Foreigners who Failed to Comply with the Terms and Conditions of their Provisional Liberty
The BI Operations Order No. SBM-2015-011 outlines procedures for handling foreigners who fail to comply with the terms of their provisional liberty granted under Commonwealth Act No. 613. Such non-compliance results in the immediate cancellation of their provisional liberty and possible forfeiture of any cash bonds posted. The Intelligence Division is responsible for monitoring compliance and reporting violations, while the Legal Division must prepare an order for cancellation and initiate deportation proceedings within three days of receiving reports. Foreigners can file a Motion for Reconsideration, but any forfeited cash bonds will not be returned if used for re-arrest expenses. This order aims to streamline the legal process for dealing with deportable foreigners who violate their provisional liberty conditions.
