OCA CIRCULAR NO. 14-84
TO : All Clerks of Court and Ex-Officio Sheriffs of the Regional Trial Courts
In view of the prohibitive cost of publication, a request was filed with this Court for the revision and/or modification of the Notice of Sale of Extra-Judicial Foreclosure Petition filed with the Sheriff's Offices for publication in newspapers. It proposes to eliminate, for reason of economy, some words or phrases which are of less importance but still will comply substantially with Act 3135.
Pursuant therefore to the Resolution of the Court En Banc, dated April 3, 1984, you are hereby DIRECTED to adopt the following format: prcd
"NOTICE OF EXTRA-JUDICIAL SALE
"Upon extra-judicial petition for sale under Act 3135 __________ filed by __________ against (Name and address of Mortgagor/s) to satisfy the mortgage indebtedness which as of __________ amounts to P________ excluding penalties, charges, attorney's fees and expenses of foreclosure, the undersigned or his duly authorized deputy will sell at public auction on date of sale 198__ at 10:00 A.M. or soon thereafter at the main entrance of the Place of Sale to the highest bidder, for cash and in Philippine currency, the following property with all its improvements, to wit:
"TRANSFER CERTIFICATE OF TITLE NO. _____
"A parcel of land _________________ situated in ________ containing an area ________, more or less, _________.
"Prospective buyers may investigate for themselves the title hereinabove described and encumbrances thereon, if any there be.
"______, 198__.
SHERIFF"
Strict Compliance herewith is hereby enjoined.
