That if said widow/widower, or beneficiary, possesses highly technical qualifications, she/he may be considered for lateral entry to the PNP, subject to the requirements of Sec. 33 of R.A. No. 6975.
SECTION 6. Implementing Rules and Regulations. — The Chief PNP shall issue the necessary rules and regulations implementing this Circular within fifteen (15) days from the issuance hereof.
SECTION 7. Effectivity. — This Circular shall take effect immediately.
