SUPREME COURT CIRCULAR NO. 16-86

| SUBJECT | : | Filing of Applications for Optional Retirement |
In order to forestall the situation whereby an applicant for optional retirement continues to render service beyond the date stated in his application or the date of approval of his retirement for lack of notice whether his application has been approved or denied, only to find out later that his application for optional retirement has been already approved; in order likewise to preclude the necessity of validating the official acts performed prior to receipt of such notice of approval of the application for optional retirement; and to afford sufficient time for the determination of the applicant's qualification for optional retirement, the inclusion of the application in the Court's agenda, and notice and service of the Court's action on the applicant;
The following guidelines in filing applications for optional retirement shall be followed:
1. All applications for optional retirement shall specify the date of effectivity thereof and not leave the same effective "upon approval of the Court".
2. All such applications, together with all the necessary documents in support thereof, shall be filed with the Office of the Court Administrator at least two (2) months prior to its effective date, either personally or by special delivery. cdt
3. Within one month following the filing of his application, the applicant must inquire and verify from the Court Administrator as to the status of his application.
4. When the specified date of retirement is reached, without the applicant receiving any notice of approval or denial of his application, he shall cease working and discharging his functions, unless directed otherwise.
Strict compliance herewith is hereby enjoined.
